GOVERNMENT REGULATION
of 26 July 2000
amending Government Regulation No. 1 / 2000 Coll., on the timetable for public rail freight transport
The Government hereby orders, pursuant to § 879a, to implement § 772 of Act No. 40 / 1964 Coll., Civil Code, pursuant to § 771 to implement § 629 of Act No. 513 / 1991 Coll., Commercial Code, and pursuant to § 66 (1) to implement § 37 (7) of Act No. 266 / 1994 Coll., on Railways, as amended by Act No. 23 / 2000 Coll.:
Government Decree No. 1 / 2000 Coll., on the Transport Regulations for Public Rail Freight, is amended as follows:
1. In the introductory sentence, the words "pursuant to § 879a to implement § 772 of Act No. 40 / 1964 Coll., Civil Code, and pursuant to § 771 to implement § 629 of Act No. 513 / 1991 Coll., Commercial Code 'are replaced by the words" to implement § 772 of Act No. 40 / 1964 Coll., Civil Code, as amended by Act No. 509 / 1991 Coll., and pursuant to § 771 (1) of Act No. 513 / 1991 Coll., Commercial Code, and § 37 (7) of Act No. 266 / 1994 Coll., on Railways, as amended by Act No. 266 / 1994 Coll.'.
2. in the last sentence of Article 5 (2), the words "referred to in points (a) to (h) 'are replaced by the words" referred to in points (a) to (h) and (j) and (k)';
3. in Article 25 (1) (a), in the part of the sentence before the first semicolon, the words "and its weight" shall be deleted and in the following part of the sentence the words "and its weight, only" shall be replaced by the words "only."
4. In Article 27, the following text shall be added at the end of paragraph 4: ', to the full extent, if the whole consignment has been lost or completely destroyed, otherwise at a pro rata rate corresponding to the partial loss or damage of the consignment. They shall not be refunded if they were part of the price of the consignment being transported.';
This Regulation shall enter into force on the day of its publication.
