THE LAW
of 16 June 2005
amending Act No. 96 / 1993 Coll., on Construction Savings and State Support of Construction Savings and Adding the Act of the Czech National Council No. 586 / 1992 Coll., on Income Tax, as amended by the Act of the Czech National Council No. 35 / 1993 Coll., as amended
Parliament has decided on this law of the Czech Republic:
Act No. 96 / 1993 Coll., on Construction Savings and State Support of Construction Savings and on Addition of the Czech National Council Act No. 586 / 1992 Coll., on Income Tax, as amended by the Czech National Council Act No. 35 / 1993 Coll., as amended by Act No. 83 / 1995 Coll. and Act No. 423 / 2003 Coll., is amended as follows:
1. In Article 5, the following paragraph 11 is added:
"(11) The contract shall contain until the end of the savings period, for a maximum period of six years from the date of its conclusion, the amount of the remuneration or the method of determining the amount of the remuneration for the management of the building savings account set up and conducted to receive the contribution of the participant, and the services strictly related to the management of that account, the method of determining the amount of the remuneration shall not depend solely on the will of the building savings bank. The necessary related account management services as referred to in the first sentence are those services the provision of which imposes generally binding legislation on the building economy or those services the provision of which cannot be refused by a participant who properly fulfils its obligations under the contract, without adversely affecting the provision of such services, resulting in a loss of entitlement to State aid. '
2. In Article 11 (2), the following sentence is added: "Interest on the State aid advance shall be due to the participant from the day following the date on which the building savings bank receives the advance from the Ministry."
Transitional provision
The measures provided for in Article 11 (2) shall apply to all participants in the building savings, irrespective of the date of conclusion of the contract.
Efficacy
This Act shall take effect on the first day of the third month following its publication.
