DECLARATION
of 20 December 2022
amending Decree No. 420 / 2008 Coll., laying down the formalities and content of the plan for the protection of conservation of conservation and conservation zones
The Ministry of Culture provides pursuant to Article 45 of Act No. 20 / 1987 Coll., on State Heritage Care, as amended by Act No. 320 / 2002 Coll., Act No. 186 / 2006 Coll., Act No. 307 / 2008 Coll., Act No. 124 / 2011 Coll. and Act No. 284 / 2021 Coll., ("the Act '):
Decree No. 420 / 2008 Coll., laying down the terms and content of the conservation plan for conservation of conservation and conservation zones, is amended as follows:
1. in Article 1 (2) (a):
"(a) a list of real estate which is a cultural monument or a national cultural monument, an identification of urban and landscape values and real estate which are architecturally or urbanistically valuable construction or a set of buildings, a historically important construction, a site or a set of buildings, a significant dominance, a symbol of historical cultural landscape and are located in a conservation or conservation zone,"
2. in Paragraph 1 (2) (b), the word "listing" shall be replaced by the word "destination" and the words "requesting a binding opinion in advance" and the words "described by the cadastral identification data" shall be deleted;
3. in Article 1 (2), point (d) is deleted;
Point (e) shall be renumbered as point (d).
4. in Article 1 (3) (a):
"(a) Drawing No 1, in which the real cultural monuments, real national cultural monuments, urban and landscape values, architecturally or urbanistically valuable buildings or sets of buildings, historically significant buildings, places or sets of buildings, significant dominance and features of the historical cultural landscape located in a conservation or conservation zone,"
5. in Article 1 (3) (b), the words "No 2" shall be inserted after the words "drawing" and the words "seeking a binding opinion in advance" shall be deleted;
6. In Paragraph 1 (3) (c), the text "No 3 'is inserted after the word" drawing'.
7. In Paragraph 1 (4), the word "or 'is replaced by a comma and the words" or 1: 5 000' are added at the end of the text of the paragraph.
8. In Article 1 (5), at the end of the first sentence, the words "in exceptional cases it is formed by a link between the quarry points of the existing borders or points at those borders' shall be added.
9. In Article 1, the following paragraph 8 is added:
"(8) The protection plan shall be drawn up in an electronic version in a machine-readable format that allows display in geographical information systems. ';
Transitional provision
Protection plans issued prior to the date of entry into force of this Order shall not be affected.
Efficacy
This Decree shall take effect on 1 July 2023.
