on the conditions for irradiation of foodstuffs, the maximum permitted dose of radiation and the method of labelling
According to Section 19 (c) of Act No. 110 / 1997 Coll., on Food and Tobacco Products and on the amendment and addition of certain related laws:
Preliminary provisions
§ 1
(1) This decree lays down the conditions for the use of ultraviolet rays and ionising radiation to treat foodstuffs, the maximum permitted doses of radiation to which each type of food may be exposed and the method of labelling irradiated foods.
(2) Radiation treatment of foodstuffs under this Decree is not:
(a) the exposure caused by diagnostic devices used to control foodstuffs.
(b) exposure in which the median absorbed dose in the food does not exceed 0,5 Gy overall, 1)
(c) radiation treatment of foodstuffs carried out under medical supervision in the preparation of a special sterile diet.
(3) The requirements for sources of ionising radiation and for the protection of health in their handling are laid down in specific regulations. (2)
§ 2
For the purposes of this decree:
(a) ultraviolet radiation at a wavelength of 250-270 nm and a dose of 250-300 Jm2;
(b) ionising radiation consisting of particles charged, uncharged or both, capable of being directly or indirectly ionised.
§ 3
Conditions of irradiation of food by ultraviolet rays
Ultraviolet rays can be used for treatment
(a) water intended for the production of packed infant water, packaged table water, bottled drinking water and other bottled waters, (3) unless the essential ingredients which lend it its characteristics change;
(b) drinking water used as raw material for the manufacture of foodstuffs, with the exception of foodstuffs intended for infant and infant formulae and raw materials for their manufacture;
(c) other foodstuffs, provided that their health and quality are not affected as a result of exposure.
§ 4
Conditions of exposure to food and food ingredients by ionising radiation
(1) Foodstuffs listed in Annex No 1 may only be irradiated up to the maximum permitted absorbed dose and for the technological or hygienic purpose set out in that Annex.
(2) Other foodstuffs may only be irradiated by ionising radiation if:
(a) the technological need otherwise difficult to provide is addressed by this radiation;
(b) there is no health risk to consumers;
(c) the exposure process shall not interfere with the health and quality of the food.
(3) Under the conditions laid down in paragraph 2, ionising radiation may be used for:
(a) reducing the number of food-borne diseases through the destruction of pathogenic organisms;
(b) restrictions on food spoilage by reducing breakdown processes and destroying organisms contributing to spoilage;
(c) reduction of losses resulting from premature maturation, stamping or germination;
(d) disinfection and disinsectisation of foodstuffs containing organisms harmful to plants and plant products.
§ 5
(1) Only sources complying with the conditions laid down in Article 2 (a) may be used for the treatment of foodstuffs by ultraviolet rays.
(2) The following types of ionising radiation may be used to treat foodstuffs with ionising radiation
(a) radiation of radionuclides 60Co and 137Cs,
(b) X-ray radiation not exceeding 5 MeV;
(c) accelerated electrons with an energy not exceeding 10 MeV.
(3) The dose of ionising radiation must be limited to the lowest level necessary, which is proportionate to the technological purpose of the radiation treatment of the food.
§ 6
Method of labelling irradiated foods
(1) Food irradiated by ionising radiation is marked on the consumer packaging:
(a) the words "treated with radiation" and
(b) the graphic symbol set out in Annex 2,
in addition to spices, extracts from spices, herbs and parts of herbs which, by their nature of use by the consumer, do not exceed 2 per cent of the weight of the food put into circulation and foodstuffs containing radially treated food material up to a maximum of 10 per cent of their weight.
(2) The printing of the inscription referred to in paragraph 1 (a) must be in legible and indelible characters placed in a clearly visible place. The graphical symbol referred to in paragraph 1 (b) shall be made by dark characters on a bright ground, in combination with a combination which allows its unambiguous identification by the consumer.
§ 7
Final provision
This decree shall take effect on the day of its publication.
