laying down the details of the indication on the packaging of wine or wine grape products and other details of the labelling of wine and wine grape products
The Ministry of Agriculture provides, pursuant to Sections 13 (9) and 13a (2) of Act No. 115 / 1995 Coll., on Vinohradship and Wine and amending certain related legislation, as amended by Act No. 216 / 2000 Coll., hereinafter referred to as "the Act":
Derogations from the information on the packaging intended for consumers
(Paragraph 13 (9) of the Law)
(1) The content of wine or other wine grape products in the packaging intended for consumers may be lower than the nominal content indicated on the packaging not more than:
(a) 10 ml at a content not exceeding 0,4 l,
(b) 20 ml at a content between 0,4 and 0,7 l,
(c) 25 ml at a content between 0,7 and 1,0 l,
(d) 2,5% of the nominal content at content of 1 l or more.
(2) The average content in the 10 consumer-controlled packages taken for inspection in accordance with paragraph 1 (a), (b), (c) or (d) must not be less than the nominal content of the package indicated on the label.
(3) The negatives referred to in paragraph 1 shall not apply to an indication of the content for which the international symbol "e '1 is indicated)
Details of the labelling of wine and grape products
(Paragraph 13a (2) of the Act)
Details of the labelling of all wine and wine products
(1) The particulars in the labelling of the packages of wines classified in accordance with Article 6 of the Act shall be indicated in easily legible and indelible characters in such a way as to distinguish them significantly from the material on which they are printed, as well as from all other written data and pictures,
(a) together in a visible place on one or more labels, easily separable and placed on the same packaging; or
(b) directly on the packaging.
(2) The commercial name or registered office of the wine-producer classified in accordance with Article 6 of the Act may be supplemented by the words "wine-holder '," owner of the vineyard', "winemaker '," wine-holding' or any other similar term only if the wine was obtained exclusively from grapes originating from vineyards owned by the producer indicated on the packaging and the processing of the grapes took place with that producer.
(3) Indication of the wine content in the package
(a) in hectolitres, litres, centilitres or millilitres at the same time as the name of the unit of volume used, or by abbreviation thereof;
(b) numerals which, for a content of more than 100 cl, are at least 6 mm high, for a content of more than 20 cl up to 100 cl at least 4 mm high, for a content of more than 5 cl up to 20 cl at least 3 mm high and for a content of 5 cl less than 2 mm high.
(4) The lot shall be marked by the words "lot number 'or" lot No'.
(5) The actual alcoholic strength by volume or tenths. They shall not be higher than or less than 0,5% vol. compared to the alcohol content determined by analysis, tolerating the tolerance set for the test method used. The figure for the actual alcoholic strength by volume shall be "% vol '. The figure may be given by the words" actual alcoholic strength' or "actual alcohol 'or by the abbreviation" alc.'. The alcohol content shall be indicated on the label by numerals which, if they are more than 100 cl high or more than 5 mm high, if they are more than 20 cl high or up to 100 cl high, at least 3 mm high and 20 cl lower than 2 mm high.
(6) Other wine grape products, in particular wine-based drinks, musts, concentrated musts and grape juices, are to be labelled in accordance with specific legislation.2)
(7) The provisions of specific legislation remain untained.3)
Details of the labelling of quality wine and wine with the addition
(1) The designation of a quality wine or wine with added added value in conjunction with the designation of the type of cabinet, late collection, selection of grapes, selection of berries, iced wine and straw wine shall be given in the letters of the same type and size as the name of the wine-growing region or the name of the wine-growing community.
(2) The name of the vine variety shall be given in accordance with the name of the vine variety specified in the specific legislation.4) It shall also be authorised, in addition to the name of the vine variety, to indicate the synonym of the name of that variety in the Annex hereto.
(3) The indication of the quality registration number, which means the reference number and the wine sample in the decision of the Ministry of Agriculture to be classified in accordance with Article 14 of the Act, shall be indicated on the label of the wine with the addition so as to avoid confusion with other numbers.
Details of the labelling of sparkling wine
(1) The name of the vine variety may be indicated in the case of sparkling wine if it has been obtained entirely from the declared variety, with the exception of products from another variety, contained in a threading or dispatch liqueur. It shall also be authorised, in addition to the name of the vine variety, to indicate the synonym of the name of that variety in the Annex hereto.
(2) The terms "fermented in bottles," "fermented in bottles by a traditional method," "traditional method" or "classical fermentation in bottles," whereby the bottle means packaging intended for consumers, may be used only if:
(a) the indication of quality sparkling wine, quality sparkling wine in the wine-growing region or in the production sector, if so produced; or
(b) the designation of sparkling wine originating in another country for which the conditions for its manufacture have been recognised as equivalent to those laid down by law.
Details of labelling of wine with other particulars
(1) The packaging of wine may include recommendations on the use of wine aimed at consumers, which may cover:
(a) the food to which wine may be recommended;
(c) the type and manner in which the wine is to be presented for consumption;
(c) the procedure for pouring wine with sediment (wine stone);
(d) the use of the wine in question for religious purposes;
(e) the storage of wine.
(2) Recommendations for the use of wine for religious purposes may be indicated on the packaging if:
(a) written consent by the competent church to the declared use of wine has been given,
(b) it has been produced in accordance with the specific requirements laid down by the regulations of the church concerned,
(c) is offered for sale or sold exclusively for use declared on the packaging.
(3) Offers for the sale or sale of wine referred to in paragraph 2 (b) (c) shall not apply to wines classified as "kosher wine," where appropriate marked by other names established by churches not falling within the Roman Catholic religion. These wines may be put into circulation without restriction.
(4) In addition to the information provided for in Section 13a of the Act, wine with added value may be indicated
(a) an indication that the wine was filled with the same producer on whose vineyards the grapes were harvested and which produced the wine,
(b) the method of manufacture;
(c) organoleptic characteristics which are characteristic of the product;
(d) an indication of the award of the valuation;
(e) information on:
1. the history of the wine in question, of the manufacturer or persons involved in the marketing of the wine;
2. natural or technical wine-growing conditions giving the essential characteristics of the wine;
3. maturity achieved by the storage of the wine concerned.
(5) The data referred to in paragraph 4 and in Article 13a of the Act are set out
(a) on the same label as those provided for in Article 13 of the Act or on another label; or
(b) directly on the packaging.
(6) The indication referred to in paragraph 4 (a) shall be given by the words "completed by the manufacturer." The term "bottled by the manufacturer 'may be replaced by" filled with a vineyard' if the vineyards from which grapes have been harvested for the preparation of the wine concerned are managed for at least three years by that producer.
(7) The words
(a) white (made from white, pink or red grapes),
(b) pink (made from red or blue grapes without fermentation, in the case of table wines and sparkling and semi-sparkling wines and quality stamps and blends of white and red wine),
(c) red (made of or heat-treated from blue grapes).
(8) Expressions can be used to express sugar content in wine
(a) "dry" only if the wine contains:
1. not more than 4 g of residual sugar per litre; or
2. not more than 9 g of residual sugar per litre if the acid content calculated as tartaric acid is not more than 2g per litre below the residual sugar content,
(b) "semi-dry" only if the wine in question contains:
1. residual sugar in quantities exceeding the value referred to in (a), not exceeding 12 g per litre; or
2. not more than 18 g of residual sugar per litre if the acid content fulfils the condition referred to in (a) (2);
(c) "semi-sweet" only if the wine in question contains residual sugar in quantities exceeding the value referred to in (b), not exceeding 45 g per litre,
(d) "sweet" only if the wine in question contains residual sugar of at least 45 g per litre.
(9) The valuation indication referred to in paragraph 4 (d) applies only to a particular lot which has been filled from a single container of at least 1000 litres, with the exception of wine with an addition, and which has been packed in packages intended for consumers of up to 1 litre. In so doing,
(a) indicate the name of the wine-growing region, the wine-growing community and the wine-growing line from which the wine comes and the year in which the grapes were harvested;
b) bear a cap which cannot be used more than once.
(10) The minimum quantity of wine with added value for the purposes of the designation by the indication of the award of the valuation referred to in paragraph 9, packed in consumer packages, shall be as follows:
a) Cabinet 600 litres,
(b) late collection of 400 litres;
(c) selection of grapes and selection of berries of 200 litres,
(d) ice and straw wine 100 litres.
(11) The valuation referred to in paragraph 4 (d) or the valuation awarded by another country may be indicated on the label of the quality wine only if this can be demonstrated by the relevant document.
(12) The packaging referred to in Article 2 (1), which contains the particulars referred to in Article 13 of the Act, may include:
(a) establishing a company, on wine-growing in the family, on the history of wine, bottling plant or person involved in the marketing of wine, e.g. "Company founded in........," "Wine-growing in the family since.......,"
(b) the maturity of the wine resulting from its storage, which shall be indicated by the words "aged in a wooden barrel" or "barrique,"
(c) the method of producing wine from red or blue grapes without fermentation, to be indicated by the words "claret,"
(d) the method of production of wines with the addition of grapes of vine varieties affected by noble mould grey (Botrytis cinerea), to be indicated by the words "botrytic collection."
(13) The particulars referred to in paragraph 4 (e) shall appear on the packaging referred to in Article 2 (1) clearly separate from the part on which the particulars referred to in Article 13 of the Act are given or on the tag.
(14) Where quality wine originates from products obtained from grapes harvested in different wine-growing municipalities but within a single wine-growing area, only the name of the wine-growing region may be indicated.
(15) The names of the vine varieties, which are composed of several words, shall be indicated on the label in no more than two rows in a single type and font size. The marking shall not be interrupted by any other indication.
(16) The indication of the year shall be indicated on the label only if at least 85% of the grapes used for the production of the wine have been harvested in that year.
Details of the labelling of sparkling and semi-sparkling wine with other particulars
(1) The actual alcoholic strength shall be indicated in units or units rounded to 5 tenths of a percentage. The said alcoholic strength shall not be more than or less than 0,8% vol by volume than that determined by analysis; the derogation provided for in the test method used is accepted. The figure identifying the actual alcoholic strength by volume shall indicate the symbol "% vol 'and may be preceded by the words" actual alcoholic strength' or "actual alcohol '.
(2) Sparkling wine shall be marked with one of the following terms according to the sugar content:
(a) "brut nature" or "naturally hard" if the sugar content is below 3 g in litre; such data can only be used for products for which no sugar has been delivered after the production of sparkling wine,
(b) "extra brute" or "particularly hard" if the sugar content is between 0 g and 6 g in litre;
(c) "brute" or "hard" if the sugar content is less than 15 g in litre;
(d) "extra dry" or "particularly dry" if the sugar content is between 12 g and 20 g in litre;
(e) "sec" or "dry" if the sugar content is between 17 g and 35 g in litre,
(f) "demi-sec" or "semi-dry" if the sugar content is between 33 g and 50 g in litre,
(g) "doux" or "sweet" if the sugar content is greater than 50 g per litre.
(3) Where the sugar content of a given product makes it possible to use the two terms referred to in paragraph 2, only one of them shall apply.
(4) For quality sparkling wines aromatic, the use of the term for sugar content may be replaced by an indication of the sugar content in grams per litre. The tolerance allowed shall be ± 5 g / l.
(5) The terms "doux" or "sweet" may be replaced by the indication that the sugar content exceeds 50 g in litre.
(6) The terms referred to in Section 5 (8) may be used to express the sugar content of sparkling wine.
(7) The indication of the wine year may be used to indicate:
(a) quality sparkling wine or quality sparkling wine in the wine-growing region; or
(b) sparkling wines originating in a third country for which the conditions for its manufacture have been recognised as equivalent to those laid down in the law.
(8) The reference to the wine year may be indicated only if at least 85% of the wine has been obtained from grapes harvested in the year concerned, with the exception of products contained in the distillery or dispatch liqueur.
Restrictions on wine labelling
(1) No labelling shall be used for the designation of table wine, quality wine, wine with added value or imported wine containing the words, parts of words, signs or illustrations which:
(a) contain:
1. in the case of table wine, the name of a quality wine or wine with the addition of:
2. in the case of quality wine, the name of a table wine or wine with the addition of:
3. in the case of imported wine, the name of one of the table wines or quality wines or wines with the addition of:
(b) contain incorrect data, in particular those concerning geographical origin, vine variety, vintage or quality of wine.
(2) No indication interchangeable with the characteristics of table wine, quality wine, wine with added value or other imported wine shall be used to indicate imported wine.
Efficacy
This decree shall take effect on the day of its publication.
