amending and supplementing the State Service Order for Measures and Weights
In an agreement with the relevant ministries pursuant to § 13 (1) (a) and (b) of the Legal Action No. 2 / 1955 Coll., on the State Service for Measures and Weights, on the State Service for Precious metals and on the testing of weapons and ammunition for civil use, as amended by Government Decree No. 3 / 1959 Coll., on the establishment of the State Committee for the Development of Technology:
Decree No 122 / 1955 of the Minister of Finance of the Ú. l, on the State Service for Measures and Weights, is amended as follows:
1. Paragraph 3 reads as follows:
Uniformity of measures and scales
(1) Only measures, weights, scales, measuring instruments and machines (hereinafter referred to as "gauges') based on legal measures may be used in the national economy.
(2) The Standardisation Authority may, for serious reasons, in particular for the purpose of contact with a foreign country, authorise the use of measuring instruments based on non-legal measures for certain types of plants and certain types of goods. "
2. The following Sections 3a and 3b are inserted after Section 3:
Official tests
(1) Meters manufactured, exported, repaired or used by economic, budgetary or other organisations (hereinafter referred to as "organisations") or individuals, as well as the standards of such meters (basic measuring instruments), shall be subject to mandatory checking and verification (hereinafter referred to as "official testing").
(2) Manufacturers, import customers and repairers of measuring instruments are required to submit measuring instruments subject to an official test which they have produced, imported or repaired, where appropriate, to the relevant district service, the measuring instruments and scales for official testing before they are passed on to the customer and if they are measured for their own use before they are put into use.
(3) If the measuring instrument has been found to be correct in the official examination, it shall verify with the national marks declared by the President of the Standardisation Office; otherwise they must be taken out of service.
(4) For a new official test, the gauges shall be submitted to the user before the expiry of the verification period.
(5) The list of measuring instruments subject to official examination and the validity of their verification are set out in the Annex to this Decree. In the absence of a verification period in the list of measuring instruments, the measuring instrument shall be subject to a new official test only under the conditions laid down in § 5 (2) (b) to (f).
(6) If, since the first official examination, the characteristics of the measuring instruments kept for sale have not changed and during the year in which they were officially verified, they have not been proven to have been used, they may, at the request of the holder, be affixed by the competent district service before the end of that year by State marks for a further period without examination.
(7) Specific rules shall apply to the official test of basic measuring instruments and the period of validity of such measuring instruments.
Business tests and verifications
(1) The Standardisation Authority may, in agreement with the relevant ministries, entrust the organisation with carrying out business tests and verification of specified types of measuring instruments which produce, repair or use; This business test and verification shall replace the official test.
(2) The measuring instrument which has been found to be correct in this test will be marked by the designated organisation, declared for this purpose by the President of the Standardisation Office. Otherwise, these gauges shall be subject to official testing without modification. '
3. Paragraph 5 reads as follows:
Validity of verification
(1) The period of validity of the verifications shall start from the beginning of the calendar year following the year in which the official test of the measuring instrument was carried out.
(2) Validity of the verification of the gauge shall cease if:
(a) its period of validity has expired;
(b) amendments, modifications or repairs to the measuring instrument are made which may affect the characteristics relevant for its verification or the extent of its use;
(c) one of the national brands has been infringed, removed, degraded or has become illegible;
(d) the prescribed markings have been arbitrarily modified or the illicit marking, division, etc., has been subsequently affixed;
(e) the gauge has been so damaged that it may have lost some property determined for its verification;
(f) it is also evident in the case of an intact verification that the gauge has become incorrect or that it no longer has the prescribed requirements.
(3) If the verification has expired, the gauge shall be paid for unverified and shall not be used unless it is re-tested and verified. ';
4. Paragraph 6 (g) reads as follows:
"(g) exceptionally permit the verification of a measuring instrument based on non-legal measures where the use of such a measuring instrument has been authorised by the Standardisation Authority (§ 3 (2))."
5. Paragraph 17 (3) reads as follows:
"(3) No finding (certificate, certificate, certificate, certificate, etc.) shall be issued for the examination and verification of the measuring instrument or its refusal, unless otherwise specified in the measurement regulations. ';
This decree shall take effect from the date of its publication.
