THE LAW
of 22 July 2009
amending Act No. 2 / 1969 Coll., on the Establishment of Ministries and other Central Authorities of the Czech Government, as amended, and Act No. 6 / 1993 Coll., on the Czech National Bank, as amended
Parliament has decided on this law of the Czech Republic:
Amendment of the Act on the Establishment of Ministries and other Central Authorities of the Czech Republic
Act No. 1 / 2004, Act No. 1 / 2004, Act No. 2 / 2004, Act No. 2 / 2004, Act No. 5 / 2004, Act No. 5 / 1992 Coll., Act No. 5 / 1992 Coll., Act No. 5 / 1990 Coll., Act No. 5 / 1990 Coll.
1. In Article 4 (1), the words "regulation of the issuance of electronic money 'shall be inserted after the words" financial market'.
2. In Paragraph 4 (1), the word "performance 'shall be inserted after the words" except'.
3. In Article 4 (1), the words "for the introduction of the single currency euro on the territory of the Czech Republic, for payment," shall be inserted after the words "Czech National Bank."
4. In Paragraph 4, the following paragraph 2 is inserted after paragraph 1:
"(2) The Ministry of Finance, together with the Czech National Bank, prepares and presents to the Government proposals for legal adjustments in the field of currency and money circulation, and proposals for legal adjustments regulating the status, scope, organisation and activity of the Czech National Bank, with the exception of financial market supervision, payment and electronic money issuance."
Paragraphs 2 to 4 shall become paragraphs 3 to 5.
5. In Section 12, the words "and operates an information system for the handling of classified information between public authorities' shall be added at the end of the text of paragraph 5.
Amendment of the Act on the Czech National Bank
Act No. 6 / 1993 Coll., on the Czech National Bank, as amended by Act No. 60 / 1993 Coll., Act No. 15 / 1998 Coll., Act No. 442 / 2000 Coll., Act No. 377 / 2005 Coll., Act No. 57 / 2006 Coll., Act No. 62 / 2006 Coll., Act No. 230 / 2006 Coll., Act No. 160 / 2007 Coll., Act No. 36 / 2008 Coll., Act No. 124 / 2008 Coll., and Act No. 254 / 2008 Coll., is amended as follows:
1. In Paragraph 28 (b), the words "which may, however, be purchased for a maximum period of one year 'are deleted.
Paragraph 37 reads as follows:
(1) The Czech National Bank, together with the Ministry of Finance, is preparing and submitting to the Government proposals for legal adjustments in the field of currency and money circulation and proposals for legal adjustments regulating the status, scope, organisation and activity of the Czech National Bank, with the exception of financial market supervision, payment and electronic money issuance.
(2) The Czech National Bank is working with the Ministry of Finance to prepare proposals for legal adjustments in the field of financial market, payment, regulation of electronic money issuance, foreign exchange management and introduction of the single currency euro in the Czech Republic. "
EFFECTIVE
This Act shall take effect on the 15th day following its publication.
