DECLARATION
of 11 November 2019
amending Decree No 357 / 2013 Coll., on the Real Estate Register (cadastral decree), as amended by Decree No 87 / 2017 Coll.
According to § 66 (1) (g) of Act No. 256 / 2013 Coll., on the Land Register (cadastral law), the Czech Authority provides:
In Section 69 of Decree No 357 / 2013 Coll., on the Real Estate Register (cadastral decree), the following paragraph 6 is added, including footnote 4:
"(6) If the instrument issued under the conditions laid down directly by the applicable European Union4), which shows universal legal succession, does not specify the rights or properties to which the succession is subject because the legal order of the State in which the charter was issued does not make this possible, the cadastral office shall register a change of ownership or other rights in kind on the basis of that instrument and a declaration by the successor having the formalities laid down in Article 66 (4) (a) to (d) and (f).
(4) Regulation (EU) No 650 / 2012 of the European Parliament and of the Council of 4 July 2012 on jurisdiction, applicable law, the recognition and enforcement of decisions and the acceptance and enforcement of authentic instruments in matters of succession and the creation of a European certificate of succession. ';
Efficacy
This Regulation shall enter into force on 1 January 2020.
