DECLARATION
of 5 September 2012
on the particulars of the Charter on the examination of the deceased, the manner in which he is completed and the transfer of the places of destination, and the particulars of the notification of termination of pregnancy by the birth of a dead child, the death of a child and the death of a mother (Order on the Charter on the examination of the deceased)
The Ministry of Health provides pursuant to Section 120 of Act No. 372 / 2011 Coll., on Health Services and the Conditions for their Provision (Health Services Act), as amended by Act No. 167 / 2012 Coll., for the implementation of Section 92 of the Health Services Act:
§ 1
(1) The sheet on the examination of the deceased ("the sheet") is broken down into parts A and B.
(2) List to be completed
(a) an electronic template allowing electronic transmission; or
(b) in the printed form of an electronic template or a copy form (hereinafter referred to as "paper form").
(3) The elements of the Charter and the manner in which it is completed are set out in the Annex to this Order. The deceased means even a stillborn child to fill the List.
§ 2
(1) If no obligation to perform an autopsy or to perform an autopsy is provided for in the Health Services Act, the List shall be transmitted as follows:
(a) Part A of the Institute of Health Information and Statistics of the Czech Republic, after completion of all investigations related to the identification of causes and circumstances of death, but not later than 30 days from the date of death or, where applicable, the date of the body of the deceased; a copy of this part shall be entered in the medical file of the deceased health service provider whose doctor has examined the deceased's body;
(b) Part B:
1. Part B1 of the Matrix Office under the Matrix Act 1),
2. part B2 to the person providing the funeral2),
Part 3 of B3 to funeral services providing burial (2).
(2) If there is an obligation by the Health Services Act to perform an autopsy or to perform an autopsy, the List shall be transmitted to the health service provider whose medical establishment is to perform an autopsy, to the person responsible for the burial (2) and to the funeral service operator responsible for transporting to the autopsy (2).
(3) After the autopsy, the sheet shall be transmitted as follows:
(a) Part A of the Institute of Health Information and Statistics of the Czech Republic, after completion of all investigations related to the identification of causes and circumstances of death, but not later than 30 days from the date of death or, where applicable, the date of the body of the deceased; a copy of this part shall be entered in the medical file of the deceased health service provider whose doctor has performed the autopsy;
(b) Part B:
1. Part B1 of the Matrix Office under the Matrix Act 1),
2. part B2 to the person providing the funeral2),
Part 3 of B3 to funeral services providing burial (2).
(4) In the case of a decision not to perform an autopsy, paragraph 3 shall apply mutatis mutandis.
§ 3
(1) Part A of the List is transmitted electronically to the Institute of Health Information and Statistics of the Czech Republic using a secure data protocol or paper form.
(2) Part B1 of the List shall be transmitted to the Registry in paper form or electronic form in PDF format of the document version 1.7 and above, signed by a recognised electronic signature of the doctor who carried out the examination of the deceased's body.
(3) Part B2 of the List is to be transmitted to the person providing the burial and part B3 of the List to the funeral service operator providing the burial in a manner agreed with them. No birth number shall be entered in Part B2 of the List to the person responsible for burial.
§ 4
The formalities for the termination of pregnancy by the birth of a dead child, the death of a child and the death of a mother in connection with the birth, abortion, six weeks or death within 1 year after the termination of pregnancy, which is carried out through the List of Part A, are set out in the Annex to this Order.
§ 5
(1) Corrections to the List shall be made by completing the relevant part of the list if they are found
(a) on the basis of diagnostic examinations carried out or investigations carried out by law enforcement authorities, additional facts which are not listed in the parts of the Charter referred to; or
(b) errors relevant to the accuracy of the completion of the parts of the Charter already transmitted.
(2) In the corrected List, in the relevant part A or B, it shall be indicated that the correction is by checking the item "Correction"; the corrected item is marked at the same time. Part A or B of the corrected List shall again be transmitted to the destination in accordance with Section 2, either electronically or in paper form. The relevant part of the List shall be replaced at the place of destination by the newly completed part of the List.
§ 6
Decree No 289 / 2012 Coll., on the requirements of the Charter on the examination of the deceased, the manner in which the deceased is to be completed and the transfer to the places of destination (Order on the Charter on the examination of the deceased) is deleted.
§ 7
This Decree shall take effect on 1 January 2013.
