Government Regulation
of 6 April 1954
on donations to the State and on the organisation of collections by national committees.
The Government of the Czechoslovak Republic orders pursuant to § 1 (a) of Act No. 143 / 1949 Coll., on Changes in the Organisation of Public Administration and in the jurisdiction of its bodies, and under § 4 (2) of Act No. 83 / 1952 Coll., on the budgets of national committees:

Oddíl 1.

Deciding on the offer and treatment of donations to the State.
§ 1.
(1) With the exception of the cases referred to in paragraphs 2 to 4, the Executive Authorities of the District National Committees shall decide on the acceptance of donations and other contributions to the State (hereinafter referred to as "donations"), the national committees of which have been offered to the national committees, central offices and other budgetary organisations, or on the promise of such gifts. The management authority of the district national committee in whose district the gift is offered shall be responsible for this decision and for dealing with the gift received.
(2) The executive bodies of the local national committees may accept and take over, in the administration of the local national committees, the gifts offered to them by small-scale movable items which they have appointed as donors to serve the needs of the local population.
(3) A gift of scientific, artistic or collectors' value offered to a scientific or other institution which is responsible for the management of such property may be accepted by that institution. By accepting it, the gift will pass into her administration.
(4) The acceptance of a foreign gift shall be decided by the Ministry of Foreign Affairs, which shall proceed in agreement with the Ministry of Finance, and shall be treated with the gift received.
§ 2.
If defects or obligations are associated with the gift in a disproportionate way to the value or importance of the gift, or if the donor weighs his offer by difficult or inappropriate conditions, or if the acceptance of the gift is prevented by other serious reasons, the gift may be accepted only if there is a particular interest in its acceptance. In such cases, the approval of the Executive Authority of the Regional National Committee should be required if the gift is accepted by the Executive Authority of the District National Committee and the agreement of the Central Office in the case of the receipt of the gift by a scientific or other institution (§ 1 (3)). In doubt, the Executive Authority of the Regional National Committee or the Central Office shall seek the approval of the Ministry of Finance.
§ 3.
The gift received goes to state socialist property.
§ 4.
This Regulation shall not apply to gifts which have been offered and which, in their capacity, are accepted by the National Assembly, the President of the Republic, the Government, the members of the Government, the Slovak National Council, the Board of Authors, the members of the Board of Authors and the heads of the Czechoslovak representative offices abroad.

Oddíl 2.

Collections organised by national committees.
§ 5.
(1) The National Committee may provide the means necessary to carry out certain of its cultural or social tasks through a collection between the population of its district. Such a collection may be organised by a national committee only with the approval of the national higher-level committee. In order to organise the collection by the Regional National Committee, the approval of the central authority responsible shall be required, which shall proceed in agreement with the Ministry of Finance.
(2) The cash yield of the collection is the income of the national committee, which accounts it for the benefit of its budget. The funds provided by the collection yield can only be used for the purpose of the collection. The national higher-level committee (competent central office) may exceptionally authorise the use of the collection yield to fulfil another cultural or social task.

Oddíl 3.

Common provisions.
§ 6.
The Ministry of Finance may lay down details for the implementation of this Regulation, in particular on the acceptance and treatment of donations or the proceeds for them.
§ 7.
This Regulation shall enter into force on the day of its publication; they shall be implemented by the Finance Minister in agreement with the participating members of the Government.
