THE LAW
of 12 November 1999
on measures in relation to the Federal Republic of Yugoslavia
Parliament has decided on this law of the Czech Republic:
Basic provisions
If the United Nations Security Council or the Council of the European Union adopt sanctions against the Federal Republic of Yugoslavia to an extent not exceeding the provisions of paragraphs 3 to 6 of this Law, the Government may, by regulation, provide for, amend, suspend, revoke or renew prohibitions and other restrictions in a manner consistent with the decisions of those bodies of international organisations on those sanctions measures.
Definition of terms
This law means:
(a) by a sanctioned body, the Federal Republic of Yugoslavia or its authorities and representatives,
(b) the sanctioned territory of the territory of the Federal Republic of Yugoslavia or part thereof;
(c) a sanctioned person:
1. citizen of the sanctioned entity,
2. another natural person permanently or predominantly present in the sanctioned territory; or
3. a legal person fully or principally controlled by a sanctioned entity or other sanctioned persons or based, whether formally or in fact, in the sanctioned territory;
(d) Czech person
1. Czech Republic,
2. citizen of the Czech Republic,
3. a natural person without nationality permanently resident in the Czech Republic,
4. a legal person or institutions established in the Czech Republic, and
5. a foreign legal person or institution fully or principally controlled by legal persons or institutions established in the Czech Republic,
(e) goods, any raw material, product or service, whether or not any consideration is given for their supply;
(f) sanctioned goods owned, held or otherwise controlled by a sanctioned entity or a sanctioned person;
(g) goods owned, held or otherwise controlled by a Czech person,
(h) other goods which are not Czech goods or sanctioned goods;
(i) means of transport any machine or equipment capable of transporting persons or goods;
(j) means of transport by means of means of transport of the sanctioned entity;
1. flying a flag, imatriculated, owned, held or used by, or otherwise controlled by, a sanctioned entity; or
2. owned, held, used or otherwise controlled by a sanctioned person,
k) Czech means of transport
1. flying or otherwise controlled by the Czech Republic,
2. owned, held, used or otherwise controlled by the Czech person,
(l) another means of transport which is neither the Czech means of transport nor the means of transport of the sanctioned entity.
Trade and services
In the field of trade and services, the penalty regime may include:
(a) restrictions or prohibitions on the importation or purchase, sale or any other treatment by Czech persons or on the Czech territory, with the exception of the acquisition by a gift or inheritance of the goods,
(b) restrictions or prohibitions on the export, sale or other treatment of Czech goods to a sanctioned entity or to persons or to a sanctioned territory;
(c) restrictions or prohibitions on the transit of Czech goods through the sanctioned territory and the sanctioned goods through the Czech Republic;
(d) restriction or prohibition of transit through the territory of the Czech Republic of other goods into the sanctioned territory or designated sanctioned entity or persons;
(e) restrictions or prohibitions on the provision by Czech persons of any other performance for the benefit of or in the territory of a sanctioned entity or persons, as well as the conclusion of transactions in them; and
(f) restrictions or prohibitions on any other activity which would support or include support for the activity referred to in points (a) to (e);
(g) restrictions or prohibitions on transfers of money from and to accounts held for the benefit of sanctioned entities or sanctioned persons by Czech persons or in the territory of the Czech Republic, with no interest being paid on frozen funds during the period of implementation of the sanction regime;
(h) restrictions or prohibitions on any other provision by Czech persons or from the territory of the Czech Republic of funds and financial and economic resources to sanctioned entities or sanctioned persons; and
(i) the restriction or prohibition on the conclusion or performance of insurance policies for the benefit of a sanctioned entity or persons sanctioned.
Transport and connections
(1) In the field of transport, the penalty regime may include:
(a) restriction or prohibition of crossing the national borders of the Czech Republic by Czech means of transport with a view to entering the sanctioned territory;
(b) restriction or prohibition of crossing the national borders of the Czech Republic by other means of transport through or from the territory of the Czech Republic for the purpose of entering the sanctioned territory;
(c) restriction or prohibition of crossing the national borders of the Czech Republic by means of means of transport of a sanctioned entity, whether for the purposes of entering or leaving the territory of the Czech Republic,
(d) restriction or prohibition of any physical or legal disposition with means of transport of a sanctioned entity located in the Czech Republic;
(e) restrictions or prohibitions on the provision of Czech means of transport to a sanctioned entity; and
(f) limitation or prohibition of repair and provision of spare parts, components or tools necessary for the repair or modification of the means of transport of the sanctioned entity.
(2) In the area of connections, the penalty regime may include:
(a) restrictions or prohibitions on the transport and admission to or intended for a sanctioned territory from or through the territory of the Czech Republic;
(b) restriction or prohibition of telephone calls to a sanctioned entity or to a sanctioned territory;
(c) restrictions or prohibitions on the sending of messages to a sanctioned entity or to a sanctioned territory, whether via mail, telephone, telegraph, computer network or any other means of communication; and
(d) a ban on radio, television or other broadcasting in the sanctioned territory.
(3) The restrictions or prohibitions provided for in paragraph 2 shall not affect the right of the Ministry of Foreign Affairs to contact diplomatic missions and consular posts located in the sanctioned territory.
Technical infrastructure
In the field of technical infrastructure, the penalty regime may include restrictions or prohibitions on the supply of energy and the supply of raw materials necessary for its production from or through the territory of the Czech Republic to a sanctioned entity or sanctioned persons or to a sanctioned territory.
Scientific, technological, cultural and sporting contacts
(1) In the field of scientific and technological relations, the penalty regime may include restrictions or prohibitions on the activities of Czech persons or activities carried out in the territory of the Czech Republic, controlled or controlled, which constitute scientific and technical cooperation involving a sanctioned entity or sanctioned persons, or which is directed towards such scientific and technological cooperation.
(2) In the field of cultural relations, the penalty regime may include restrictions or prohibitions on the activities of Czech persons or activities carried out in the territory of the Czech Republic or from the territory of the Czech Republic controlled or controlled, which constitute the cultural exchange of persons or objects to which a sanctioned entity or sanctioned persons are involved, or which is aimed at such cultural exchange. This also applies mutatis mutandis to unilateral cultural visits or the provision of articles.
(3) In the field of sport relations, the penalty regime may include:
(a) restrictions or prohibitions on the participation of persons or groups representing a sanctioned entity or sanctioned persons in sports events or other sporting events organised in the Czech Republic or by Czech persons;
(b) restrictions or prohibitions on the participation of Czech persons or groups representing the Czech Republic in sports events organised by a sanctioned entity or in a sanctioned territory.
Exemptions from the sanction scheme
(1) The penalty regime does not apply to the supply of food, clothing, medicines, medical supplies and other humanitarian needs necessary to save and survive civilians in the sanctioned territory. However, these deliveries may be subject to control by the competent international authorities or authorities of the Czech Republic and may be subject to authorisation.
(2) The penalty scheme shall not apply to payments and other transactions for humanitarian supplies as referred to in paragraph 1.
(3) The means of transport of the sanctioned entity may enter the territory of the Czech Republic and the Czech means of transport may enter the sanctioned territory if it is in a state of distress.
Compensation
(1) No one is entitled to compensation resulting from the implementation of the penalty scheme.
(2) The Government may, by regulation, determine which Czech persons who have suffered damage as a result of the implementation of the penalty scheme and who are not entitled to compensation under paragraph 1 are to be compensated from the resources of the Czech Republic under what conditions and to what extent; such persons must, however, demonstrate that they have taken all the measures that may reasonably be required of them in the framework of the implementation of the sanction scheme, including the conclusion of adequate safeguards to prevent, reduce or otherwise heal damage.
Efficacy
This Act shall take effect on the day of its publication.
