THE LAW
of 19 July 1990
amending and supplementing Act No 194 / 1988 Coll., on the jurisdiction of federal central government bodies
The Federal Assembly of the Czech and Slovak Federal Republic decided on this law:
Čl. I
Act 194 / 1988 Coll., on the jurisdiction of federal central government bodies, is amended as follows:
1. In Section 2, the words "drawn up by the Communist Party of Czechoslovakia" are deleted.
2. Paragraph 9 (6) is deleted.
3. Paragraph 18 (1) reads as follows:
"(1) Federal ministries shall inform the public of proposals for serious measures relating in particular to the standard of living, health protection, social and cultural needs of citizens."
4. Sections 19 to 21, including the title, read:
"Federal Ministry of Strategic Planning
§ 19
The Federal Ministry of Strategic Planning is the central authority of the Czech and Slovak Federal Republic for the long-term strategy of economic and social development.
§ 20
(1) The Federal Ministry of Strategic Planning, together with the Central Authorities for the National Economic Strategy of the Republics and in cooperation with the Central Authorities of the Federation and Republics, coordinates the preparation of the Economic and Social Development Strategy of the Czech and Slovak Federal Republic, draws up its proposals and presents them to the Government of the Czech and Slovak Federal Republics.
(2) The Federal Ministry of Strategic Planning in the process of preparing and developing an economic and social development strategy of the Czech and Slovak Federal Republics, in particular, draws up proposals:
(a) the basic guidelines, the material and systemic conditions of economic and social development and the state policy of structural change;
(b) the concept of scientific development and scientific and technological policy;
(c) the concept of economic defence and state security;
(d) long-term concepts for the involvement of the Czechoslovak economy in the world economy;
(e) the main objectives of living conditions and living standards of the population.
§ 21
The Federal Ministry of Strategic Planning evaluates the implementation of the economic and social development strategy of the Czech and Slovak Federal Republic as well as the measures taken to implement it and its effectiveness. "
5. § 22 is deleted.
6. Sections 23 and 24, including the title, read:
"Federal Environment Committee
§ 23
The Federal Committee on the Environment is the central body of the state administration of the Czech and Slovak Federal Republic for the Environment.
§ 24
(1) The Federal Committee on the Environment, in close cooperation with the Central Authorities of the Republics on the Environment and other Federal Central Authorities of the State Administration and Central Authorities of the Republic, is working on a proposal for a state environmental policy and its methods of implementation. After discussion in the governments of the Republic, the proposal for this policy is submitted to the Government of the Czech and Slovak Federal Republic.
(2) The Federal Committee on the Environment, in close cooperation with the Central Authorities of the Republics on the Environment and other Central Authorities of the Federation and the Republics, the manner in which national environmental policy is implemented, in particular:
(a) propose national environmental policy implementation programmes, including selected environmental protection structures, mainly financed by the Federation budget;
(b) coordinate the national environmental information system following international agreements;
(c) encourage and support solutions to selected scientific and technical environmental problems;
(d) propose economic instruments for implementing state environmental policy.
(3) The Federal Committee on the Environment coordinates the performance of tasks in the area of spatial planning and construction rules in matters affecting both Republics or affecting the interests of neighbouring States.
(4) The Federal Committee on the Environment carries out international cooperation within the competence of the Federation and coordinates international cooperation within the competence of the Republics.
(5) The Federal Committee on the Environment is subject to state control over nuclear safety. "
7. Sections 25 to 29 are deleted.
8. In the end, the words "unless otherwise provided for by a special law 'shall be added.
9. In Article 45 (2), the words "and methodically manage and control the cryptographic service 'shall be added at the end.
10. § 48 is released.
11. the words "and prices" shall be added to the end of Paragraph 49.

"Federal Ministry of Economy
§ 72
The Federal Ministry of Economic Affairs is the central body of the state administration of the Czech and Slovak Federal Republic for the implementation of the economic and social development strategy and the implementation of the state economic policy, in particular structural policy.
§ 73
Federal Ministry of Economy
(a) coordinate, in close cooperation with the competent authorities of the Republics, the preparation of the State Structural Policy, in particular the Industrial, Energy, Agricultural, Nutrition and Raw Materials Policy, its proposals and submit them to the Government of the Czech and Slovak Federal Republic;
(b) develop the concept of a state investment policy, including its implementation and provision of state expertise for investment actions for which financial resources from the Federation budget are to be used;
(c) formulate state business plans and priorities, declare bankruptcy proceedings for state contracts and generally promote business activities;
(d) propose and coordinate programmes and projects to implement national scientific and technological policies, including ways of financing them, the purchase of licences and the security of a system of scientific, technical and economic information;
(e) apply direct regulation instruments to individual entities within the limits laid down by law when implementing a stabilisation policy;
(f) submit proposals to the Government for the use of foreign direct assistance funds and coordinate and evaluate proposals for the location of foreign investments.
§ 74
(1) The Federal Ministry of Economic Affairs is developing a concept of the creation and use of State tangible reserves.
(2) The Federal Ministry of Economic Affairs proposes the measures necessary to safeguard the defence and security of the State in the development and implementation of economic policy.
§ 75
The Federal Ministry of Economy
(a) it provides international cooperation in the field of energy of the Czech and Slovak Federal Republics and lays down the principles for the development of electricity transmission facilities;
(b) establish the principles of the development of the gas transit system in accordance with the international obligations of the Czech and Slovak Federal Republic;
(c) organise and manage a civil service for precious metals;
(d) to the extent provided for by the law, carry out official administration in respect of the production, import and entry into circulation of plant protection products, the protection of plant variety rights and the breeding of animals;
(e) ensure uniform implementation of the state testing and standardisation as well as solutions to international standardisation tasks.
§ 76
The Federal Ministry of Economic Affairs hereby authorises the design and financing of geological works in the area of the extraction and processing of radioactive raw materials under special regulations, reviews and approves the calculations of their stocks and issues, under this Act, generally binding legislation on their classification, depreciation and registration.
§ 77
Federal Ministry of Economy pursuant to this Act issues generally binding legislation on the section
(a) scientific and technological development, research and development bases;
(b) project preparation of buildings, state expertise and evaluation of buildings;
(c) investment, project, engineering and characterisation activities. ';
13. § 78 to 80, including the title:
"Federal Competition Authority
§ 78
The Federal Competition Authority is the central body of the state administration of the Czech and Slovak Federal Republic for the promotion and protection of competition.
§ 79
The Federal Competition Authority shall supervise compliance with the competition rules laid down by the special law.
§ 80
(1) Federal Competition Authority
(a) monitor the development of competition on the market and carry out competitive analyses of the market;
(b) monitor the economic activity of business operators in order to avoid abuse of their monopoly or dominant position;
(c) identify cases of distortion of competition and, to the extent provided for by the special law, decide on the remedy and the penalty.
(2) The Federal Competition Authority to the extent provided for by a special law
(a) approve contracts for the merger of business operators or their economic activities or for cooperation concerning competition;
(b) adopt anti-monopoly measures. ';
14. Sections 81 to 84 shall be deleted, including the title.

"Federal Ministry of Control
§ 95
The Federal Ministry of Control is the central body of the Government Administration of the Czech and Slovak Federal Republic for Control.
§ 96
(1) The Federal Ministry of Control controls the federal central government bodies, bodies subordinate to them, organisations established or constituted by them and organisations established by federal law.
(2) The Federal Ministry of Inspections controls the controls as directed by the Government
(a) how the obligations arising from the laws, other generally binding legislation and measures based on them, are fulfilled;
(b) examine the level of handling of complaints, initiatives and petitions of citizens and the relevant citizens.
(3) In carrying out control activities, the Federal Ministry of Control examines the legality, effectiveness and economy.
§ 97
The Federal Ministry of Control shall, in the field of defence and security matters entrusted to the Federation, monitor compliance with the obligations arising from the laws, other generally binding legislation and measures issued on their basis.
§ 98
The Federal Ministry of Control shall, in cooperation with the relevant federal central administration, check that the quality of the products, works and services of state-owned enterprises is in conformity with generally binding legislation and measures issued on their basis and technical standards, in particular in terms of environmental protection, consumer protection and protection of the reputation of domestic production abroad.
§ 99
The Federal Ministry of Control shall, in cooperation with the competent authorities of the Republics, check the authorities and organisations managed by the authorities of the Republics in the cases referred to in Section 97 how the measures of the federal authorities are implemented. ';
16. The following Sections 99a to 99d are inserted after Section 99:
„§ 99a
Article 96 provides for the Federal Ministry of Control to carry out similar checks on organisations entrusted with the Federal Assembly Act by carrying out tasks in the field of government.
§ 99b
The control of the Federal Ministry of Control shall not apply to the activities of political parties, political movements, civil associations, trade unions and bodies, cooperatives and other cooperative organisations, as well as to other non-state organisations, with the exception of the control of the management of funds provided to them by the Federation State Budget or federal special-purpose funds, as the case may be.
§ 99c
Federal Ministry of Control
(a) directs the activities of the authorities in the control section within the Federation;
(b) coordinate its activities with the other central government authorities exercising control and the competent authorities of the Republics for control;
(c) draws the attention of other national authorities to infringements of laws, other generally binding laws and measures issued on their basis.
§ 99d
Federal Ministry of Control as required by the Bureau of the Federal Assembly
(a) report on the findings of its control activities;
(b) carry out an inspection to carry out the tasks of the Federal Assembly and its bodies, in particular in the context of the discussion of the State Budget and the Federal State Final Account and the investigation of complaints, proposals and petitions submitted to the Federal Assembly;
(c) provide supporting documents for the control activities of the Federal Assembly, its bodies and its Members and provide comments on those supporting documents. ";
17. Paragraph 100, including the title, is deleted.
18. Article 101 to 107 shall be renumbered as Article 60a to 60g and the words "Federal Price Office" shall be replaced by the words "Federal Ministry of Finance."
19. In § 124, the words "§ 29 'and the clutch" a' are deleted and the words "77 'are added after the heading" 75'.
Čl. II
(1) Property rights, rights and obligations arising from employment and other relationships are transferred
(a) from the State Planning Commission to the Federal Ministry of Strategic Planning;
(b) from the State Commission for Scientific, Technical and Investment Development to the Federal Committee on the Environment;
(c) the Federal Ministry of Metal, Engineering and Electrical Engineering, the Federal Ministry of Agriculture and Nutrition and the Federal Ministry of Fuel and Energy to the Federal Ministry of Economic Affairs;
(d) from the Committee of People's Control of the Czech and Slovak Federal Republic to the Federal Ministry of Control;
(e) from the Federal Price Office to the Federal Treasury.
(2) Legal entities established or established by existing federal central government bodies, or to which a similar relationship is provided for in a generally binding law, have the same status as federal central government bodies which have been entrusted by that law.
Čl. III
The scope of the Federal Ministry of Interior, as provided for in Sections 41, 42 and 43 of Act No. 194 / 1988 Coll., on the competence of federal central government bodies, does not apply to the services of the National Security Corps managed by the Ministry of Interior of the Czech Republic and the Ministry of Interior of the Slovak Republic.
Čl. IV
(1) If generally binding legislation entrusts the competence of the State Planning Commission, the Federal Ministry of Strategic Planning or the Federal Ministry of Economic Affairs shall exercise that competence according to the nature of the case.
(2) Where generally binding legislation entrusts the competence of the State Commission for Scientific, Technical and Investment Development, the Federal Committee on the Environment or the Federal Ministry for Strategic Planning or the Federal Ministry for Strategic Planning, as the case may be, shall exercise that competence in the fields covered by the generally binding legislation.
(3) Where generally binding legislation entrusts the Federal Price Office with its competence, the Federal Ministry of Finance shall exercise that competence.
(4) If generally binding legislation entrusts the Federal Ministry of Fuel and Energy, the Federal Ministry of Metal, Engineering and Electrical Engineering and the Federal Ministry of Agriculture and Nutrition, the Federal Ministry of Economic Affairs shall exercise that competence within the scope of the Federation.
Čl. V
The Federal Ministry of Control and the rights and obligations of the staff of its apparatus shall apply mutatis mutandis to the provisions of Act No. 103 / 1971 Coll., on People's Control until the Law on Control is issued.
Čl. VI
This Act shall take effect on the day of its publication.
