DECLARATION
of 3 October 2024
amending Decree No 61 / 2011 Coll., on the sampling requirements, procedures and methods for testing seed and seed, as amended
The Ministry of Agriculture provides, pursuant to § 3a (11), § 4 (15) (a), (b) and (e), § 5 (8) (f), § 6 (8) (c) and (d), § 19 (17) (l) and § 22 (11) (b) of Act No. 219 / 2003 Coll., Act No. 96 / 2009 Coll., Act No. 241 / 2009 Coll., Act No. 300 / 2009 Coll., Act No. 331 / 2010 Coll., Act No. 178 / 2006 Coll., Act No. 54 / 2012 Coll., Act No. 279 / 2013 Coll., Act No. 243 / 2016 Coll., Act No. 183 / 2017 Coll.
Decree No. 61 / 2011 Coll., on the requirements for the sampling, procedures and methods of testing of seed and seed, as amended by Decree No. 410 / 2013 Coll., Decree No. 3 / 2018 Coll., Decree No. 156 / 2021 Coll. and Decree No. 505 / 2021 Coll., are amended as follows:
1. Paragraph 2, including the title, reads:
Procedure for checking the accompanying documents of the lot of propagating material
[Articles 4 (15) (b) and (e) and 19 (17) (l) of the Law]
(1) Before sampling, the supplier shall submit the following documents to the samples:
(a) an application for recognition of propagating material;
(b) proof of recognition of the crop;
(c) the records referred to in Article 7 (1) of the Act,
(d) the registration of accepted, issued and shredded labels by category and generation of propagating material maintained in accordance with Article 19 (5) of the Act, containing at least the information referred to in paragraph 2, and the record of the destruction of the labels which have been destroyed, on forms the models of which are published on the Institute's website; the registration of accepted, issued and shredded labels may be submitted in electronic form,
(e) the completed information on the sample list, in accordance with the model of the print of the sample list set out in Annex 2 to this Regulation; and
(f) in the case of seed potatoes, the completed label of the sample for determining the health status of seed potatoes, which shall contain the particulars referred to in paragraph 5.
(2) The records of accepted, issued and shredded labels referred to in paragraph 1 (d) shall contain at least the following particulars:
(a) the date of receipt of the labels or the date of printing of the labels, in the case of shredding of the labels, the date of shredding;
(b) species and variety,
(c) categories and generations;
(d) the lot number,
(e) the number and range of serial numbers accepted, issued and shredded labels;
(f) the body for which the labels are intended; and
(g) the stamp and signature of the sampled producer which carried out the check of the data in the register.
(3) An establishment where seed sampling is carried out for the purposes of certification must be equipped with a book with a fixed link with records of all sampled lots. The sampled samples shall be accompanied by a signature and stamp of the records in this book. The list of records of sampled lots may be replaced by the seed production register and shall contain at least the following information:
(a) the date of sampling;
(b) the lot number,
(c) identification of the propagator;
(d) species and variety,
(e) categories and generations;
(f) lot size; and
(g) the range of serial numbers of the labels.
(4) The labels of unrecognised seed are removed from the packaging when dispatched from storage. The disposal of labels shall be carried out at the place where the labels are removed from the packaging. The disposal of the labels shall be carried out solely by the sampled or overlooked person who is an employee of the Institute and shall certify it on the record of the destruction of the labels.
(5) The label of the sample for determining the health status of seed potatoes contains at least the variety name, category and generation, the area of the propagation crop, the number of the propagation crop, the supplier's stamp, the identification of the propagator, the indication of the region and the district in which the propagation crop is located. The date of sampling and the signature and stamp of the sampled sample maker shall be supplemented after the sampling itself. '
2. In Article 3, at the end of paragraph 3, the sentence "The maximum weight of a lot of grass seed may be increased to 25 000 kg if the supplier has received authorisation from the Institute."
3. In Article 4, at the end of paragraph 5, the sentence "In the case of hybrid vegetable seed, the size of the sample may be adjusted to the growing test in agreement with the plant test station for the vegetable growing test."
4. In Article 6, the following sentence is inserted at the beginning of paragraph 2: "Each or part of a stored seed lot shall be permanently marked with a fixed batch label. All packages of seed lot must be intact. '
5. In the text under the group title above Section 11, the text "h) 'is replaced by" f)' and the number "10 'is replaced by" 11'.
6. In Article 11 (3) (d), "sugar beet and fodder beet 'is replaced by" sugar beet and fodder beet';
7. In Article 11 (4), the last sentence is deleted.
8. In Annex No 1, Part 2, point 2.1, point 2.1.5. of Part 2.1.5.1, paragraph 2, the words "within seed of one lot 'shall be added at the end of the text in point (a).
9. In Annex No 1, Part 2, point 2.1, subpoint 2.1.5. of Part 2.1.5.1, paragraph 7, the sentence "The records of sampled lots shall be kept in the book of the automatic sampling device in the order in which each lot passes through the automatic sampling device."
10. In Annex No 1, Part 2, point 2.1 (2.1.5. of Part 2.1.5.3, the following paragraph 4 is added:
"(4) Where an automatic sampling device is used, the date on which the sample maker takes all the required samples from the automatic sampling cabinet and checks the packaging of the relevant seed lots in storage. ';
11. In Annex No 1, Part 4, in paragraph 4, the words "except oil and fibre plants for which a weight of 250 g is prescribed 'are deleted.
12. in Annex 1, Part 5 (3) (a) (5), "± 3%" is replaced by "± 2%."
13. In Annex 1, Part 9, the heading "9.4 Tables to 9.2.4 'is inserted after point 9.3.
14. In Annex No 1, Part 9, point 9.4, Table 11, Part 1:

For an average number of seeds of another plant species (JRD) greater than 138, the tolerated range shall be calculated using the following formula and rounded upwards to the next integer:

For N = 10 - 19: R = (average number of seeds JRD) x 6,11
For N = 20: R = (average number of seeds JRD) x 6,69. "
15. Annex 2 shall read as follows:

Maximum authorised size of the lot for pelleted and granulated seed, seed bands and mats:
The maximum number of seeds which may contain lots of pelleted or granulated seed, seed bands or mats shall be 1 000 000 000 (10 000 units of 100 000 pieces), the weight of which shall not exceed 40 000 kg with a tolerance of 5% (42 000 kg).
