GOVERNMENT REGULATION
of 3 December 2018
amending Government Regulation No 48 / 2017 Coll., laying down requirements under the acts and standards of good agricultural and environmental condition for the areas of cross-compliance rules and the consequences of non-compliance for the granting of certain agricultural aid, as amended by Government Regulation No 126 / 2018 Coll.
The Government mandates pursuant to § 2b (2) and § 2c (5) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll., Act No. 85 / 2004 Coll., Act No. 441 / 2005 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll., and pursuant to § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 441 / 2005 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll.:
Government Regulation No 48 / 2017 Coll., on the establishment of requirements according to the acts and standards of good agricultural and environmental condition for the areas of cross compliance rules and the consequences of non-compliance for the granting of certain agricultural aid, as amended by Government Regulation No 126 / 2018 Coll., is amended as follows:
1. In Annex No 1, after the serial number of Act 10, the serial number of Requirement 7, the serial number of Act 10 shall be added to the serial number of Requirement 8:

2. In Annex No 2, point 7, at the end of point (b), the word "a 'is deleted.
3. In Annex No 2, at the end of point 7, the dot is replaced by "a 'and the following point (d) is added:
"(d) in the growing season referred to in Article 9 of Government Decree No 50 / 2015 Coll., laying down certain conditions for the granting of direct payments to farmers and amending certain related government regulations, as amended, on the part of the soil block used by it with a type of agricultural culture, does not grow standard arable land containing a continuous area of eroded land greater than 2 ha or the area of which is more than 50% covered by eroded land, more than 30 ha of continuous area of one crop; the area planted or planted with this crop is considered to be a continuous area of one crop within the soil block part, which are not visibly separated from each other by the forage protection zone or the protection zone referred to in Article 14 (4) of Decree-Law No 50 / 2015 Coll. a minimum width of 22 m or a surface area of another crop with a minimum width of 110 m; the applicant does not have to comply with this condition for the part of the soil block with crops pursuant to § 18 of Decree No. 50 / 2015 Coll. and for the part of the soil block for which the application for the grant of the sub-measure pursuant to § 21 and 22 of the Government Decree No. 75 / 2015 Coll. '.
4. In Annex 3 to Act No 4, order number 13, in the range row Large in the column Evaluation and in the row Severity Great in the column Evaluation, the sentence "The withdrawal period has not been respected in livestock or residues of veterinary medicinal products of categories B1 and B2 have been detected in animal products under Council Directive 96 / 23 / EC in excess of the limit value. 'is replaced by the sentence" After the administration of veterinary medicinal products of categories B1 and B2 under Council Directive 96 / 23 / EC, the withdrawal period has not been observed in livestock or residues of such products have been detected in excess of the limit value'.
5. In Annex 3, after the serial number of Act 10, the serial number of Requirement 7, the serial number of Act 10 shall be added to the serial number of Requirement 8:

Transitional provisions
1. Legal relationships arising before the date of entry into force of this Regulation shall be assessed in accordance with Government Regulation No 48 / 2017 Coll., as effective before the date of entry into force of this Regulation.
2. The applicant may not comply with the conditions set out in Annex 2 (5) (c) and (d) to Government Regulation No 48 / 2017 Coll., as effective from 1 January 2019, on the part of the soil block with the continuous area of the crop established before 1 January 2019.
Efficacy
This Regulation shall be binding in its entirety and directly applicable in all Member States.
