According to Section 53 (3) of Act No. 165 / 2012 Coll., on Supported Energy Sources and on the Amendment of Certain Acts, as amended by Act No. 131 / 2015 Coll.:
In Decree No. 390 / 2015 Coll., on how to determine the main activity of agricultural production and how to register the list of producers with the main activity of agricultural production, Section 2 including the title reads:
Method of determining the main activity of agricultural production
The main activity of agricultural production is the activity of an agricultural entrepreneur, which is registered in the records of an agricultural entrepreneur pursuant to Section 2f of the Agricultural Act, if, in the sum of the last closed financial year, its agricultural production revenues account for more than 50% of the total business income and this is demonstrated by an auditor's report. The auditor's report for the previous calendar year shall be submitted by the agricultural entrepreneur to the Ministry of Agriculture by 30 June each year. ';

Efficacy
This Decision shall enter into force on 1 January 2019.
