GOVERNMENT REGULATION
of 4 November 2019
amending Government Regulation No 515 / 2004 Coll., on material support for the creation of new jobs and material support for retraining or training of employees in the context of investment incentives, as amended
The Government orders pursuant to § 111 paragraph 12 of Act No. 435 / 2004 Coll., on Employment, as amended by Act No. 367 / 2011 Coll., Act No. 136 / 2014 Coll., Act No. 84 / 2015 Coll., Act No. 327 / 2017 Coll. and Act No. 210 / 2019 Coll.:
Government Regulation No. 515 / 2004 Coll., on material aid for the creation of new jobs and material support for retraining or training of employees in the context of investment incentives, as amended by Government Regulation No. 578 / 2004 Coll., Government Regulation No. 338 / 2006 Coll., Government Decree No. 68 / 2008 Coll., Government Decree No. 97 / 2010 Coll., Government Decree No. 10 / 2014 Coll. and Government Decree No. 173 / 2015 Coll., is amended as follows:
1. In Article 1, the following paragraph 1 is added:
"(1) The amount of the employer's material support for the creation of new jobs under investment incentives in the case of an investment event in a technology centre is CZK 200 000 per new job set up in the territorial area (1); no support is provided for creating new jobs in the capital of Prague. '
Paragraphs 1 and 2 shall become paragraphs 2 and 3.
2. In Section 1 (2) of the Introductory Part of the provision, the words "Amount of material aid 'are replaced by the words" Material aid' and the words "in the case of an investment in production 'are inserted after the words" in the case of an investment in production if the average proportion of unemployed persons in the territorial area (1) reaches at least 7,5% and its amount'.
3. In Paragraph 1 (2), at the end of point (b), the comma is replaced by a dot and point (c) is deleted.
4. in Sections 1 (2) (b) and 2 (1) (a) and (b) and 4, the word 'unemployment' shall be replaced by 'unemployed persons';
5. In Article 2, the following paragraph 1 is added:
"(1) The amount of material support for retraining or training of employees under investment incentives in the case of an investment event in a technology centre shall be 50% of the costs of retraining or training employees (2) in the territorial area; no aid shall be granted in the capital city of Prague for retraining or training of employees. '
Paragraphs 1 to 4 shall be renumbered paragraphs 2 to 5.
6. In Section 2 (2) of the Introductory Part of the provision, the words "Amount of material aid 'are replaced by the words" Material aid' and the words "in the case of an investment in production 'are inserted after the words" in the case of an investment in production if the average proportion of unemployed persons in the territorial area is at least 7,5%'.
7. In Article 2 (3) and (4), "paragraph 1 'is replaced by" paragraphs 1 and 2';
8. Paragraph 3, including footnote 4, reads as follows:
(1) New jobs means jobs created by an employer under an agreement negotiated under Paragraph 111 (6) of the Act (hereinafter referred to as "the Agreement '), where nationals of the Czech Republic, nationals of another Member State of the European Union or their family members or long-term residents in the European Union are located within the territory of the Czech Republic, and those persons have an indefinite employment relationship with the employer.
(2) The number of new jobs in the case of the introduction of production or the construction of a technology centre shall be determined by the number of employees at the place of implementation of the investment action4) at the date specified under the Agreement for the creation of new jobs.
(3) The number of new jobs in case of extension of the production or expansion of the technology centre shall be determined as the difference between the number of employees at the place of implementation of the investment action4) at the date fixed under the agreement for the creation of jobs and the average number of employees at the place of implementation of the investment action4) over a period of 12 calendar months preceding the submission of the intention to obtain an investment incentive by the employer.
(4) The number of new posts determined in accordance with paragraphs 2 and 3 shall be rounded down to the whole unit.
4) Paragraph 1a (1) (h) of Act No. 72 / 2000 Coll., on investment incentives and amending certain laws, as amended. '
9. In Section 4, the words "two half-years' are replaced by the words" the completed calendar half-year immediately '.
Transitional provision
For the promise of investment incentives provided in the procedure under Act No. 72 / 2000 Coll., on investment incentives and amending certain laws (the Investment Incentives Act), as amended, initiated before the date of entry into force of this Regulation, Government Regulation No. 515 / 2004 Coll., as effective before the date of entry into force of this Regulation, shall apply.
Efficacy
This Regulation shall enter into force on the first day of the calendar month following its publication.
