THE LAW
of 23 July 2009
amending certain laws in connection with the adoption of the Statute for Members of the European Parliament
Parliament has decided on this law of the Czech Republic:
Amendment to the Pension Insurance Act
Act No. 1 / 2007, Act No. 5, Act No. 5, Act No. 5, Act No. 18 / 2000 Coll., Act No. 118 / 2000 Coll., Act No. 24 / 2002 Coll., Act No. 26 / 2004 Coll., Act No. 4 / 2004 Coll., Act No. 46 / 2004 Coll.
1. in Article 5 (1) (ch), the words "and Members of the European Parliament, elected in the Czech Republic" shall be deleted;
2. in Article 6 (1), the following point (f) is inserted after point (e):
"(f) the performance of the duties of a Member of the European Parliament, elected on the territory of the Czech Republic,"
Point (f) shall be renumbered as point (g).
3. The following Section 102b is inserted after Section 102a:
The participation of Members of the European Parliament elected on the territory of the Czech Republic before the date on which the European Parliament's term of office starts in 2009 shall be assessed in accordance with the legislation in force before that date. '
4. In Paragraph 105, the current text becomes paragraph 1 and the following paragraph 2 is added:
"(2) The term of office of a Member of the European Parliament elected on the territory of the Czech Republic shall be deemed to be excluded from the date on which the term of office of the European Parliament begins in 2009 (Paragraph 16 (4))."
Amendment to the sickness insurance law
Act No. 187 / 2006 Coll., on sickness insurance, as amended by Act No. 585 / 2006 Coll., Act No. 181 / 2007 Coll., Act No. 261 / 2007 Coll., Act No. 239 / 2008 Coll., Act No. 305 / 2008 Coll., Act No. 306 / 2008 Coll., Act No. 479 / 2008 Coll., Act No. 2 / 2009 Coll. and Act No. 41 / 2009 Coll., is amended as follows:
1. in Article 5 (a) (9), the words "and Members of the European Parliament, elected in the Czech Republic" shall be deleted;
2. in Paragraph 92 (2) (h), the words "and Members of the European Parliament elected on the territory of the Czech Republic," shall be deleted;
Amendment of the Act on the organisation and implementation of social security
In Article 36 (ch) of Act No. 582 / 1991 Coll., on the organisation and implementation of social security, as amended by Act No. 359 / 2004 Coll., the words "and, for Members of the European Parliament, elected in the Czech Republic, the Office of the Chamber of Deputies' are deleted.
Amendment of the Social Security Insurance Act and contribution to the State Employment Policy
In Article 3 (1) (b) (6) of Act No. 589 / 1992 Coll., on Social Security Insurance and Contribution to State Employment Policy, as amended by Act No. 359 / 2004 Coll. and Act No. 189 / 2006 Coll., the words "and Members of the European Parliament elected in the Czech Republic 'are deleted.
Amendment of the Income Tax Act

1. in Paragraph 4 (1) (zl):
"(zl) remuneration, severance pension, old-age pension, pension, contributions, kind of performance and reimbursement of expenses paid from the budget of the European Union to a Member or former Member of the European Parliament elected in the territory of the Czech Republic, plus provision and reimbursement of expenses granted from the budget of the European Union to a surviving spouse or a registered partner or partner and dependent children in the event of the death of a Member of the European Parliament elected in the territory of the Czech Republic,";
2. in Article 6 (9) (r), the words "and Members of the European Parliament elected in the Czech Republic" shall be deleted;
3. in Article 6 (10) (a), the words "and Members of the European Parliament elected in the Czech Republic" shall be deleted;
TRANSITIONAL PROVISIONS
1. Members of the European Parliament, elected on the territory of the Czech Republic, who were members of the European Parliament in the parliamentary term which ended in 2009 and were re-elected in 2009 and have decided to apply the national system to date throughout their activity in respect of remuneration, severance and pensions (1), continue to participate in sickness and pension insurance under existing legislation; the social security contributions and the contribution to the national employment policy from their salary shall also be paid under these rules, and the employer's tasks shall be carried out by the person responsible for carrying out these tasks for those Members under those rules. This also applies mutatis mutandis to the participation of these Members in staff accident insurance under Act No. 266 / 2006 Coll., on staff accident insurance, as effective by the date of entry into force of this Act.
2. For the taxation of remuneration, retirement, old-age pension, pension, contributions, actual implementation and reimbursement of expenses granted from the budget of the European Union to Members of the European Parliament elected on the territory of the Czech Republic who were members of the European Parliament in the parliamentary term which ended in 2009 and were re-elected in 2009 and have decided to apply the national system to date throughout their activities, Act No. 586 / 1992 Coll., as amended by the date of entry into force of this Act.
EFFECTIVE
This law shall take effect on the first day of the European Parliament's parliamentary term, which shall begin in 2009.
