establishing a list of chemicals and chemical products whose production, placing on the market and use are restricted
According to Article 15 (3) of Act No. 157 / 1998 Coll., on Chemicals and Chemical Products and on the amendment of certain other laws, hereinafter referred to as "the Act":
§ 1
The Annex to this Decree sets out a list of hazardous chemicals and dangerous chemicals whose production, placing on the market and use are restricted. 1)
§ 2
This Decree shall take effect on 1 January 1999.

List of substances and preparations whose production, placing on the market and use is restricted
1. Polychlorinated biphenyls (excluding monochlorinated and dichlorinated), polychlorinated terphenyls and preparations containing more than 0,005% of these substances
1. Shall not be included in products placed on the market, e.g. as operating charges for machinery and equipment, etc.
2. Restrictions on the distribution of these substances, preparations and products, such substances or preparations containing them also apply to the sale of products already used (second hand sale).
3. Existing equipment containing the following substances and preparations:
3. 1. in closed systems of transformers, inducers or heat resistors of electrical equipment,
3.2. In capacitors,
3. 3. in heat transfer facilities,
3. 4. as hydraulic fluids in underground mining installations;
may be operated until the end of their lifetime or until they are disposed of. 2)
These machines and equipment may be used only if they are marked with a clear sign: "Contains PCBs (or PCTs)," "Specific regulations shall be followed for decommissioning and disposal."
4. These substances and preparations may be used for the normal maintenance of the equipment and for the operational replenishment of the well-functioning equipment referred to in point 3.
2. Vinyl chloride (chloroethylene, chloroethylene), Cas No 75- 01-4
It may be used with the exception of use as a driving gas in aerosol generators.
3. Liquid substances or preparations which are considered dangerous as defined in Section 2 (8) of the Act
1. It shall not be used in ornamental articles intended to produce light or colour effects by means of different phases, e.g.:
- in decorative lamps and ashtrays,
- in funny and entertaining articles,
- in games for one or more participants or in articles intended to be used as such or with decorative aspects.
2. Substances and preparations constituting an aspiration hazard, marked with the phrase R 65, which may be used as fuel in decorative lamps and placed on the market in packs of 15 l or less, may contain a dye only if added for tax reasons or as a perfuming additive. The packaging of such substances and preparations shall be legibly and permanently marked "Keep lamps with this liquid out of the reach of children." The labelling does not in this way alter the other labelling obligations for dangerous substances and preparations.
4. Tris (2,3-dibromopropyl) phosphate, Cas No 126-72-7
Shall not be used for the treatment of textile products intended to come into contact with the skin, such as clothing, lingerie, bed linen, etc.
5. Benzene, Cas No 71-43-2
1. It may be contained in substances or products placed on the market in quantities not exceeding 0,1% w / w.
2. May be contained in toys or parts thereof in quantities not exceeding 5 mg.kg.1
3. The restriction of benzene content in the products referred to in point 1 shall not apply to:
3. 1. Motor fuels,
3. 2. Substances and preparations used in industrial production in closed systems with a controlled emission contribution complying with the applicable regulations. 3)
6. Asbest
1. Fibrous asbestos
1. crocidolite, Cas No 12001-28-4
1.2. Amosit, Cas No 12172-73-5
1. 3. anthophylite, Cas No 77536-67-5
1.4. actinolite, Cas No 77536- 66-4
1.5. tremolite, Cas No 77536- 68-6
shall not be added to products placed on the market.
2. Fibrous asbestos chrysolite, Cas No 12001-29-5 shall not be used for the manufacture of:
2.1. toys,
2. 2. materials or products intended for application by spraying,
2. 3. finished products sold to the public by retail in powder form,
2. 4. smoking supplies such as smoking pipes, cigarettes and cigar and cigarette tips,
2.5. Catalytic filters and isolations intended to be incorporated into gas-heated catalytic heaters;
2.6. paints and varnishes,
2. 7. Filters for liquids,
2. 8. Road covering materials with a fibre content exceeding 2% by weight,
2. 9. mortar, protective coatings, fillers, gaskets, gaskets, putty, adhesives, decorative powders and preparations for surface treatment;
2. 10. Heat or sound insulation materials with low density (having a specific weight of less than 1 g.cm-3);
2.11. air filters and filters used in the transport, distribution and use of natural gas and gas;
2. 12th base layers for plastic floor and wall coverings,
(2) 13. finished textiles in the form intended to be delivered to the end user, unless they are so modified as to prevent the release of fibres,
2. 14. Roof cardboard.
3. Products containing fibrous asbestos may only be placed on the market if they are labelled with a label indicating "Caution contains asbestos," "Inhaling asbestos is dangerous health," "Follow safety instructions." The labelling in this way does not alter the other labelling and packaging obligations laid down for hazardous chemicals and chemicals by law.
7. Unfilled
8. Tris-aziridinyl phosphine oxide, Cas No 5455-55-1
Shall not be used for the treatment of textile products intended to come into contact with the skin, such as clothing, lingerie, bed linen, etc.
9. Polybrominated biphenyls (PBB), Cas No 59536-65-1
Shall not be used for the treatment of textile products intended to come into contact with the skin, such as clothing, lingerie, bed linen, etc.
10. Soap powder from the bark of the tuopolistic mydlovirus (Quillaia saponaria) and its derivatives containing saponins
Powder of the roots of Helleborus viridis and Helleborus niger
Powder of the roots of the white sneeze (Veratrum album) and black sneeze (Veratrum nigrum)
Benzidine and / or its derivatives o-nitrobenzaldehyde, Cas No 522-89-6
Wood powder
1. It shall not be used in jokingly and funny articles to be used as such, for example as an ingredient in sneezing powder and smelly bombs.
2. The restriction referred to in point 1 shall not apply to smelly gun balls containing less than 1,5 ml.
11. Sulphides and polysulphides
11.1. Ammonium sulphide, Cas No 12135- 76-1
11.2. Ammonium hydrogen sulfide, Cas No 12124-99-1
11.3. Ammonium polysulphide, Cas No 12259-92-6
1. It shall not be used in jokingly and funny articles to be used as such, for example as an ingredient in sneezing powder and smelly bombs.

12. Volatile esters of bromoacetic acid
12.1. Methylbromoacetate, Cas No 96-32-2
12.2. Ethylbromoacetate, Cas No 105- 36-2

13.2-naphthylamine, Cas No 91-59-8 and its salts
1. It shall not be included in substances and preparations placed on the market in quantities exceeding 0,1% w / w.
2. Point 1 shall not apply to the industrial production and use of these substances as intermediate products in closed systems where these substances are produced by chemical reactions and are further processed in such a way that, after the completion of the entire production process, these substances can be found at concentrations below 0,1% m / m.
14. Benzidine, Cas No 92-87-5 and its salts
1. It shall not be included in substances and preparations placed on the market in quantities exceeding 0,1% w / w.
2. Point 1 shall not apply to the industrial production and use of these substances as intermediate products in closed systems where these substances are produced by chemical reactions and are further processed in such a way that, after the completion of the entire production process, these substances can be found at concentrations below 0,1% m / m.
15.4-nitrobiphenyl, Cas No 92-93-3
1. It must not be contained in substances and preparations placed on the market in quantities exceeding 0,1% w / w.
2. Point 1 shall not apply to the industrial production and use of this substance as an intermediate product in closed systems, where this substance is produced by chemical reactions and is further processed in such a way that, after the completion of the entire production process, it can be found at concentrations of 0,1% m / m and less.
16.4-aminobiphenyl, Cas No 92-67-1 and its salts
1. It shall not be included in substances and preparations placed on the market for sale to the public.
2. When placing those substances and preparations containing those substances on the market, they shall be clearly and permanently marked "For professional use only 'without prejudice to other labelling obligations.
17. Lead carbonates
17. 1. Lead carbonate anhydrous, PbCO3, Cas No 598- 63-0
17.2. Carbon trilead dihydroxide, basic lead carbonate,
2 PbCO3.Pb (OH) 2, Cas No 1319-46-6
1. They shall not be used as constituents of coatings.
2. Point 1 shall not apply to coatings used for the restoration and maintenance of works of art, historical buildings and their interiors.
18. Lead sulphates
18.1. Lead sulphate, PbSO4 (1: 1), Cas No 7446-14-2
18.2. Lead sulphates, PbxSO4, Cas No 15739-80-7
1. They shall not be used as constituents of coatings.
2. Point 1 shall not apply to coatings used for the restoration and maintenance of works of art, historical buildings and their interiors.
19. Mercury, Cas No 7439-97-6 and its compounds
1. Mercury compounds shall not be used as such or as part of preparations intended for:
1. 1. to protect wood,
1. 2. the impregnation of industrial textiles, geotextiles and yarns intended for their manufacture;
1. 3. to prevent the establishment of micro-organisms, plants and animals on installations completely or partially immersed in water;
1.4. For water treatment.
2. Mercury may be included in alkaline manganese batteries placed on the market:
2. 1. in quantities not exceeding 0,05%, in batteries intended for long-term use under extreme conditions,
2.2. In quantities not exceeding 0,025%, in other alkaline manganese batteries.
3. Point 2 shall not apply to alkaline manganese button cells and batteries consisting of button cells.
20. Arsen, Cas No 7440-38-2 and its compounds
1. It shall not be included in substances and preparations used:
1. to prevent the establishment of micro-organisms, plants or animals on installations completely or partially immersed in water;
1.2. For the protection of wood,
1. 3. For industrial water treatment.
2. Point 1.2 shall not apply to inorganic salts of the type Cu- Cr- As (CCA, copper-chromium-arsenic) used for industrial vacuum or pressure impregnation of wood intended for outdoor use.
3. DFA-type preparations (dinitrophenol-fluoride-arsenic) may be used for in situ repair of already built masts carrying cables. Only experts may handle these products using vacuum or pressure.
21. Organo-tin compounds
1. They shall not be placed on the market for use as substances or constituents of products acting as biocides in coatings with anti-fouling effect.
2. Shall not be used as substances or constituents of products which act as biocides to prevent the rotting and damage of micro-organisms, plants and animals for:
(a) hulls of ships with a total length according to ISO 8666 of less than 25 m, and hulls of ships intended primarily for use on inland waterways and areas, with no length limit;
(b) cages, floats, nets and other equipment used for fish and molluscs farming;
(c) other equipment or equipment completely or partially immersed in water.
3. For uses other than those referred to in points (a) and (b), those substances may only be placed on the market in packages of at least 20 litres, excluding retail sales.
4. Where such substances or preparations containing those substances are placed on the market for authorised uses, the packaging of the following substances or preparations shall be marked legibly and permanently with the following inscription:
"Not to be used for ships of a total length of less than 25 m or for ships of any length used mainly on inland waterways and areas or for any other facilities or equipment for fish or molluscs farming. '
5. They shall not be used as such or as constituents of preparations intended for the treatment of industrial waters.
22. Di-µ-oxodi-n-butyltin hydroxyborane (DBB), Cas No 75113-37-0
1. It shall not be contained in substances or preparations placed on the market in quantities exceeding 0,1% w / w.
2. Point 1 shall not apply to substances and preparations intended solely for processing into finished products in which the substance is not present at a concentration exceeding 0,1% w / w.
23. Pentachlorophenol, Cas No 87-86-5 and its salts and esters
1. It shall not be contained in substances or preparations placed on the market in quantities exceeding 0,1% w / w.
2. Point 1 shall not apply to substances and preparations intended for use in industrial plants with controlled effluent and gaseous waste complying with the requirements of legislation3), 4)
2. 1. for the treatment of wood which will not be used inside buildings for decorative or other purposes, nor will it be used for the manufacture of packaging intended for cultivation or for the treatment and manufacture of packaging which may come into contact with foodstuffs or other materials intended for human or animal nutrition;
2. 2. for impregnation of fibres and industrial textiles not intended for the manufacture of clothing and upholstery of furniture;
2. 3. As a raw material or an auxiliary substance in industrial production.
3. Point 1 shall not apply to exceptional cases of placing on the market and use of devices containing pentachlorophenol for the treatment in situ of buildings of cultural, historical or artistic importance or of buildings affected by domestic and rotting timber.
4. In all cases where the use of pentachlorophenol as such or as constituents of the preparation is authorised, the total content of hexachlorodibenzo- p-dioxin in it must be less than 2 mg.kg-1
5. Substances and preparations containing pentachlorophenol or its derivatives placed on the market on the basis of exceptions:
(a) they must be packed in packs of at least 20 litres,
(b) may not be sold in retail;
(c) they must be legibly and permanently marked on the packaging: "For industrial and professional use only."
The labelling does not in this way alter the other labelling obligations for dangerous substances and preparations.
24. cadmium, Cas No 7440-43-9 and its compounds *)
1. These substances shall not be used to dye products and parts thereof made from:
1. 1. polyvinylchloridu (PVC) [3904 10]

The cadmium content of the plastic products shall not be more than 0,01% w / w.
2. These substances may be used in coatings [3208], [3209] at a concentration not exceeding 0,01% w / w, except for high zinc coatings where the cadmium content and its compounds, calculated as cadmium content, may not exceed 0,1% w / w.
3. The restrictions referred to in points 1 and 2 shall not apply to products dyed for safety purposes.
4. The following substances shall not be used to stabilise the following finished products made from polymers and vinyl chloride copolymers:

In all cases, irrespective of end-use, the above end products or parts thereof may be placed on the market, manufactured from polymers or vinyl chloride copolymers, stabilised with cadmium content, provided that the cadmium content (expressed as Cd) does not exceed 0,01% of the weight of the polymer.
5. The restriction referred to in point 4 shall not apply to finished products in which cadmium-based stabilisers are used for safety reasons.
6. These substances shall not be used for any surface treatment of metallic parts of machinery and equipment when such parts of machinery or equipment are used in the following sectors or applications or are manufactured by the following sectors or applications:

The restriction also applies to spare parts of machinery and equipment.
7. The restriction in paragraph 6 shall not apply to:
7. 1. Products and components thereof used in aviation, space research, mining and the nuclear industry, where their use requires high safety requirements;
7. 2. components of safety systems for road, agricultural, railway and vessel vehicles;
7. 3. Electrical contacts in all areas of use, if required by the safety requirements of the equipment where they are used.
25. Monomethyl tetrachlorodiphenylmethane
Trade name e.g. Ugilec 141, Cas No 76 253-60-6
1. Shall not be used for any purpose.
2. Machinery and equipment may be placed on the market only if they do not contain the substance; the restriction also applies to the marketing of machinery and equipment already used (second hand sale).
26. Monomethyl dichlorodiphenylmethane
Business name e.g. Ugilec 121, Ugilec 21
1. Shall not be used for any purpose.
2. Machinery and equipment may be placed on the market only if they do not contain the substance; the restriction also applies to the marketing of machinery and equipment already used (second hand sale).
27. Monomethyl dibromodiphenylmethane
Trade name e.g. DBBT, Cas No 99 688- 47-8
1. Shall not be used for any purpose.
2. Machinery and equipment may be placed on the market only if they do not contain the substance; the restriction also applies to the marketing of machinery and equipment already used (second hand sale).
28. Nickel, Cas No 7440-0-20 and its compounds
1. These substances may be used in parts of products which are inserted into pierced ears or other pierced parts of the human body, in the epitheliation of wounds caused by piercing, subsequently removed or not removed, provided that those parts of the products are homogeneous and the nickel concentration, expressed as nickel mass ratio to the total weight of the product, is less than 0,05% w / w.
2. These substances may be used for products intended for direct and long-term contact with the skin, such as:
- earrings,
- necklaces, bracelets and chains, ankle ornaments, rings,
- wristwatch cases, belts and clamps,
