DECLARATION
of 6 June 2006
amending Decree No. 167 / 2002 Coll., implementing Act No. 247 / 2000 Coll., on the acquisition and improvement of professional competence for the management of motor vehicles and on amendments to certain laws, as amended by Act No. 478 / 2001 Coll., as amended by Decree No. 152 / 2003 Coll.
The Ministry of Transport provides pursuant to § 62 of Act No. 247 / 2000 Coll., on the acquisition and improvement of professional competence to drive motor vehicles and on amendments to certain laws, as amended by Act No. 478 / 2001 Coll.:
Decree No. 167 / 2002 Coll., implementing Act No. 247 / 2000 Coll., on the acquisition and improvement of professional competence for the management of motor vehicles and on amendments to certain laws, as amended by Act No. 478 / 2001 Coll., as amended by Decree No. 152 / 2003 Coll., is amended as follows:
1. In Section 1, the words, including the footnote, shall be inserted after the words "This decree '," the relevant provisions of the European Communities shall be incorporated'; and
1) Commission Directive 2000 / 56 / EC amending Council Directive 91 / 439 / EEC on driving licences. '
footnote 1 shall be renumbered footnote 1a, including the footnote references.
2. Paragraph 17, including the title, reads:
Test on road traffic rules and medical training
(K § 40 (3) of the Act)
(1) The test to be carried out under the road traffic and medical training regulations is composed of 25 issues with the possibility of obtaining 50 points.
(2) The questions in the test are drawn up as follows:
(a) 10 questions verifying the knowledge and use of road traffic rules by drivers;
(b) 4 questions verifying knowledge of the principles of safe driving and vehicle control;
(c) 3 questions verifying the knowledge of road signs, light and acoustic signals, warning lights, special markings of vehicles and persons, transport equipment and operational information equipment, including appropriate driver behaviour that is relevant to their importance;
(d) 3 issues verifying the ability to deal with traffic situations;
(e) 2 issues verifying knowledge of the rules on road traffic conditions;
(f) 2 issues verifying knowledge of road traffic regulations;
(g) 1 question verifying knowledge of medical training.
(3) The following types of questions are used in the test:
(a) the question to which 3 answers are assigned, only one of which is correct;
(b) the question to which "yes" or "no" answers are assigned,
(c) the question to which three pictures are assigned, only one of which is correct in relation to the question.
(4) The questions in the test referred to in paragraph 2 (b), (e) and (f) are aimed at demonstrating the knowledge of the applicant for a driving licence in the following areas:
(a) the importance of monitoring the traffic situation on the road, the considerate and disciplined behaviour of other road users;
(b) the effect of fatigue, alcohol, addictive substances and medicines on the driver's response and recognition capabilities, on the response time and change in driver's behaviour in general;
(c) the most important principles concerning compliance with the safety distance between vehicles, braking tracks and vehicle control in relation to different weather conditions;
(d) the impact of weather conditions on the state of the infrastructure and the risks arising from these changes for the driving of the vehicle, including the impact of changes in the daytime and night time on the driving of the vehicle;
(e) the way in which the vehicle is managed on individual road categories and the risks associated with driving on different road categories at different traffic densities, the characteristics of the different road construction works and their impact on the safety of the vehicle's driving;
(f) specific risk factors relating to the lack of experience of other road users, such as children, pedestrians, cyclists and people with reduced mobility,
(g) risks arising from differences in the management of different types of motor vehicles, field of vision and driver visual perception when driving different types of vehicles;
(h) the documents required for the operation of the vehicle;
(i) the principles of conduct and conduct in the event of an accident or similar event and the measures to be taken in such cases (identification of the location of the accident, notification of the accident, provision of first aid);
(j) rules for ensuring the safe transport of persons and goods;
(k) safety precautions when leaving the vehicle;
(l) structural components of the vehicle which affect the safety of driving, in particular the steering system, the wheel suspension system, the braking system, the tyres, the headlamps, the lights, the direction indicators, the reflectors, the rear-view mirrors, the windscreen washer and the windscreen wipers, the exhaust system, the safety belts and the audible warning devices, including the recognition of their normal failures and defects;
(m) the safety equipment of the vehicle, in particular seat belts, head restraints and child restraint systems;
(n) rules on the use of the vehicle in relation to the environment, in particular adequate use of audible warning devices, fuel consumption, limitation of polluting emissions.
(5) The questions in the test referred to in paragraph 2 (b), (e) and (f), in addition to the areas referred to in paragraph 4, for AM and A and subgroup A1, are further aimed at demonstrating the knowledge of the applicant for a driving licence in the following areas:
(a) the use of protective equipment, in particular gloves, shoes, clothing and protective helmets;
(b) visibility of motorcyclists for other road users;
(c) risk factors arising from the state of the road, taking into account the slippery parts of the road, e.g. sewerage cover, horizontal road signs and tram tracks.
(6) The questions in the test referred to in paragraph 2 (b), (e) and (f), in addition to the areas referred to in paragraph 4, for categories C, C + E, D, D + E and subgroups C1, C1 + E, D1 and D1 + E, are further aimed at demonstrating the knowledge of the applicant for a driving licence in the following areas:
(a) driving time, security breaks, rest periods and use of recording equipment;
(b) the carriage of goods or passengers;
(c) the documents necessary for the operation of the vehicle and the documents necessary for the national and international carriage of cargo or passengers;
(d) the principles of conduct and conduct in the event of an accident or similar event and the measures to be taken in such cases, including the rules applicable to the implementation of rescue or evacuation operations;
(e) safety measures for the dismantling or replacement of wheels;
(f) the mass and dimensions of the vehicle;
(g) limitations on the driver's visual field resulting from the vehicle design;
(h) the principles applicable to the loading of the vehicle, the inspection of the load, the loading and fixing of the load, the characteristic characteristics of certain types of cargo (bulk materials, liquids, suspended loads), the means of loading and unloading of large items when using the loading equipment (only for groups C, C + E and C1 + E and subgroups C1 and C1 + E);
(i) the driver's liability principles applicable to the carriage of passengers with a view to ensuring the comfort and safety of passengers, the specificities of the transport of children, including pre-departure checks (only for groups D and D + E and sub-groups D1 and D1 + E);
(j) the basic structure and function of the combustion engine, liquids, fuel system, electrical system, ignition system and transmission system (only for groups C, C + E, D and D + E);
(k) the principles of installation and proper use of tyres, including maintenance;
(l) types of braking systems, their main components, connections, use and daily maintenance, types of speed limitation devices;
(m) types of coupling systems, their main components, including their connection, use and daily maintenance (only for groups C + E and D + E and subgroups C1 + E and D1 + E),
(n) the methods used to detect causes of failure;
(o) the principles of preventive vehicle maintenance and proper repair;
(p) the driver's responsibility for loading and unloading the cargo (only for groups C and C + E and subgroups C1 and C1 + E).
(7) Individual correct answers are evaluated by one, two or four points. One point shall be evaluated for the correct answer to questions under paragraph 2 (c), (e) and (g). The two points shall be evaluated for the correct answer to the questions referred for in paragraph 2 (a), (b) and (f). The four points shall be evaluated for the correct answer to the questions referred for in paragraph 2 (d).
(8) At least 43 points are required for the evaluation of the test with a "benefit '.'
3. Paragraph 19, including the title, reads:
Practical driving test
(Paragraph 42 (5) of the Law)
(1) In the first part of the practical driving test, the applicant for a driving licence shall demonstrate the following knowledge and skills:
(a) for all categories and subgroups of driving licences
1. check the condition of tyres, vehicle lighting and direction-indicator lights, audible warning devices, steering and brake functionality, windscreen, windscreen wipers, operating fluids, instrument plates and tell-tales, adjust the seat to the correct position, adjust the rear-view mirrors, fasten the safety-belt and verify that all doors are closed, for groups C, C + E, D and D + E and for sub-groups C1, C1 + E, D1 and D1 + E, in addition to check the condition of the brakes and steering systems, wheels, wheel discs, fenders, windows and recording equipment;
2. then start the engine and make a smooth start of the vehicle (during the test to start up the hill and down the hill), revert by turning left and right, brake the vehicle to stop accuracy, park the vehicle and leave the parking space, drive to and exit from the curb, bypass the standing vehicle and obstacles, in addition to turn the vehicle in the opposite direction in group B and subgroup B1 using forward and reverse direction;
(b) in the case of driving licences of categories AM and A and subgroup A1, adapt the protective helmet, gloves, shoes and clothing, start the motorcycle from the stand and lead it without running the engine;
(c) for category B, B + E, C, C + E, D, D + E and T and subgroups C1, C1 + E, D1 and D1 + E
1. carry out a body check, driver and passenger doors, emergency equipment and other safety equipment;
2. demonstrate knowledge of the safety of work when loading and unloading the vehicle, safe parking and securing the vehicle for loading and unloading;
(d) in the case of a driving licence of categories B + E, C + E, D + E and T and subgroups C1 + E and D1 + E, connect a trailer or a semi-trailer to form a combination of vehicles, the operation must start with a towing vehicle parked next to the trailer or semi-trailer, i.e. not in one row, and check the coupling device, brakes and electrical connections and disconnect the trailer or semi-trailer;
(e) for driving licences of categories C, C + E, D, D + E and T and subgroups C1, C1 + E, D1 and D1 + E, demonstrate the knowledge of the use of recording equipment, brake system principles and speed limitation devices and check the relief brake and control systems;
(f) for driving licences of categories D and D + E and subgroups D1 and D1 + E
1. check emergency exits, fire extinguishers and other safety equipment;
2. demonstrate knowledge of the rules relating to stopping and standing with regard to safe boarding and exit from the bus.
(2) In the second part of the practical driving test, the applicant for a driving licence shall demonstrate the following knowledge and skills:
(a) for all categories and subgroups of driving licences
1. the ability to control the motor vehicle in road conditions, in particular to maintain the correct direction of travel, to accelerate the vehicle up to the appropriate speed and to maintain this speed even during the gear shift, to enter and drive safely, to adjust the speed of the vehicle when turning left and right, and, if possible, to adjust the speed of the vehicle to road conditions, to join another lane, to pass a moving vehicle, especially in narrow spaces, to observe the correct distance between vehicles in different lanes, to overtake in different situations, to turn at the intersection left and right, to turn off of road roads,
2. knowledge of driving on a roundabout, crossing a level crossing railway, driving along tram stops, buses and trolleybuses, crossing pedestrian crossings, hill and hill crossings at a large longitudinal slope, entering or leaving the motorway or the road for motor vehicles, placing in a lane with faster moving vehicles, crossing into a lane with slower driving vehicles if such traffic situations are available at the test site;
(b) in the case of a driving licence for categories AM, A and A1
1. park the motorcycle and put it on the stand,
2. Drive the U-shaped curve, perform the slalom at slow speed, at the assigned second or third gear and speed of at least 30 km.h-1 to perform a driving action demonstrating the ability to safely control the motorcycle;
3. at an initial speed of not less than 50 km.h-1, for the AM group reasonably reduced with regard to the maximum permissible speed of the vehicle, carry out a driving action consisting of avoiding an obstacle and two braking manoeuvres;
4. demonstrate the control of the motorcycle at different speeds and different operating situations, showing the ability to simultaneously control the clutch and brake, maintain the balance and direction of view, position of the feet on the foot and demonstrate control of the steering and gear control techniques and the front and rear brakes;
(c) for category C, C + E, D, D + E and T and subcategories C1, C1 + E, D1 and D1 + E, knowledge of the characteristics of the vehicle which can prevent the driver from facing, the influence of the wind on the driving of the vehicle, the measures necessary for overtaking the spray mud, the use of different braking systems, the use of the deceleration brake and the adjustment of the track of the vehicle length and its overrun at turning.
(3) Throughout the second part of the practical driving test referred to in paragraph 2, the applicant for a driving licence shall demonstrate considerate, disciplined, predictable and adaptable driving behaviour.
(4) The assessment of the practical driving test shall include an assessment of the adaptable and decisive driving behaviour, compliance with the driver's obligations on the road, adaptation of the current weather and other road conditions, respect for other road users and the correct and timely response to their behaviour, with caution towards children, pedestrians, cyclists and persons with reduced mobility, the ability to anticipate road traffic situations, the ability to control the vehicle and the proper use of its components and equipment, the implementation of the necessary measures when leaving the vehicle. ';
4. In Paragraph 21 (2), the second sentence is deleted.
Efficacy
This Decree shall take effect on 1 July 2006.
