DECLARATION
of 28 April 2004
implementing the Act on the registration of residents
The Ministry of the Interior provides, pursuant to § 13b (7) and § 25 of Act No. 133 / 2000 Coll., on the registration of residents and birth numbers and on the amendment of certain laws (the Act on the registration of residents), as amended by Act No. 53 / 2004 Coll., hereinafter referred to as "the Act ':
TECHNICAL METHOD FOR THE TRANSFER OF FAMILY NUMBERS TO THE SUPPLY PLACE AND ALLOCATION OF FAMILY NUMBERS TO THE SUPPLY PLACE
Transmission of birth numbers to dispensing points
(1) From the register of birth numbers 1) (hereinafter referred to as the register), for the purposes of the individual assignment of the birth number to a natural person (m2), delivery points 3) (hereinafter referred to as the "delivery point") of the family number assembly (hereinafter referred to as the "assembly") are transmitted. The assembly shall be made up for each calendar day and shall be transmitted to the delivery point for a period of three calendar months so that each issue point receives them for verification and subsequent use no later than 3 working days before the beginning of the first calendar month of the period for which the set is made up. The procedure laid down in the second sentence shall not apply where the assembly or requested birth numbers referred to in paragraph 2 are provided by remote access through an electronic communications network providing feedback to the point of departure.
(2) The register shall also be provided with designated and not yet assigned birth numbers for the purpose of assigning them to a natural person pursuant to Sections 16 (b), (c), (d) and (e) and 17 (2) of the Act (hereinafter referred to as the "required birth numbers') upon request of the delivery point.
(3) The assemblies referred to in paragraph 1 shall be transmitted or the required birth numbers referred to in paragraph 2 shall be provided 4)
(a) remote access through an electronic communications network, providing feedback to the point of departure;
(b) on a technical data medium; or
(c) in the form of printed documentation.
(4) The registry administrator shall determine the specific form of transmission of sets or the provision of requested birth numbers to the relevant place of issue (5) according to the state of the technical conditions of the registry, taking into account the state of the technical conditions of the particular point of delivery.
(5) The reports transmitted, containing the birth numbers for the relevant calendar month, together with the requested birth numbers for that month, shall be sent to the registry administrator after processing in accordance with Article 2, in the form in which they were provided.
Allocation of the birth number by the delivery point
(1) The following information shall be entered in the assembly with the birth number assigned to the natural person at birth for the purposes of drawing up the register:
(a) the name and, where appropriate, the name of the natural person to whom the birth number has been assigned;
(b) the day, month and year of birth;
(c) the place and district of birth and, in the case of a natural person born abroad, the place and state of birth; the name of the place of birth is registered according to its current form at the time of registration, 6)
(d) the date on which the birth number was assigned.
(2) The place of issue shall transmit to the registry administrator, for the purposes of the creation of a register, the following information concerning the natural person to whom the birth number has been assigned pursuant to Sections 16 (b), (c), (d) and (e) and 17 (2) of the Act:
(a) the name and, where applicable, the name, surname, maiden name of the natural person to whom the birth number has been assigned;
(b) the day, month and year of birth;
(c) the place and district of birth and, in the case of a natural person born abroad, the place and state of birth;
(d) the date on which the birth number was assigned,
(e) in the case of adoption, the name and / or surname (s) of the acquirer (s) (7), the surname and birth number of the acquirer (s);
(f) the birth number initially assigned, if new,
(g) the reason for the assignment of the birth number.
(3) In the case of a natural person to whom a birth number has been assigned pursuant to Article 17 (2) of the Act, the original and new data are given.
Method and conditions for carrying out the control of data in the population information system
(1) The control of data maintained in the population information system (hereinafter referred to as the "information system") is carried out using both the information system software and the local survey at processing sites (8).
(2) The subject of the check shall be:
(a) completeness, accuracy and up-to-date of kept data, 9)
(b) a distinction between processing current, historical or blocked data for verification purposes, 9)
(c) keeping records of data provision, 10)
(d) the provision of data management (4) before any changes, destruction or loss, unauthorised transmission or other unauthorised processing, or any other misuse, unauthorised or accidental access thereto;
(e) evaluation of the effectiveness of the measures adopted (4) for data protection; and
(f) an evaluation of the consistent processing of objections by data subjects. 11)
(3) When carrying out the check, it shall always be carried out in such a way as not to restrict or interrupt the processing of data held in the information system and to ensure in full the conditions for the performance of the responsibility of the controller of the information system. 12)

(1) The model form "Login card" is set out in Annex 1.
(2) The model form "Document of birth number" is set out in Annex 2.
(3) The model form "Request for information system data" is set out in Annex 3.
(4) The model form "Confirmation of change of residence" is set out in Annex 4.
The registration form, the birth certificate, the request for data from the information system and the confirmation of change of residence issued before the date of entry into force of this Decree may be used until 31 December 2005.
EFFECTIVE
This decree shall take effect on the day of its publication.
