Decree of the Ministry of Regional Development on the implementation and content of proficiency tests for the performance of guided tourism activities

DECLARATION
Ministry of Local Development
of 31 July 2001
on the implementation and content of proficiency tests for the pursuit of guided tourism activities
The Ministry of Local Development, in agreement with the Ministry of Industry and Trade and the Ministry of Education, Youth and Sports, provides, pursuant to Article 73a (3) of Act No. 455 / 1991 Coll., on Business Business (Trade Act), as amended by Act No. 356 / 1999 Coll.:
§ 1
(1) The proficiency test for the performance of guided activities in the field of tourism (1) (hereinafter referred to as "the test") takes place in secondary vocational schools and higher vocational schools2) aimed at preparing for tourism and at higher schools3) carrying out study programmes in the field of tourism (hereinafter referred to as "educational establishments." The list of educational establishments shall be published in the Commercial Journal for the relevant school and academic year by the Ministry of Local Development (hereinafter referred to as "the Ministry ') after consultation with the Ministry of Education, Youth and Sports, together with an indication of the languages in which the language part of the examination can be completed.
(2) The examination shall be carried out before a panel appointed by the Rector, by the person acting as Rector or by the Director of the Training Facility. The chair of the commission shall be a pedagogical or academic staff of an educational establishment, a vice-chairman of an employee of the competent trade office (4) proposed by that office. The members of the Commission shall be:
(a) educational or academic staff of an educational establishment with an appropriate professional focus;
(b) a member of the business community of tour guides if the business community is active in the region of the test venue;
(c) a representative of the municipal office at the educational establishment.
§ 2
(1) Commission
(a) draw up oral questions and topics for the written examination in accordance with the requirements laid down in Section 4;
(b) decide on the exclusion of a tenderer who, during the examination, uses illicit aids or devices, or, where appropriate, significantly disrupts the course of the test,
(c) decide on all matters relating to the examination;
(d) grant an exemption pursuant to Article 4 (2).
(2) President of the Commission
(a) at least 15 days before its commencement, inform the Ministry of the location and time of the examination; The Ministry may entrust its staff to attend the examination,
(b) verify the identity of the tenderer;
(c) prior to the start of the examination, identify the tenderer with his rights and obligations and with the time course of the examination;
(d) manage the proceedings of the Commission;
(e) ensure a protocol record (hereinafter referred to as "protocol") of the course and result of the test;
(f) sign the certificate referred to in Article 7 (2).
(3) The Commission shall act in a number of at least four members and shall act by a majority of its members. In the event of a tie, the vote of the President of the Commission shall be decisive.
(4) The original protocol shall be archiva5) for an educational establishment and shall contain:
(a) the name and address of the educational establishment;
(b) the composition of the Commission;
(c) details of the tenderer referred to in Article 3 (1);
(d) an alert for an exemption pursuant to Article 4 (2), if granted;
(e) the trade for which the test took place,
(f) entering and evaluating each part of the test;
(g) the overall assessment of the test;
(h) the date of completion of the protocol, its reference number, the signatures of the members of the commission and the stamp of the educational establishment.
§ 3
(1) In the application for a test sent to the educational establishment, the applicant shall indicate:
(a) name, surname, date of birth, place of permanent residence, foreign residence outside the Czech Republic and place of residence in the Czech Republic,
(b) the trade for which the test is required to operate;
(c) a declaration that it is subject to the conditions of the examination laid down in this Decree and the educational establishment;
(d) which foreign language has chosen for the language part of the examination or whether it fulfils the conditions for the procedure laid down in Article 6 (2), if so, shall include certified copies of the relevant documents,
(e) asking for an exemption within the meaning of Article 4 (2), together with an indication of the reason and language in which it intends to pass the test;
(f) date and handwritten signature.
(2) If the application does not contain all the particulars provided for in paragraph 1, the training establishment shall invite the applicant to complete the application, and if the training establishment does not receive the completed application, the candidate shall not be invited to the test.
(3) The educational establishment shall determine at least two dates for the examination in each half-year, period or semester. The invitation to be tested shall be delivered by the educational establishment to the tenderer no later than one month before the date of the examination. In addition to the invitation, the applicant shall receive a range of test questions identifying the aids or means of testing the holidays, the notification of the amount of payment for the test and the method of payment.
(4) Candidates who could not attend the test for serious reasons and have duly apologized for their non-participation shall set a replacement test date for the training establishment.
§ 4
(1) The examination shall consist of part of the professional and linguistic part and may be carried out within two days. If the candidate fails one part of the examination, the test shall be completed and the candidate shall be assessed as not benefiting from the qualification step.
(2) The test shall be conducted in the Czech language. The Commission grants an exception on request to a stranger if the candidate demonstrates the basic knowledge of the Czech language. In the case of a derogation, the professional and linguistic part of the examination shall be in the applicant's native language or other language, as appropriate. The basic knowledge of the Czech language is demonstrated by an interview which will take place on the day of the examination before the beginning of the examination. The applicant must demonstrate the ability to respond to questions relating to the normal situations of daily life and to communicate the content of the text from the daily press.
(3) The total test result is assessed by the classification grade "benefit" or "benefit". A candidate who has demonstrated knowledge and skills to the extent provided for in this Decree shall be assessed by the classification "benefit '. A candidate assessed by the classification grade" failed' may submit a new application pursuant to Paragraph 3 (1).
§ 5
(1) The professional part of the test is oral and lasts no more than 60 minutes. It shall verify the level of knowledge and competence necessary for the pursuit of guided tourism activities. For the successful composition of this part of the examination, the applicant shall demonstrate:
(a) knowledge
1. the basic characteristics of the Czech Republic in terms of victorial, political, historical and cultural, sustainable development of tourism and the foundations of general, physical and economic geography,
2. important destinations of tourism, especially in the Czech Republic and Europe,
3. basic data on historical settlements and real estate cultural monuments in the Czech Republic, including accessibility for persons with reduced mobility,
4. the essence of individual artistic styles and artistic and historical terminology and the world's most important monuments,
5. legislation related to the provision of individual tourism services (e.g. business, consumer protection, basic customs, passport and visa services, and related to the insurance of tourism participants),
6. tourism services, including the specificities of their provision, in particular catering, accommodation, guided tourism,
7. organisation and management of tourism in the Czech Republic, international tourism organisations, specificities of the tourism market, basic professional terminology of tourism,
8. the specificities and advantages of the different types of transport services, including knowledge of basic international regulations;
9. the psychology of advertising in tourism and the psychology of working with a customer, including the rules of social behaviour and the foundations of social psychology and mental hygiene;
(b) Ability
1. to apply geographical, historical and artistic knowledge to guided activities;
2. bring tourists closer to the sights and attractions of the region, its customs and traditions,
3. prepare the guide's interpretation and provide it in Czech and foreign languages,
4. take over the trip, lead a group of tourists, manage normal and emergency situations during the trip, make quick and correct decisions,
5. self-orient in the field with the help of map, plan, literature,
6. bill and evaluate the trip from the point of view of the guide,
7. Report the insurance event,
8. To respond promptly to questions and comments from an accompanying group of persons or individuals,
9. Discuss, master the foundations of rhetoric and communication skills.
(2) The knowledge and competence referred to in paragraph 1 shall be demonstrated by the tenderer:
(a) the individual processing of the itinerary of the specified route identifying the identified sites, including the resolution of the simulated problem situation on that route;
(b) familiarisation of the Commission with a processed itinerary and resolution of the problem situation;
(c) by answering supplementary questions on the theory of free-interest issues from the areas referred to in paragraph 1 (a),
(d) by answering questions on the basis of draw from a separate block of questions drawn up pursuant to paragraph 1 (b).
§ 6
(1) The language of the test shall take the form of both oral and written, and shall verify the level of knowledge of the chosen foreign language or languages shown by the tenderer.
(a) by written processing of a subject identified by the Commission without the possibility of using a dictionary, using the technical terms used in the field of tourism;
b) free translation of a two-minute speech in a foreign language into a Czech language,
(c) a 15-minute controlled conversation in a chosen foreign language aimed at addressing a particular situation associated with the performance of a guide.
(2) The language of the test shall not be required if the tenderer proves that he has composed one of the national language examinations (6) from the relevant language (s) or, in the case of a derogation provided for in Section 4 (2), if the tenderer is in his / her native language which he / she has chosen under § 3 (1) (d) and for the language part of the test.
§ 7
(1) The Commission shall report the result of the examination to the tenderer on the day of the examination. The applicant, who has been assessed by the classification grade "benefited ', shall issue an educational establishment within 14 days of the examination of the certificate, which is evidence of professional competence to conduct a guided tourism activity. A copy of the certificate shall be sent to the Ministry within 15 days of the date of the examination.
(2) The certificate shall contain:
(a) the name and address of the educational establishment;
(b) details of the tenderer referred to in Article 3 (1) (a);
(c) the date of completion of the test;
(d) the date of issue of the certificate;
(e) the name of the trade for which the certificate is issued, including the indication of the foreign languages in which the tourist guide is entitled to carry out the business;
(f) the exemption notice provided for in Article 4 (2), if granted,
(g) the stamp of the educational establishment and the signature of the Chairman of the Examination Board.
§ 8
(1) The holder of a certificate wishing to extend his activity to the exercise of his or her business in a foreign language other than that indicated in the certificate may do so only on the basis of proof of performance of the national language examination or proof of performance of the language part of the examination provided for in this Order.
(2) The proof of completion of the language part of the examination must include the particulars referred to in Article 7 (2) (a) to (d) and (g) and the indication of the foreign language in which the certificate holder carried out the language part of the examination.
(3) The authorisation to conduct a guided tourism activity in the next language shall be demonstrated by the certificate referred to in Article 7 (1) together with one of the documents referred to in paragraph 1.
§ 9
This Decree shall take effect on 1 October 2001.
