Government Decree
of 10 November 1949
on the provisional application of certain international conventions relating to the General Agreement on Tariffs and Trade
Under Article 1 of the Act of 22 February 1949, No 66 Coll., on the provisional implementation of international economic agreements of a general nature, I declare:
According to the Resolution of the Government of the Czechoslovak Republic of 18 October 1949 and with the agreement of the President of the Republic, the following international conventions shall be implemented before the National Assembly has given its consent:
(a) the Protocol of 10 October 1949 on the conditions for access to the General Agreement on Tariffs and Trade with effect from 1 January 1950, whereby the Minister for Finance, in an agreement with Foreign Affairs and Foreign Trade Ministers, provides and declares in the Collection of Laws which of the customs concessions contained in Annex A, Schedule X (Czechoslovakia) to this Protocol and which take effect on the date;
(b) Protocol of 13 August 1949 amending Article XXVI of the General Agreement on Tariffs and Trade, with effect from the date of signature;
(c) Protocol of 13 August 1949 replacing, with effect from the date of signature, Act I (Australia) of the General Agreement on Tariffs and Trade,
(d) Protocol of 13 August 1949 replacing Act VI (Ceylon) of the General Agreement on Tariffs and Trade with effect from the date of signature;
(e) Third Protocol of 13 August 1949 on corrections to the General Agreement on Tariffs and Trade with effect from the date of signature,
(f) First Protocol of 13 August 1949 on amendments to the General Agreement on Tariffs and Trade with effect from the date of signature.
The Annex to the Reports of Acts *) shall be published in the English and French original version as well as in the translation of the framework part of all the above conventions and in the original version of the English version as well as in the translation of the Annex to the Protocol referred to in point (a) of the X-Czechoslovakia Charter; otherwise the original text of all conventions was published by the United Nations, Lake Succes, New York.

THE GOVERNMENTS OF THE REPUBLIC OF AUSTRALIA, THE KINGDOM OF BELGIUM, THE UNITED STATES OF BRAZIL, BURMY, CEYLON, THE REPUBLIC OF CZECH, THE REPUBLIC OF CZECH, THE REPUBLIC OF FRENCH, THE REPUBLIC OF THE REPUBLIC OF LUCEMBOURG, THE REPUBLIC OF CHILE, INDIA, THE JIHOAFRICAN UNION, THE SOUTHERLANDS, THE CANADES, THE REPUBLIC OF CUB, THE REPUBLIC OF LUCEMBOURG, THE KINGDOM OF THE NETHERLANDS, THE NEW ZELANDS, PAKISTAN, THE UNITED KINGDOM OF THE UNITED KINGDOM OF THE UNITED STATES OF AMERICS,
_ CONSIDERING the outcome of the negotiations on access by the acceding governments to the General Agreement,
in agreement with the provisions of Article XXXIII of the General Agreement:
CONSIDERING the terms of this Protocol under which acceding governments may accede to the General Agreement
and the current Contracting Parties shall decide by a two-thirds majority resolution, as agreed in paragraph 11 of this Protocol, on the access of acceding governments to the General Agreement:
1.
(a) Subject to the provisions of this Protocol, each of the acceding governments shall give provisional effect on the date on which this Protocol becomes applicable to it:
(i) Parts I and III of the General Agreement; and
(ii) Part II of the General Agreement fully compatible with its laws in force at the date of this Protocol.
(b) The commitments entered into paragraph 1 of Article I of the General Agreement with reference to Article III thereof, as well as the commitments entered into paragraph 2 (b) of Article II of the General Agreement with reference to Article VI thereof, are deemed to be part of Part II of the General Agreement for the purposes of this paragraph.
(c) For the purposes of the General Agreement, the instruments of Annex B to this Protocol in respect of acceding governments are deemed to be instruments of the General Agreement.
(d) Notwithstanding the provisions of paragraph 1 of Article I of the General Agreement, it does not require the signature of this Protocol acceding to the Government to remove any preferences in import duties or levies, provided that they do not exceed the limits laid down in paragraph 4 of Article I of the General Agreement as amended and which apply exclusively between Uruguay and Paraguay.
2. The date on which this Protocol enters into force for the acceding Government shall become a Contracting Party as provided for in Article XXXII of the General Agreement.
3. Notwithstanding the provisions of paragraph 12, the discounts listed in the instrument relating to each of the current Contracting Parties and contained in Annex A to this Protocol shall not enter into force for that Contracting Party until that Contracting Party has provisionally notified the Secretary-General of the United Nations that it intends to bring the discounts into effect. Thereafter, discounts shall enter into force for that Contracting Party, either on the date on which the Protocol referred to in paragraph 12 first enters into force or on the 30th day following the date on which the notification is made to the Secretary-General, but always later on. This notification shall only be effective if the Secretary-General is moved by 30 April 1950 at the latest. As soon as the discounts have entered into force, the relevant instrument shall be considered to be the instrument of the General Agreement with respect to that Contracting Party.
4. Any Contracting Party which has submitted the notification referred to in paragraph 3 or any acceding Government which has signed this Protocol may at any time suspend or revoke, in whole or in part, any discount provided for in the relevant instrument forming part of Annex A or B to this Protocol, which that Contracting Party or that Government has previously negotiated with the acceding Government not signing this Protocol or the current Contracting Party shall not give effect to that notification, provided that the current Contracting Party or the acceding Government which has a substantial interest in the goods in question has signed this Protocol, or submits a notification to that Party or to that Party, provided that, without prejudice to the provisions of Article XXXV of the General Agreement, all other Contracting Parties and the acceding governments shall notify them on the thirty days following the date on which the date on which the Party or on which the request, the latter Party, and which the Contracting Party with which it has originally agreed, shall sign, sign this Protocol, or submit a notification, or submit a notice, or withdraw, or withdraw, or withdraw, and shall, provided that notice, and shall, provided that it, provided that it, without prejudice, without prejudice to the effect of any harm to the effect of any other of any other

(a) Whenever Article II of the General Agreement refers to the date of this Agreement, the date of this Protocol shall be understood as regards the instruments annexed to this Protocol.
(b) Whenever, in paragraph 6 of Article V, subparagraph 4 (d) of Article VII and in paragraph 3 (c) of Article X of the General Agreement, the date of this Agreement is referred to, for each acceding government, to be 24 March 1948.
(c) Where paragraph 11 of Article XVIII of the General Agreement refers to the dates 1 September 1947 and 10 October 1947, it is understood as regards each acceding government, 14 May 1949 and 30 July 1949 respectively.
6. Each acceding government shall bring into force the provisions of the General Agreement, as annexed to the Final Act of the Second Meeting of the Preparatory Committee of the United Nations Conference on Trade and Employment, as corrected, supplemented or otherwise amended on the date of signature of this Protocol by the acceding Government. In order for the signature of this Protocol acceding to the Government to be effective, it shall be accompanied by an appropriate declaration approving any correction, addition or other amendment agreed by the Contracting Parties and submitted to governments for adoption, which has not yet become effective on the date of signature of this Protocol acceding to the Government.
7. Any acceding government signing this Protocol may revoke the provisional entry into force of the General Agreement; This cancellation shall become effective on the 60th day following the date on which the written notice of such revocation is received to the Secretary-General of the United Nations.
8.
(a) Any acceding government which signs this Protocol and does not submit notice of cancellation pursuant to paragraph 7 shall be able to accede to the Agreement on the date on which the General Agreement becomes applicable in accordance with its Article XXVI or after that date, under the conditions laid down in this Protocol, by deposit of an instrument of accession with the Secretary-General of the United Nations. This approach shall become an effective date on which the General Agreement referred to in Article XXVI enters into force or on the 30th day following the date on which the instrument of access was filed, but always later on.
(b) The accession to the General Agreement referred to in paragraph 8 (a) of this Protocol shall be deemed, for the purposes of paragraph 2 of Article XXXII of the Agreement, to be adopted by the Agreement pursuant to paragraph 3 of Article XXVI of the Agreement.
9.
(a) Any acceding government which signs this Protocol or imposes a instrument of access in accordance with paragraph 8 (a), and any Contracting Party which makes the notification referred to in paragraph 3, shall do so for its mother territory and for the territory for which it is internationally responsible, with the exception of separate customs territories which it shall notify to the Secretary-General of the United Nations at the time of signature or deposit of the instruments of accession or the notification referred to in paragraph 3.
(b) Any acceding government or current Contracting Party providing the Secretary-General with a notification of the exemption referred to in subparagraph (a) of this paragraph may at any time notify the Secretary-General that the signature, accession or notification made pursuant to paragraph 3 is valid for any separate customs territory so exempted or for any separate customs territory so exempted and this notification shall become effective on the 30th day following the date on which the Secretary-General arrives.
(c) If one of the customs territories for which the acceding government has put the General Agreement into effect has or obtains full self-administration in the management of its foreign trade relations and other matters covered by the General Agreement, that territory will be considered a Contracting Party if the acceding government responsible makes a statement confirming that fact.
10.
(a) The original of this Protocol shall be deposited with the Secretary-General of the United Nations and shall be open for signature at the headquarters of the United Nations for the current Contracting Parties from 10 October 1949 to 30 November 1949 and for the acceding governments from 10 October 1949 to 30 April 1950.
(b) The Secretary-General of the United Nations shall immediately supply all members of the United Nations and all other governments participating in the United Nations Conference on Trade and Employment with a certified copy of this Protocol, notify them of any addition to the further signature, any deposit of the instrument of access referred to in paragraph 8 (a), any notification or submission pursuant to paragraphs 3, 7, 9 (a) or 9 (b).
(c) The Secretary-General is authorised to register this Protocol in accordance with Article 102 of the Charter of the United Nations.
11. As soon as this Protocol, as regards the acceding Government, is signed by two thirds of the Contracting Parties to this Agreement, it shall constitute a decision taken pursuant to Article XXXIII of the General Agreement by which those Parties approve the access of that Government.
12. Subject to the provisions of paragraph 3, this Protocol shall enter into force for each acceding Government, in respect of which it shall be signed by two thirds of the Contracting Parties before 30 November 1949.
(a) from 1 January 1950, if signed by the acceding Government by 30 November 1949, or
(b) if it is not signed by the acceding government by 30 November 1949, on the 30th day following that on which it will be signed by the acceding government.
13. The date of this Protocol shall be 10 October 1949.

Notes to individual goods.
(1) Liquid products referred to in pol. pol. 97a) are products obtained from waste from the manufacture of sulphate cellulose, consisting essentially of a mixture of fatty and resin acids, distilled, yellowish or ochre.
A semi-solid product means a very dense (semi-solid) dark brown or blackened residue after distillation of the said raw liquid product, consisting essentially of a mixture of fatty and resin acids and containing still some fat.
However, only consignments of both of the following goods, accompanied by a certificate issued by the manufacturer, certified by the Czechoslovak Republic Embassy in the country of origin and containing the following particulars shall be eligible for consideration at the contractual rates under this heading:
(a) the name of the manufacturer;
(b) the description of the goods,
(c) its trade name,
(d) a declaration by the manufacturer that the goods consist of a mixture of fatty and resin acids obtained from waste from the manufacture of sulphate cellulose and that they are distilled or residues from distillation.
The Czechoslovak Customs Administration reserves the right to be convinced of the composition of the goods by examining samples collected from consignments of such goods on importation.
(2) In addition to certificates of origin, all wines imported into Czechoslovakia must also be accompanied by an analysis certificate issued by public laboratories, the list of which will be established by mutual agreement between the competent authorities of the exporting country and the Czechoslovak authorities.
The analytical certificate shall in particular contain:
specific weight,
alcohol grade;
the content of all acids,
volatile acid content,
the extract content,
sugar content,
a sugar-free extract content,
ash (mineral) content,
a declaration that the wine is natural without any additives.
(3) The wines "Marsala" and "Vermouth" belonging to the rate.
General notes.
The specific duty rates Kčs 50 - and less than 100 kg shall be taken to be gross.
Specific duty rates higher than Cčs 50 - per 100 kg shall be taken to mean net weight, unless otherwise specified in this schedule.

Wishing to amend Article XXVI General agreements within the meaning of Article XXX of this Agreement
They shall be adopted as follows:
1. The text of paragraph 4 of Article XXVI The General Agreement is amended as follows:
"4.
(a) Any government which adopts this Agreement shall do so for its parent territory for which it is internationally responsible, with the exception of separate customs territories which shall notify the Secretary-General of the United Nations when the Agreement is adopted.
(b) Any government notified to the Secretary-General of this kind in agreement with the exceptions foreseen in the subparagraph (a) of this paragraph may at any time notify the Secretary-General that its adoption of the Agreement applies to any separate customs territory so exempted and this notification becomes effective on the 30th day following the date on which the Secretary-General arrives.
(c) If any of the customs territories for which a Contracting Party has adopted this Agreement has or obtains full self-management in the management of its foreign trade relations and other matters covered by this Agreement, that territory shall be considered a Contracting Party if the Contracting Party responsible makes a declaration confirming that fact. "
This Protocol shall be deposited with the Secretary-General of the United Nations after signature at the end of the third session of the CONTRACTING PARTIES.
3. As from the date of deposit, the deposit of the Protocol shall constitute, for each Contracting Party whose representative shall sign this Protocol without reservation, the deposit of the instrument of acceptance of the amendment referred to in paragraph 1 of this Protocol.
4. The instruments of acceptance of those Contracting Parties which do not sign this Protocol or which sign it with reservations as to acceptance shall be deposited with the Secretary-General of the United Nations.
5. Pursuant to the provisions of Article XXX of the General Agreement, the amendment referred to in paragraph 1 of this Protocol shall enter into force as soon as two thirds of the governments Parties at the time have deposited their instruments of acceptance, in accordance with the provisions of paragraphs 3 and 4 of this Protocol.
6. The Secretary-General of the United Nations shall inform all members of the United Nations and all governments participating in the United Nations Conference on Trade and Employment of any acceptance of the amendment contained in paragraph 1 of this Protocol as well as of the date on which that amendment enters into force pursuant to paragraph 5 of this Protocol.
7. The Secretary-General shall be authorised to register this Protocol within the meaning of Article 102 of the Charter of the United Nations.

The first of the two explanatory notes to Article XXIV, as amended by the Special Protocol relating to Article XXIV, shall be as follows:
"Paragraph 9.
It is understood that I require that, where goods imported into the territory of one of the members of the customs union or into the area of free trade with a preferential customs duty be re-exported to the territory of another member of that Union or region, that Member shall levy a duty equal to the difference between the customs duty already paid and any higher duty which would be collected if the goods were imported directly into its territory. '
(The following are corrections in the schedule of tariff concessions. II - Belgium, Luxembourg, the Netherlands, III - Brazil, V - Canada, VII - Chile, XI - France, XII - India, XV - Pakistan, XVIII - South Africa Union, XX - United States of America to be declared therein.)
