Regulation on the examination of water and sewage construction projects for housing sites

Order of the Minister of Technology
of 14 December 1948
on the examination of water and sewage construction projects for housing sites.
The Minister of Technology hereby orders pursuant to § 41 (2) (g) of the Act of 27 October 1948, No. 241 Coll., on the first five-year Economic Plan for the Development of the Czechoslovak Republic (Five-Year Plan Act):
(1) Any project of water and sewage structures (hereinafter referred to as the "project") for residential buildings which are mass-built and wholly or partly concentrated in the district of the municipality (hereinafter referred to as the "site") must be examined by the Ministry of Technology in terms of efficiency and technical feasibility.
(2) The project shall contain the following components:
1. an indication of the number of dwellings in the estate and the timing of the use of the housing with an indication of the time coordination between housing and public investment,
2. A clear map, on the scale of 1: 25.000,
3. a semi-anonymised plan of the scale 1: 2.880 or 1: 1000 marked with height ratios of anchors and plantations and with the drawing of the entire settlement,
4. longitudinal profiles of water-timetables or sewers with a length of 1: 1000 and a height of 1: 100,
5. plans for construction objects in the scale 1: 50,
6. technical report with hydrogeological evidence, hydrotechnical and static calculations,
7. budget of construction cargo with reports of land works and buildings, price list of works and materials, price analysis and calculation of construction equipment (including water pipes and sewage fittings for street installations); and
8. List of servants and water rights concerned.
(1) The project will be submitted by the Regional National Committee for examination
1. construction kit, namely
(a) before the water-rights hearing, if the project was not submitted for consideration under the Water Law before the publication of this Regulation; or
(b) by 31 January 1949 at the latest, if a water permit has been issued before the publication of this Regulation, but the implementation of the project has not yet begun or has not yet been fully completed;
2. the Water Authority immediately, if the project has already been submitted for consideration under the Water Law before the publication of this Regulation, but has not yet been authorised.
(2) If the implementation of the project has already begun, the whole project must be submitted and the part which is not yet implemented must be marked.
The Ministry of Technology will examine the submitted project, establish its link with the implementation plans of the housing buildings and see how the time coordination of all works for the construction of the housing site is ensured. The project shall be returned either with a certificate of examination or with an order from the builder to amend or supplement the project; However, it cannot be imposed to remove the part of the construction already carried out. The project may only be approved if it is accompanied by a certificate from the Ministry of Technology on examination. The result of the examination is binding on the project under the Water Act and its implementation; If a water-law permit has already been granted and it is contrary to the examination certificate, the project should be re-authorised. The result of the examination may be waived only with the agreement of the Ministry of Technology.
If the municipality for the housing site (§ 1), built as part of the tasks of the two-year economic plan or included in the implementation plans of the five-year plan, has not yet completed the project of water and sewage structures, it shall be obliged to do so without delay and submit the project to the Regional National Committee by 28 February 1949, which shall submit it with its comments to the Ministry of Technology for examination, for which the provisions of § 3 apply mutatis mutandis.
The Ministry of Technology may entrust the Regional National Committees with the examination of the projects under Sections 3 and 4.
Until the Regional National Committees begin to operate in the matters covered by this Regulation, their responsibilities in the Czech countries are carried out by the Regional National Committees and in Slovakia mandated technicians.
This Regulation shall enter into force on the day of its publication.
