of 23 July 2009
amending Act No 166 / 1999 Coll., on Veterinary Care and amending certain related laws (Veterinary Act), as amended, and Act No 634 / 1992 Coll., on Consumer Protection, as amended
Parliament has decided on this law of the Czech Republic:
Amendment of veterinary law
Act No. 166 / 1999 Coll., on Veterinary Care and on the Amendment of Certain Related Laws (Veterinary Act), as amended by Act No. 29 / 2000 Coll., Act No. 154 / 2000 Coll., Act No. 102 / 2001 Coll., Act No. 76 / 2002 Coll., Act No. 120 / 2002 Coll., Act No. 309 / 2002 Coll., Act No. 320 / 2002 Coll., Act No. 131 / 2003 Coll., Act No. 316 / 2004 Coll., Act No. 444 / 2005 Coll., Act No. 48 / 2006 Coll., Act No. 186 / 2006 Coll., Act No. 124 / 2008 Coll., Act No. 182 / 2008 Coll., Act No. 223 / 2009 Coll., Act No. 227 / 2009 Coll., is amended as follows:
1. In Paragraph 5a (1), the words "for business purposes' shall be deleted and the words" an undertaking, plant or other establishment in which those animals are kept or kept 'shall be replaced by the words "aquaculture production undertaking or special aquaculture establishment in which aquatic animals are kept'.
2. In Article 21 (13), the sentence "If this examination is not carried out by the Regional Veterinary Administration, it must be carried out in the laboratory referred to in Article 52 (3)."
3. In the first sentence of Article 27b (3), the words "and, if this person is not available, the veterinarian 'shall be deleted.
4. In the first sentence of Article 27b (5), the words "or veterinarian 'shall be deleted.
5. in Paragraph 48 (1) (q), including footnotes 25g to 25i:
"(q) shall, at the request of the authority carrying out State surveillance under the Act on Czech Trade Inspection25g) or the Act on the Customs Administration of the Czech Republic25h), which the State Veterinary Institute shall carry out laboratory tests to identify the animal species in accordance with the Regulation of the European Communities prohibiting the placing on the market, importing and exporting into the Community of cat and dog skins and products containing these skins 25i);
25g) Act No. 64 / 1986 Coll., on Czech Trade Inspection, as amended.
25h) Act No. 185 / 2004 Coll., on the Customs Administration of the Czech Republic, as amended.
(25i) Regulation (EC) No 1523 / 2007 of the European Parliament and of the Council of 11 December 2007 prohibiting the placing on the market, importation into and exportation from the Community of cat and dog skin and products containing such skin. "
Footnote 25g is renumbered footnote 25j, footnote 25g is renumbered footnote 25k and footnotes 25h to 25j are renumbered footnotes 25l to 25n, including the footnotes.
6. In Article 49 (1) (p), the following point 3 is added:
'3. compliance with the obligations or requirements laid down in the Regulation of the European Communities prohibiting the placing on the market, importation into and exportation from the Community of cat and dog skins and products containing these skins (25i) in the case of raw cat and dog skins; ';
7. In Paragraph 70 (1), after the second sentence, the sentence "In case of a replacement in the event of a dangerous disease of bees, the time limits for submitting an application under the previous sentence shall be extended by 6 weeks."
Amendment to the Consumer Protection Act

1. In Section 23, paragraph 12 is added, including footnote 29:
"(12) The Czech Trade Inspection Centre shall supervise compliance with the obligations or requirements laid down by the directly applicable European Communities regulation prohibiting the placing on the market, importing and exporting into the Community cat and dog skins and products containing these skins (29), unless they are raw cat and dog skins.
(29) Regulation (EC) No 1523 / 2007 of the European Parliament and of the Council of 11 December 2007 prohibiting the placing on the market, importation into and exportation from the Community of cat and dog skins and products containing such skin. "
2. In Paragraph 23a, the following paragraph 4 is inserted after paragraph 3:
"(4) The Czech Trade Inspection Centre is entitled to provide and order the destruction of cat and dog skins and products containing these skins, with the exception of raw cat and dog skins, at the expense of those who have infringed the prohibition laid down by the directly applicable European Communities29)."
Paragraphs 4 to 6 shall be renumbered paragraphs 5 to 7.
3. in Article 23a (7), the words "paragraph 4 'are replaced by the words" paragraph 5';
4. In Article 24 (1) (b), at the end, the word "or 'is deleted and the following point (c) is added:
"(c) infringes the prohibition arising from a directly applicable regulation of the European Communities prohibiting the placing on the market, importing into the Community and exporting from it cat and dog skins and products containing these skins (29), or '.
Point (c) shall be renumbered (d).
5. in Article 24 (9) (a), "x)" is replaced by "w)";
6. In Article 24 (9) (b), the words "and (d) 'shall be inserted after the words" (c)'.
7. in Article 24 (9) (d), "(y)" is replaced by "(x)";
8. in Article 24a (1), the following point (c) is inserted after point (b):
"(c) infringes the prohibition arising from a directly applicable regulation of the European Communities prohibiting the placing on the market, importation into and exportation from the Community of cat and dog skins and products containing these skins (29),"
Points (c) to (e) shall be renumbered as points (d) to (f).
EFFECTIVE
This Act shall take effect on the day of its publication.
