DECLARATION
Ministry of Transport and Communications
of 29 November 1996
amending and supplementing Decree No. 102 / 1995 of the Ministry of Transport Coll., on the approval of the technical competence and technical conditions of road traffic
The Ministry of Transport and Communications provides, pursuant to Section 16 of Act No. 38 / 1995 Coll., on technical conditions of road traffic of road vehicles:
Čl. I
Decree of the Ministry of Transport No. 102 / 1995 Coll., on the approval of the technical competence and technical conditions of road traffic, is amended as follows:
1. In Paragraph 25 (1), the following sentence is added at the end: "For the approval of the technical competence of a used road vehicle, the technical conditions with regard to its braking apply:
(a) for vehicles of categories M2, M3, N2, N3, O3 and O4 pursuant to ECE Regulation No 13.06 until 30 September 1997,
(b) for vehicles of categories M1, N1, O1 and O2 pursuant to ECE Regulation No 13.06 until 31 December 1999,
(c) for vehicles of category L pursuant to ECE Regulation No 78.01 until 31 December 1999. "
2. In Paragraph 39 (1), the words in brackets "under ECE Regulations No 32 and 33 'are replaced by" under ECE Regulations No 32, 33, 94 and 95';
3. Note 29) reads as follows:
"29) Decree No. 176 / 1960 Coll. (ECE No 29, 32, 33, 66, 94 and 95). '
4. In Paragraph 43 (1), the following sentence is added at the end: "The strength of passenger seats and their attachment to a vehicle for vehicles of categories M2 and M3 with a occupancy of 17 or more passengers shall meet the conditions laid down in the specific Regulation for the approval of the technical competence of the vehicle concerned and shall be approved accordingly. '.
5. In Paragraph 51 (1), the following sentence is added at the end: "For the approval of the technical competence of a used road vehicle, the limits shall apply:
(a) for vehicles of category M1 or N1 pursuant to ECE Regulation No 83.02 B until 31 December 1999,
(b) for vehicles of categories L1 and L2 pursuant to ECE Regulation No 47.00 until 31 December 1999,
(c) for vehicles of categories L3, L4 and L5 under ECE Regulation No 40.01 until 31 December 1999. ';
6. In Paragraph 51 (2), the following sentence is added at the end: "Limits shall apply to the approval of the technical competence of a used road vehicle:
(a) for vehicles of categories M2, M3, N2 and N3 pursuant to ECE Regulation No 49.02 A until 30 September 1997,
(b) for vehicles of categories M1 and N1, the limits in accordance with ECE Regulation No 83.02 C or 49.02 A shall apply until 31 December 1999. ';
7. In Paragraph 52 (2), the following sentence is added at the end: "For the approval of the technical competence of a used road motor vehicle, the external noise limits shall apply:
(a) for vehicles of category L1 under ECE Regulation No 63.00 and for vehicles of categories L3 and L4 under ECE Regulation No 41.01 until 31 December 1999,
(b) for vehicles of categories L2 and L5 under ECE Regulation No 9.04 until 31 December 1999,
(c) for vehicles of categories M1 and N1 pursuant to ECE Regulation No 51.01 until 31 December 1999,
(d) for vehicles of categories M2, M3, N2 and N3 under ECE Regulation No 51.01 until 30 September 1997. ';
8. In Paragraph 52, the following paragraph 5 is inserted after paragraph 4:
"(5) In the case of vehicles of categories L3 and L4, the exhaust silencing system may be used for replacement purposes which satisfies the conditions laid down in the special Regulation 50a) and which must be approved accordingly."
Paragraphs 5 and 6 shall become paragraphs 6 and 7.
9. Note 50a:
"50a) Decree No. 176 / 1960 Coll. (ECE No 92). '
10. in footnote 52), in brackets, "98, 99" is inserted after "91";
11. The heading of Section 62 reads:
"Reflections and retro-reflectors of special markings'.
12. Article 62 shall be added to paragraphs 9, 10, 11 and 12:
"(9) Four-wheel and multi-wheel motor vehicles whose maximum design speed does not exceed 30 km.h-1, and their trailers (so-called" slow vehicles ") newly put into service as from 1 October 1997 and vehicles in service as from 1 October 1999, shall bear a special mark when operating on the rear road. This marking shall comply with the conditions laid down in the special Regulation 53a) and shall be approved accordingly.
(10) Vehicles of category N3 (so-called "heavy vehicles") when operating on the road shall bear a specific marking on the rear, as specified in paragraph 12, of:
- vehicles in international road traffic from the date of application of this decree,
- vehicles newly put into service as from 1 October 1997,
- other vehicles in service not later than 1 October 1998.
(11) Trailers of category O4, trailers of categories O1, O2 and O3 of a total length of more than 6 m and semi-trailers of categories O1, O2 and O3 of a total length of more than 8 m (so-called "long vehicles') when in use on the road shall bear a special marking on the stern as referred to in paragraph 12, namely:
- vehicles in international road traffic from the date of application of this decree,
- vehicles newly put into service as from 1 October 1997,
- other vehicles in service not later than 1 October 1998.
(12) The special marking of heavy vehicles within the meaning of paragraph 10 and of long vehicles within the meaning of paragraph 11 shall comply with and be approved under the special Regulation 53b. ';
13. Note No 53a) reads as follows:
"53a) Decree No 176 / 1960 Coll. (ECE No 69). '.
14. Note No 53b) reads as follows:
"(53b) Decree No. 176 / 1960 Coll. (ECE No 70). '.
15. In Paragraph 73 (4), the second sentence shall read: "For the approval of the technical competence of a road vehicle type, vehicles of category M1 and vehicles of category N1 may be fitted with a vehicle alarm system not exceeding 2 t, which shall comply with the conditions laid down in the special Regulation, 69) and shall be approved accordingly."
16. Note 69) reads as follows:
"69) Decree No 176 / 1960 Coll. (ECE No 97). '.
17. in Paragraph 75, the following paragraph 6 is inserted after paragraph 5:
"(6) For the approval of a type of road vehicle as from 1 October 1997, vehicles of categories N2 and N3 shall be fitted with a front underrun protection device. This device and its installation on the vehicle shall comply with the conditions laid down in the separate Regulation 75a) and shall be approved accordingly. Vehicles of category N2 of a total mass not exceeding 7,5 t shall comply only with the condition of the ground clearance of the lower edge of the protective device not exceeding 400 mm specified in this Regulation. That requirement shall not apply to off-road vehicles (category G) and those vehicles where the use of such equipment is incompatible with the purpose of the use of the vehicle. ';
Paragraphs 6, 7 and 8 shall be renumbered paragraphs 7, 8 and 9.
18. Note No 75a) reads:
"75a) Decree No 176 / 1960 Coll. (ECE No 93). '.
19. Paragraph 106 (3) reads as follows:
"(3) If a special Regulation is amended (3) and it does not provide otherwise, the procedure shall be followed:
(a) in the case of vehicles, components and accessories which have not yet been approved in accordance with the previous version of the special Regulation, the amended version of the Regulation as from the date fixed for the approval within the meaning of that text,
(b) in the case of vehicles, components and accessories already approved according to the previous version of the special Regulation, to the amended version of the Regulation after 12 calendar months from the date of entry into force of the amended version. "
20. In Paragraph 106, the following paragraph 4 is inserted after paragraph 3:
"(4) The approval of a type of road vehicle shall be subject to the use on that vehicle of parts, units, equipment and fittings complying with the last version of the approved type, provided that they are subject to such approval. These conditions shall also be met by the vehicle with regard to its entire design and all its functions. ';
Paragraphs 4, 5, 6 and 7 shall be renumbered paragraphs 5, 6, 7 and 8.
21. In § 109, the following words are added at the end of the sentence: "and in the Transport and Communications Bulletin."
22. In Annex 5 to the Order, the names and addresses of the accredited international certification bodies in the Czech Republic shall be supplemented by the name and address of the other authorised international certification service, which shall be as follows:
