of 21 December 1948
on customs discounts for the import of machinery and apparatus.
The National Assembly of the Czechoslovak Republic decided on the following Act:
(1) For machinery and apparatus of tariff class XL. [excluding machinery of tariff heading 531, 532, 533, 534a) and notes on tariff heading 538], for machinery and apparatus of tariff heading 539 (excluding engines and dynamos falling within the heading of tariff heading 539), for electrical apparatus and electrical equipment of tariff heading 543, for mobile motor machines of construction and agricultural ex-tariff. Pol. 553c), for tractors and motor ploughs of the tariff.
(2) The relief of import duties provided for in Article 2 may also be permitted for important and indispensable spare parts for such machinery and apparatus imported from a foreign country which is not produced at all in the domestic territory, if they are fit for the effectiveness of this Act and if their actual affiliation with those machinery and apparatus is demonstrated.
Where a duty reduction is granted pursuant to Section 1, the duty shall be levied:
(a) in the case of the rates of pol. pol. 530a), 530b), 530c) 1-2 and 534b) reduced duty 85- Kčs per 100 kg net weight,
(b) in the case of rates of Nos 526, 527, 528, 529, in the case of the notes on the rate of Mr 530c) and in the case of rates of Nos 535, 536, 537, 538, 539 and 543, reduced customs duty of 170.- Kčs per 100 kg net weight,
(c) for rates of pol. 553c) and 553d) reduced duty 500.- Kčs per 100 kg net weight,
(d) in the case of pol. pol. 575b) 2 reduced duty 150.- Cds per kg net weight, weighing 100 kg or more, and reduced duty 200.- Cds per kg net weight, weighing less than 100 kg but not less than 10 kg.
The Ministry of Finance may set up an Advisory Council for the examination of applications for a duty reduction under § § 1 and § 2 and require its good appearance before deciding on individual applications.
This Law shall take effect on 1 January 1949; it shall be implemented by the Finance Minister in agreement with the participating members of the Government.
