THE LAW
of 19 July 1990
on the adaptation of certain property relations to the Greek Regulations
and the congregation and archbishop of Olomouc
The Federal Assembly of the Czech and Slovak Federal Republic decided on this law to remedy the injustices caused by the Greek laws and conventions in the 1950s, in particular by the unlawful withdrawal of their immovable property:
(1) The immovable property listed in Annex 1 to this Act is declared to be the property of individual orders and conventions on the date of application of this Act.
(2) The real estate listed in Annex No 2 to this Act is declared to be the property of the Archbishop of Olomouc on the date of its effectiveness.
(3) The real estate listed in Annex 3 to this Act is declared to be the property of individual orders and conventions on 1 August 1991.
(4) The ownership of the various orders and conventions and archbishop of Olomouc on the date of application of this Act is also declared movable property, which was located on 10.4.1950 in the properties listed in Annexes 1 and 2 to Law No 298 / 1990 Coll. and in Annex 3 to this Act, if it exists and is known where the said movable property is located.
The effective date of this Act shall cease to be the claims of the relevant laws and conventions and of the Archbishop of Olomouc against the existing owners and users of the property referred to in § 1 for damages and unjustified property benefits, including rent claims, if they arose between 1 January 1950 and the effective date of this Act.
(1) Disputes concerning the application of this law are settled by the courts.
(2) The geodesy authorities will record changes in ownership relations under this law.
(1) The removal of immovable property referred to in Article 1, where it is intended for the provision of medical or social services or for education or cultural or educational activities, may be requested only after the prior consent of the body provided for by the laws of national councils.
(2) The provisions of paragraph 1 shall apply mutatis mutandis to the immovable property referred to in Paragraph 1 (3), where it serves the purposes of archiving.
(3) The removal of immovable property referred to in Article 1 shall be subject to an agreement between the law and the congregation with existing users of real estate using them for the purposes referred to in paragraphs 1 and 2. In the absence of this Agreement, the Greek Regulations and Congregations shall be entitled to the removal of the properties listed in Annexes 1 and 2 to Act No 298 / 1990 Coll. and in Annex 3 to this Act, which serve the purposes referred to in paragraphs 1 and 2 of this Act, after a period of 10 years from the date of application of this Act. The conclusion of an agreement on the use of flats and non-residential premises is governed by the provisions of the Civil Code, the Law on the rental and subletting of non-residential premises and related regulations. This commitment is transferred to all other owners at that time.
(4) If there is no agreement on the amount of the rent and the conditions under which it is paid between the existing users of real estate using it for the purposes set out in paragraphs 1 and 2 of this Law, and the rules of law, conventions and archbishop of Olomouc, the level of the rent shall be decided by the competent authority of the state administration in accordance with the generally applicable pricing rules.
This Act shall take effect on the day of its publication.
