DECLARATION
of 8 December 2014
amending Decree No. 365 / 2009 Coll., on Gas Market Rules, as amended
Pursuant to Section 98a (2) (i) of Act No. 458 / 2000 Coll., on the Terms and Conditions of Business and on the Performance of State Administration in the Energy Sector and on the Amendment of Certain Laws (Energy Act), as amended:
Decree No. 365 / 2009 Coll., on Gas Market Rules, as amended by Decree No. 370 / 2010 Coll., Decree No. 442 / 2011 Coll. and Decree No. 436 / 2012 Coll., are amended as follows:
1. in Paragraph 2 (1) (r), the words "in m3" are replaced by the words "intended in m3 or kWh."

(1) An application for the conclusion of a gas transport contract shall be submitted by a clearing entity or by a foreign natural or legal person who is not a clearing entity no later than 10 working days before 10: 00 hours before the shipment takes place. The transmission system operator shall evaluate the request for the conclusion of a gas transport contract and, in the case of a positive assessment, send the draft gas transport contract to the applicant for the conclusion of the contract within 5 working days within 16.00 hours of the submission of the application. The applicant for the conclusion of the contract shall accept the draft gas contract in such a way that the gas contract is concluded no later than two working days before 12: 00.
(2) Under a gas transport contract, the transmission system operator shall allow a clearing entity or a foreign natural or legal person not being a clearing entity to reserve monthly transport capacity, daily transport capacity, next-day transport capacity and intraday transport capacity. Transport capacity can be booked as fixed or interruptible.
(3) The request to reserve monthly transport capacity, daily transport capacity, next-day transport capacity and intraday transport capacity shall be submitted electronically. The request for reservation of transport capacity shall contain the particulars set out in Annex 1 to this Order.
(4) Monthly transport capacity, daily transport capacity, next-day transport capacity and intraday transport capacity are reserved for border points, transfer point or sum of gas production points and virtual gas storage points. Daily transport capacity, next-day transport capacity and intraday transport capacity shall be reserved for the customer's demand point directly connected to the transmission system.
(5) Gas transport when booking monthly transport capacity begins on the first gas day of the calendar month for which the capacity is reserved. A clearing entity or a foreign natural or legal person who is not a clearing entity may reserve the transport capacity from a gas month other than the gas month immediately following the month in which it requests the reservation of the transport capacity, but not earlier than 24 calendar months before the start of the shipment, depending on the reservation of the monthly transport capacity. Monthly capacity shall be reserved for one or more consecutive gas months. The monthly transport capacity for border points and points of the virtual gas storage tank may be reserved for a maximum of 60 gas months following the month in which the request for reservation of the monthly fixed or interruptible transport capacity has been made pursuant to Article 6 (1).
(6) Gas transport using reserved daily transport capacity shall begin on the first gas day of the period for which the transport capacity is reserved and end on the last gas day of the period for which the transport capacity is reserved. A clearing entity or a foreign natural or legal person who is not a clearing entity may reserve transport capacity from a gas day other than the gas day immediately following the day on which it requests the reservation of transport capacity. Daily transport capacity shall be reserved for one or more consecutive gas days. The transport capacity may be reserved for a maximum of 31 days from the date of the request for a reservation of daily fixed or interruptible transport capacity.
(7) The next day's transport capacity shall be reserved by the clearing entity or by a foreign natural or legal person who is not a clearing entity on the day preceding the day on which the shipment starts using the next day's transport capacity. The transport of gas using the next day's transport capacity shall take place for one gas day.
(8) The intraday transport capacity shall be reserved by a clearing entity or by a foreign natural or legal person who is not a clearing entity on the day preceding the date of commencement of the gas transport or on the gas day of commencement of the gas transport operation using intraday transport capacity. The transport of gas by the use of intraday transport capacity shall take place for a period of one or a part of a gas day, but always until the end of that gas day.
(9) The customer or gas supplier shall reserve the transport capacity for the customer's demand point directly connected to the transmission system in accordance with the procedure set out in Sections 11 and 12, or in the case of the reservation of daily transport capacity pursuant to Sections 6 (1) and (2), or in the case of the reservation of transport capacity in the following day, in accordance with Sections 6 (4) and (6), or in the case of intraday transport capacity in accordance with Sections 6 (5) and (6).
(10) The gas contract referred to in Article 4 (3) is concluded for a period of one calendar year with effect from the first gas day of the calendar year.
(11) The intermittent transmission capacity shall be reserved by the transmission system operator where a clearing entity or a foreign natural or legal person who is not a clearing entity so requests or cannot reserve a fixed transmission capacity on the grounds that a free fixed capacity is no longer available. ';
3. In Paragraph 6 (1), "standard 'is replaced by" monthly fixed or interruptible or daily'.
4. Paragraph 6 (2) is deleted.
Paragraphs 3 to 7 shall be renumbered paragraphs 2 to 6.
5. In Article 6 (2), the word "standard 'is replaced by" monthly' and in the last sentence, the words "or paragraph 2 'are deleted, the word" calendar' is replaced by the word "gas'.
6. The first sentence of Paragraph 6 (3) reads: "For the transport of gas to customer demand points directly connected to the transmission system, the provisions of Sections 5, 6, 10 to 12 and 14 shall apply mutatis mutandis. '.
7. Paragraph 6 (4) reads as follows:
"(4) An application for a reservation of fixed or interruptible transport capacity in the next day's mode shall be submitted by the clearing entity from 9.00 to 4.00 on the gas day preceding the gas day for which the shipment using the next day's transport capacity is booked. ';
8. In Article 6, the following paragraph 5 is inserted after paragraph 4:
"(5) An application for a reservation of fixed or interruptible intraday transport capacity shall be submitted by the clearing entity from 4.00 hours on the gas day preceding the gas day for which the transport capacity is booked using intraday transport capacity until the end of the gas day for which the transport capacity is booked using intraday capacity. ';
Paragraphs 5 and 6 shall become paragraphs 6 and 7.
9. Paragraph 6 is deleted.
Paragraph 7 shall become paragraph 6.
10.Paragraph 6 (6) reads:
"(6) The transmission system operator shall, immediately after receipt of the request for reservation of fixed or interruptible transport capacity in the next day's mode or of fixed or interruptible intraday transmission capacity, evaluate the request and reserve the capacity in the case of free transport capacity. ';
11. The following Section 6a is inserted after Section 6:
Transport in test operations
The gas transport in test operations shall be negotiated in accordance with the procedures set out in Section 13 applied mutatis mutandis. The functions of the distribution system operator referred to in Article 13 shall be performed by the transmission system operator. ';
12. in Article 7 (1), "standard" is replaced by "monthly."
13. in Paragraph 7 (3):
"(3) The transmission system operator shall provisionally reserve interruptible transmission capacity in the extent of the lack of demand in accordance with paragraphs 1 and 2. The transmission system operator shall reserve the transmission capacity only upon electronic confirmation of the reservation by the clearing entity within 8: 45 hours of the gas day on which the transmission system operator has provisionally reserved the capacity. ';
14. in Paragraph 7 (4), the words "standard interruptible capacity or daily capacity" shall be deleted;
15. in Article 10 (2), "standard" is replaced by "monthly."
16. in Article 11 (1), "16" is replaced by "15."
17. in Article 11 (3), the words "or no later than the following day, by 10.00 hours after transmission of the information referred to in Article 52 (14)" shall be deleted.
18.V § 11 paragraph. 6 reads:
"(6) A request for the reservation of distribution capacity and the conclusion of a gas distribution contract for a cross-border pipeline point shall be submitted by the clearing entity to the distribution system operator no later than 10: 00 on the working day preceding the date of the next possible start of distribution of gas agreed with the distribution system operator. The distribution system operator shall evaluate the requests for reservation of distribution capacity received and report the results of the reservation of distribution capacity to all applicants for reservation of distribution capacity no later than the third working day by 12.00 hours from the date on which the request for reservation of distribution capacity was made. The distribution capacity shall be reserved by the distribution system operator by confirming the request. ';
19. In Article 12, paragraph 8 is added:
"(8) Where a measurement has been changed from type C to type A or B at the customer's sampling point, the customer or gas supplier shall submit a request for the reservation of distribution capacity on the first gas day of the calendar month at the dates referred to in Article 11 (2) so that the effect of the reservation of distribution capacity does not occur later than 2 months after the change in the measurement type. In the event that a customer or gas supplier does not submit an application for a distribution capacity reservation pursuant to Article 10 (1) within the deadline referred to in Article 11 (2), the distribution system operator shall reserve the distribution capacity for the demand point referred to in Article 10 (1) (a) at the level of the allocated distribution capacity determined for the purposes of determining the payment for the distribution of gas under the price decision of the Authority. ';
20. In Article 13 (1), the words "reconstructions for the purposes of this Decree shall be inserted after the words" customer's equipment, "meaning interference with the gas sampling equipment which results in a change in its purpose or technical parameters."
21. in Paragraph 13 (1) (b), "more than 30" is replaced by "at least 20" and at the end of the text in point (b) the word "or" shall be deleted. "
22. in Article 13 (1), the following point (c) is inserted after point (b):
"(c) for a customer with a type of heating collection that has reconstructed the whole or part of the gas sampling installation where a minimum 10% reduction in the amount of the reserved distribution capacity can be expected after the reconstruction; or"
Point (c) shall be renumbered (d).
23. In Article 13 (2), "where less than 50% of the annual gas consumption is used for heating and hot water preparation 'is replaced by" for which the sum of the actual consumption values for the last quarter of the previous year is less than 70% of the total consumption for the period from 1 April of the previous year to 31 March of that year'.
24. In Paragraph 13, the following paragraph 3 is inserted after paragraph 2:
"(3) An application for the distribution of gas in the test run for the customer's sample gas location shall be submitted by the applicant for the reservation of distribution capacity in the test run. The application shall contain:
(a) the date of commencement of distribution in test operations;
(b) the date of cessation of distribution in test operations;
(c) reasons for starting distribution in test operations. ';
Paragraphs 3 to 6 shall be renumbered paragraphs 4 to 7.
25. Paragraph 16 (4) reads:
"(4) Under the gas storage contract, the gas storage service operator shall reserve a clearing entity or a foreign natural or legal person who is not a clearing entity, annual storage capacity with a fixed power, annual storage capacity with a fixed capacity, monthly storage capacity with a fixed capacity, daily storage capacity with a fixed capacity, daily storage capacity with an interruptible capacity. Storage capacity shall be reserved as:
(a) annual storage capacity with fixed power; the minimum time to reserve storage capacity is 1 year and the maximum time to reserve storage capacity is 5 years,
(b) annual storage capacity with fixed capacity for new storage capacity; the minimum time to reserve storage capacity is 1 year, the maximum time to reserve storage capacity is 15 years,
(c) monthly storage capacity with fixed power; the minimum time to reserve storage capacity is 1 gas month and the maximum time to reserve storage capacity is 24 gas months,
(d) daily storage capacity with fixed power; the minimum time to reserve storage capacity is 1 gas day and the maximum time to reserve storage capacity is 90 gas days,
(e) daily storage capacity with interruptible power; the time of booking of storage capacity shall be 1 gas day. ';
26. In Article 16, the following paragraph 5 is inserted after paragraph 4:
"(5) Capacity is reserved with effect from the first gas day of the period for which storage capacity is reserved. The reservation of storage capacity shall end on the expiry of the last gas day of the period for which the storage capacity was reserved. ';
Paragraph 5 shall become paragraph 6.
27. in Paragraph 17 (2):
"(2) The gas storage tank operator shall publish the terms of the auction for free storage capacity no later than 10 working days before the start of the multi-wheel electronic auction. The terms of the auction shall be proportionate, non-discriminatory and transparent. The terms of the auction include:
(a) the minimum price or the method of fixing the minimum price per unit of storage capacity for the first year or the first 12 months of the period for which storage capacity is reserved;
(b) the start date of the auction;
(c) the required means of secure electronic communication, including alternative means of communication in case of failure of electronic communication on the part of the applicant;
(d) the method of identification and the procedure for lodging the financial security;
(e) the size of the free storage capacity offered;
(f) the model of the gas storage contract or the definition of the scope of the changes to the content of the existing gas storage contract where the modification of the gas storage contract for storage capacity is required to be concluded with the participants of the auction to which storage capacity will be reserved;
(g) the size of the price increase per unit of storage capacity between the auctions and the method of allocating storage capacity;
(h) minimum and maximum time of booking of storage capacity;
(i) the method of calculating the price per unit of storage capacity for the other years or months during which storage capacity is reserved. ";
28. In Article 17 (3), the words "rounded figures' are replaced by the words" figures with precision 'and the words "percentage points' are replaced by the words" positions expressing the required size '.
29. In Article 17 (6), the word "share 'is replaced by" corresponding' and the words "and product of the coefficient 0,05 and the minimum price per unit of storage capacity referred to in paragraph 2 (a) 'are deleted.
30. In Paragraph 17 (8), "100 'is replaced by" the size of the storage capacity offered'.
31. in Article 17 (11), "100" is replaced by "the size of the storage capacity offered," and the words "or kWh" are inserted after the words "whole m3."

In such cases, the market operator shall suspend the gas supplier whose demand points are without the settlement entity's liability for the derogation at the customer demand points concerned. The procedure laid down in paragraph 2 shall not apply. '.
65.Paragraph 57 (1) reads as follows:
"(1) The distribution system operator shall, at the request of the gas supplier, terminate or discontinue the gas supply in the event of unauthorised gas collection.
(a) for the customer's sample point of the category of medium customer and wholesale customer within 3 working days of the date of receipt of the request for termination or interruption of the gas supply;
(b) in the case of a customer's point of demand in the category of retail customer and household within 10 working days of the date of receipt of the request for termination or interruption of the gas supply in the event of repeated non-compliance with the agreed payment obligations or payment obligations resulting from compensation for damage caused by unauthorised gas collection which are not fulfilled even after prior notification. "
66. In Paragraph 57, the following paragraph 2 is inserted after paragraph 1:
"(2) In the event that it is not possible to perform the termination or interruption of supply due to an inaccessible meter, the distribution system operator shall invite the customer to cooperate. If the customer does not provide the necessary synergies at the end of the gas supply, the effect of the termination of the supply shall be deemed to occur on the 30th day following the required working day indicated in the request for termination of supply in the event that the request for termination of supply has been delivered to the distribution system operator at least 5 working days before the required closing date; in other cases, the end of the supply shall take effect on the 30th day following the date of receipt of the request. At that date, the distribution system operator shall calculate the expected amount of gas consumption in accordance with the legislation governing the measurement of fluent 6) and shall transmit that calculation to the gas supplier and to the market operator for the sampling points identified by the code for the individual transmission of data to the market operator. ';
Paragraphs 2 to 5 shall be renumbered paragraphs 3 to 6.
67. In Paragraph 57, the following paragraph 5 is inserted after paragraph 4:
"(5) The distribution system operator shall terminate or interrupt the supply of gas at the retail and household customer's point of demand within 5 working days of the date of the finding of unauthorised procurement in accordance with Paragraph 74 (1) of the Energy Act (9). ';
Paragraphs 5 to 6 shall be renumbered paragraphs 6 to 7.

Character of the sampling point for assignment of the supply type diagram
The sampling point character describes the characteristics of the sampling point on the basis of which the delivery type diagram is assigned to the sampling point. The characteristics of the sampling point are determined for this purpose by the use of the sampling point, the timing and the nature of the sampling. On the basis of the assignment of specific values of each characteristic and the amount of annual consumption, the delivery type diagram will be assigned to the sampling point.

Delivery type diagrams classes
The classes of type gas supply diagrams for household, retail and medium-sized customers are assigned by the distribution system operator based on the nature of the sampling point and the frequency of the deduction, the name of the TDD class not expressing the customer category.
