DECLARATION
of 11 December 2018
amending Decree No. 129 / 2012 Coll., on details of the marketing of seed and planting plants, as amended
The Ministry of Agriculture provides, pursuant to § 7 (6) (a) of Act No. 219 / 2003 Coll., on the putting into circulation of seeds and propagating plants and amending certain laws (Law on the circulation of seeds and seed):
Decree No. 129 / 2012 Coll., on details of the marketing of seeds and propagating plants, as amended by Decree No. 409 / 2013 Coll., Decree No. 368 / 2015 Coll. and Decree No. 334 / 2017 Coll., is amended as follows:
1. At the end of footnote 1, the sentence "Commission Implementing Directive (EU) 2018 / 1027 of 19 July 2018 amending Council Directive 66 / 402 / EEC as regards isolation distances for Sorphum shall be added to the separate line. '
2. In Annex No 1, Part III, Section 2, Subsection 3:

The minimum distances given in Table 3.2b need not be respected if there is sufficient protection against unwanted foreign dusting.
In areas where the occurrence of halepian sorghum (Sorphum halepse (L.)) or Sudanese sorghum grass (Sorphum sudanense (Piper) Stapf) constitutes a specific problem due to foreign dusting, the following provisions shall apply:
(a) the seed crops intended for the production of basic seed of sorghum (Sorghum bicolor) or its hybrids must be at least 800 m from any source of such contaminating pollen (halepian or Sudanese grass sorghum or sorghum);
(b) the propagation crops intended for the production of certified seed of sorghum (Sorghum bicolor) or its hybrids shall be at a distance of at least 400 m from any source of such contaminating pollen (halepian or Sudanese grass sorghum). "
Explanatory notes 14 and 15 are deleted.
Efficacy
This Decision shall enter into force on 1 January 2019.
