GOVERNMENT REGULATION
of 3 December 2018
on the adjustment of compensation for loss of service income after the cessation of incapacity for service resulting from an accident or occupational disease and the adjustment of the cost of maintenance of survivors
The Government mandates the implementation of Act No. 361 / 2003 Coll., on the service relationship of members of the Security Corps, as amended by Act No. 186 / 2004 Coll., Act No. 436 / 2004 Coll., Act No. 586 / 2004 Coll., Act No. 626 / 2004 Coll., Act No. 169 / 2005 Coll., Act No. 253 / 2005 Coll., Act No. 413 / 2005 Coll., Act No. 470 / 2005 Coll., Act No. 167 / 2012 Coll., Act No. 189 / 2006 Coll., Act No. 531 / 2006 Coll., Act No. 375 / 2011 Coll., Act No. 428 / 2011 Coll., Act No. 306 / 2008 Coll., Act No. 326 / 2009 Coll.
The compensation for loss of service income after the cessation of incapacity for service resulting from an accident or occupational disease (hereinafter referred to as "compensation for loss of service income ') and the reimbursement of maintenance costs of survivors belonging to members or survivors under Act No. 361 / 2003 Coll., on the service relationship of members of the Security Corps, as amended, or under previous legislation1), shall be adjusted by increasing by 3,4% the average service income applicable to the calculation of compensation for loss of service income and to the reimbursement of maintenance costs of survivors, possibly increased by the former legislation2.
If there is a right to compensation for loss of service income and to reimbursement of maintenance costs of survivors after 31 December 2018, the average service income applicable to the calculation of compensation shall not be increased in accordance with Article 1.
The adjustment of the compensation for loss of service income and the reimbursement of the maintenance costs of survivors referred to in Article 1 shall be made from 1 January 2019 and shall be made without the application of the national or survivors and at the request of the member only if the compensation for loss of service income was not due to an increase in disability pension under social security legislation or pension insurance.
Efficacy
This Regulation shall enter into force on the day of its publication.
