DECLARATION
of 2 June 2006
on a derogation procedure for the killing of herring
The Ministry of the Environment provides pursuant to § 5b (4) of Act No. 114 / 1992 Coll., on Nature and Landscape Conservation, as amended by Act No. 218 / 2004 Coll., hereinafter referred to as "the Act ':
Subject matter
This decree provides for a derogation for killing (1) of starling (Sturnus vulgaris) (hereinafter referred to as "starling ') in order to prevent serious damage to the vine crop in vineyards. The purpose of killing under this decree is not to reduce the number of starfish (2), but to increase the effectiveness of shooting as a method of scaring the starfish.
Means, method and methods of derogation
The derogation shall consist of the possibility of deliberately killing the sprat, only with a shotgun-hunting weapon, or combined, using up to and including 2,5 mm in size, using up to and including two bulk rounds. The shooting may only be carried out to the edge of a flock with an estimate of at least 1000 starches in the sight of the deviant. The derogation may be applied repeatedly if the flock returns to the supervision of the shooter.
Time and local circumstances
(1) The derogation procedure may apply from 15 August to 31 October of the calendar year, only in the defined daily period starting after sunrise and ending one hour before sunset.
(2) The derogation may be applied to the type of parcel (3) (hereinafter referred to as "vineyards") and to the zone 50 metres around the vineyard in the territory of the wine-growing region of Morava4, with the exception of land situated in the territory of the National Park of Podyji.
Additional conditions for the application of the derogation procedure
(1) The derogation procedure may be applied where at least one flock of herring in the administrative district of the local competent authority of nature protection occurs during the period referred to in Article 3 (1), with an estimated estimated of at least 1000 individuals, and where this has been declared locally by the competent authority of nature protection.
(2) The derogation may be applied by natural persons who are authorised to fish for game under the conditions laid down by special legislation5 and who are to be notified in advance in person or through a user of the hunt to the competent authority of nature (hereinafter referred to as "hunter").
(3) The derogation may not be applied where the flock is already frightened by fire and leaves the vineyard.
(4) A condition for the application of the derogation procedure is to follow up the detection of the killed starches, the removal of ornithological rings, provided that the killed individuals are identified by them and their surrender to the local authority of nature, with information on the date and location of the shooting.
Efficacy
This Decree shall take effect on 1 July 2006.
