THE LAW
of 20 July 1990
amending and supplementing the Code of Criminal Procedure
The Federal Assembly of the Czech and Slovak Federal Republic decided on this law:
Act No. 141 / 1961 Coll., on the Criminal Procedure of the Court (Criminal Code), as amended by Acts No. 57 / 1965 Coll., No. 58 / 1969 Coll., No. 149 / 1969 Coll., No. 48 / 1973 Coll., No. 29 / 1978 Coll., No. 43 / 1980 Coll., No. 159 / 1989 Coll. is amended as follows:
Paragraph 71 (2) reads as follows:
"(2) In court proceedings, the detention may last a maximum of one year. However, if the defendant is prosecuted for a crime of terror (§ 93 and 93a), general threats (§ 179 (2), (3)), illicit manufacture and possession of narcotic drugs and psychotropic substances and poisons (§ 187 (3), murder (§ 219), robbery (§ 234 (2), (3), hostage taking (§ 234a (3)), rape (§ 241 (2), (3), and sexual abuse (§ 242 (3), 4), custody before a court may last for a period not exceeding two years, together with the connection in the preparatory proceedings. If such accused person is brought into custody only in court proceedings, the detention may take a maximum of two years. If the prosecution is not completed within these time limits, the defendant must be released. '
This Act shall take effect on the day of its publication.
