THE LAW
of 16 January 2008
amending Act No 139 / 2006 Coll., on concession contracts and concession procedures (concession law)
Parliament has decided on this law of the Czech Republic:
Act No 139 / 2006 Coll., on concession contracts and concession procedures (concession law) is amended as follows:
1. In Article 6 (3), the words "and electronic instruments' shall be inserted after the words" devices'.
2. In Paragraph 7 (4), the words "qualified suppliers' are replaced by the words" suppliers who have demonstrated that the qualification has been fulfilled '.
3. in Article 7 (5) (a) and (b), the words "qualified suppliers" shall be replaced by the words "suppliers who have demonstrated that the qualification has been fulfilled."
4. In Paragraph 12 (4), "Against 'is replaced by" Pro'.
5. In Paragraph 14 (1), the words "CZK 165 288 000, the main object of which is the construction of a building (hereinafter referred to as the" above-limit concession contract for construction ") 'are replaced by the words" the financial limit laid down in the implementing legislation, the main purpose of which is construction works (hereinafter referred to as the "above-limit concession contract for works")'.
6. In Paragraph 14 (1) (b), the word "potential 'is deleted.
7. in Article 15 (1) (a), the word "construction" shall be replaced by the words "works."
8. In Paragraph 15 (1) (b), the words "CZK 165 288 000 'are replaced by the words" the financial limit laid down in the implementing act'.
9. Paragraph 23 (2) reads as follows:
"(2) The legal effects of the concession contract shall be subject to its approval under paragraph 1."
10. In Paragraph 25 (1), the word "concession 'shall be inserted after the word" closure'.
11. in the first sentence of Paragraph 31 (1), the word "construction" shall be replaced by the words "works."
12. in Paragraph 32 (2) (e), the words "forecast income value" are replaced by the words "forecast income."
13. In Paragraph 34, the following paragraph 3 is added:
"(3) The Government shall issue regulations implementing Articles 14 (1) and 15 (1) (b)."
Transitional provision
Concessions initiated before the date of entry into force of this Act shall be completed in accordance with Act No. 139 / 2006 Coll., on Concession Contracts and Concession Procedure (Concession Act), as effective until the date of entry into force of this Act.
Efficacy
This Act shall take effect on the 15th day following its publication.
