Budget Act 1952
of 28 March 1952
The National Assembly of the Czechoslovak Republic decided on the following Act:
State budget objectives.
All the funds paid by the State stem from the hard work of the working people. Therefore, they should be managed in such a way that all planned construction tasks are met, with the minimum cost necessary to ensure that funds are used to support efforts to maintain peace and security and to continuously increase the material and cultural level of the working people.
Determination of the amount of the State budget.
The total expenditure of the state budget is determined by the amount of CZK 323.528,941.000, the revenue is budgeted by the amount of CZK 324.282,296.000, resulting in a surplus of CZK 753,355.000.
Expenses in government management.
(1) Expenditure in the field of national business and public administration, whether investment or non-investment, may be effected only if the reimbursement of their costs is ensured; the reimbursement of public expenditure must be secured in the State budget.
(2) The Government may authorise the execution of the necessary expenditure, not covered by the State budget, if it provides for its reimbursement by means of higher revenue or by way of the removal of other less urgent expenditure. However, funds intended for investment and personal expenditure may not be used to cover other expenditure.
(3) If expenditure cannot be paid in the State budget in accordance with the procedures referred to in the preceding paragraphs, the prior approval of the National Assembly must be effected. The Government shall provide for a regulation in which such expenditure is sufficient for the authorisation of the Government and the additional approval of the National Assembly to take place.
Responsibility of the government and its members.
The government and each member of the government shall be responsible for the economic performance of all the planned tasks and that the spending amounts of the state budget will not be exceeded, except in the case of the provisions of this law, and revenue amounts will at least be achieved.
Government budget management.
The government will adjust the management regulation according to the state budget, including cases of burdensome budgets for the coming years.
Collection of surrogates for direct taxes and collection of levies and charges by local national committees.
(1) The provisions of Act No. 274 / 1949 Coll., on the collection of surpluses for direct taxes on the financial year 1950 apply mutatis mutandis to the financial year 1952.
(2) The Government will make provision for the collection of levies and charges by the local national committees.
Credit measures.
The Minister for Finance is hereby authorised to:
(a) to carry out the credit operations necessary for conversion or payment of State debts;
(b) in order to settle domestic non-issue loans directly or indirectly burden the government or public administration facilities, set the conditions for such settlement and provide the necessary remuneration after the issue of government bonds.
Inadmissibility to set off claims against the State.
The debtor may not pay his obligation to the State by offsetting his claim on the State.
Organisation of funds, special-purpose assets and foundations.
The Government shall take measures to abolish, liquidate or otherwise modify all remaining funds, special-purpose assets and foundations as necessary and effectiveness.
Interim management of state management in 1953.
(1) The Government will take appropriate measures for the State's management between 1 January 1953 and the publication of the budget act for 1953, but not later than 30 April 1953, in proportion to the principles of the State's budget rules for 1952.
(2) Expenditure and revenue for the duration of the interim management of the State's management is to be definitively cleared into the State budget for 1953 following the publication of the budget act for 1953.
The budgets of the single national committees.
Paragraph 4 (3) of Act No. 279 / 1949 Coll., on the Financial Management of National Committees, is hereby repealed.
The effectiveness of the law.
This Law shall take effect on 1 January 1952; by the Minister for Finance and other members of the Government.
