DECLARATION
of 14 October 2010
amending Decree No 157 / 2003 Coll., laying down the requirements for fresh fruit and fresh vegetables, processed fruit and processed vegetables, dry nuts, mushrooms, potatoes and their products, and other methods of labelling, as amended by Decree No 650 / 2004 Coll.
The Ministry of Agriculture provides, pursuant to Article 18 (1) (a), (b), (g) and (h) of Act No. 110 / 1997 Coll., on Food and Tobacco Products, and amending and supplementing certain related laws, as amended by Act No. 119 / 2000 Coll., Act No. 306 / 2000 Coll., Act No. 146 / 2002 Coll., Act No. 274 / 2003 Coll., Act No. 316 / 2004 Coll. and Act No. 120 / 2008 Coll.:
This Decree was notified in accordance with Directive 98 / 34 / EC of the European Parliament and of the Council of 22 June 1998 laying down a procedure for the provision of information in the field of technical standards and regulations and rules and of rules on information society services, as amended by Directive 98 / 48 / EC.
Decree No. 157 / 2003 Coll., laying down the requirements for fresh fruit and fresh vegetables, processed fruit and processed vegetables, dry nuts, mushrooms, potatoes and their products, and other means of labelling, as amended by Decree No. 650 / 2004 Coll., are hereby amended as follows:
1. Section 1, including footnotes 1 to 3, is deleted.
2. In Article 6 (p), the words "or vegetables fresh or sterilised 'are deleted.
3. In Section 8 (1) of the Introductory Part of the Provisions, in Section 14 (1) of the Introductory Part of the Provisions, in Section 24 of the Introductory Part of the Provisions and in Section 29 of the Introductory Part of the Provisions, the words "in Implementing Legislation (1) 'are replaced by the words" in the Food Labelling Order (9)'.

4. In Paragraph 8 (1), at the end of point (f), the comma is replaced by a dot and points (g) to (i) are deleted.
5. In Paragraph 9 (2), "and 4 'is replaced by" to 5';
6. Paragraph 9 (4) is deleted.
7. Paragraph 10 (17) is deleted.
Paragraph 18 shall become paragraph 17.
8. In Paragraph 11 (3), the words "storage, transport and offer for sale 'are replaced by the words" putting into circulation'.
9. In Article 12 (b), the words "including olives' are deleted and the words" deeply 'are inserted after the words "vegetables'.
10. in Article 12 (e), the words "with added natural sweeteners or replacement sweeteners" shall be deleted;
11. in Article 12 (f), the word "replacement" shall be deleted;
12. in Article 12 (j), the words "fresh or sterilised fruit" shall be deleted;
13. in Article 14 (1), point (e) is deleted;
Point (f) shall be renumbered as point (e).
14. Paragraph 15 (3) is deleted.
15. in Article 17 (3), "storage and transport" is replaced by "putting into circulation."

Oranges
For the purposes of this decree:
(a) nuts - fruits or their seeds referred to in (b) to (i), in the raw state, or roasted or salted;
(b) walnuts - kernels of walnuts and varieties thereof,
(c) hazelnuts - hazelnut kernels;
(d) almonds - dry almond kernels,
(e) cashew nuts - seeds of western kidney,
(f) peanuts or peanuts - fruits of the groundnuts,
(g) Brazil nuts - alfalfa seeds,
(h) coconut nuts - coconut palm fruits,
(i) pine nuts - pine pine pine seeds.
Breakdown of groups and sub-groups
The breakdown of nuts into groups and subgroups is given in Annex 9.
Labelling
(1) In addition to the information given in the Act and in the Decree on the labelling of foodstuffs (9), nuts shall be identified by the name of the group and subgroup, for coconut and mixtures of nuts only by the name of the subgroup.
(2) The permitted negative mass deviations of the consumer package are set out in Annex 10.
Quality requirements
(1) The physical and chemical quality requirements are set out in Annex 11.
(2) The sensory quality requirements are set out in Annex 12.
(3) The shell must not contain pests. "
17. Paragraph 25 (2), including footnote 8, is deleted.
Paragraphs 3 and 4 shall become paragraphs 2 and 3.
18. In § 25, the sentence "Dried mushrooms have a taste typical of dried mushrooms, are free of foreign odours and flavours, are of a colour corresponding to the type of fungus used and are sufficiently dried to avoid molding or partying."
19. in Paragraph 26 (2), the words "store and transport" shall be replaced by the words "put into circulation."
20. in Paragraph 27 (h), the word "brown," shall be deleted;
21. In Article 30, the words "Table 1 'shall be added at the end of the text of paragraph 1 and paragraph 3.
22. In Paragraph 30, the words "without damage caused by pests affecting the flesh 'shall be added at the end of paragraph 2.
23. Paragraph 30 (4) reads:
"(4) The size of potato tubers of the early" small potatoes "is 17 to 28 mm. The size of the tubers of other potatoes of the potable early and tubers of the potable late spherical or oval form shall be at least 28 mm. '
24. in Paragraph 30 (6), the words "or weight" shall be deleted;
25. Annex No 1 shall be deleted;
26. In Annex 4, Table 1, in the second to fourth rows, "60 'is replaced by" 45'.
27. In Annex 4, Table 5 is added:
