Parliament has decided on this law of the Czech Republic:
Amendment to the Public Health Insurance Act

1. in Paragraph 7 (1) (h):
"(h) persons in the exercise of security detention or detention, persons in the execution of a custodial sentence or persons in the exercise of constitutional protection;"
2. In Paragraph 16b (1), the amount "CZK 2,500" is replaced by "CZK 1 000 and for insured persons over 70 years of age, including the calendar year in which they completed the 70th year of age, in the amount of CZK 500."
3. In Article 17a, the current text becomes paragraph 1 and the following paragraph 2 is added:
"(2) The health insurance undertaking shall publish the specific contract referred to in paragraph 1 in the manner and within the time limit laid down in the first sentence of Article 17 (9). In the same way and within the same period, the health insurance undertaking shall publish any amendment or amendment to a special contract showing the manner and amount of reimbursement of the health insurance undertaking by the provider of the social services provided or the scope of the services provided (hereinafter referred to as the" Appendix to the special contract '). A separate contract or a supplement to a separate contract shall take effect on the date of publication in accordance with the first sentence. If an agreement is reached between the social service provider and the health insurance undertaking on the method and amount of payment of the services paid only during the calendar year to be agreed on, the social services provider and the health insurance undertaking may agree that this agreement applies to the determination of the method and amount of payment of the services paid for the whole or part of that calendar year. The health insurance undertaking shall not disclose information and data which are subject to protection under other legislation.';
4. In Article 30 (2) (b) (4), the words "; in the case of insured persons over 65 years of age, vaccination against pneumococcal infections according to an approved vaccination scheme 'are deleted.
5. In Paragraph 30 (2) (b) (5), the words "3 doses of vaccine have been applied within the seventh month of the age of the insured person 'are replaced by the words" all doses of vaccine have been applied until the seventh month of the age of the insured person'.
6. In Article 30 (2) (b) (6), the words "for girls' are deleted.
7. In Paragraph 30 (2), at the end of point (b), the dot is replaced by a comma and the following point 7 is added:
"7. against invasive meningococcal infections, pneumococcal infections, invasive disease caused by Haemophilus influenzae type b and influenza, in patients with impaired or extinct splenic function (hyposplenism or asplenia), autologous or allogeneic transplantation of stem haematopoietic cells, in patients with severe primary or secondary immunodeficiency who require dispenserisation in a specialised workplace, or in patients with a history of invasive meningococcal or pneumococcal infection."
8. In Paragraph 30, at the end of paragraph 2, the dot is replaced by a comma and the following point (f) is added:
"(f) vaccination and reimbursement of medicinal products containing vaccines for vaccination of insured persons over 65 years of age against pneumococcal infections; paid vaccines shall be approved by the Ministry of Health on a recommendation from the National Immunisation Commission and published by means of a communication in the Collection of Laws. ';
9. in Article 39a (2) (a), the word "Greece" shall be inserted after the word "Romania,"
10. In Paragraph 39a, paragraph 7 is deleted.
Paragraphs 8 and 9 shall be renumbered paragraphs 7 and 8.
11. in Paragraph 39b (10), the words "and if the conditions laid down in (a) or (b) are met at the end of the text of point (c)" shall be added.
12. in Article 45a (1) (a), at the end of the text, the words "or shall not publish a special contract under Article 17a (2) or an addendum to a special contract" shall be added.
13. In Paragraph 55, the following paragraph 9 is added:
"(9) Where a health insurance undertaking has changed under Paragraph 11a, health insurance undertakings shall transmit free of charge information relevant to the application of the reimbursement of the costs of the services covered under paragraph 1. ';
14. In Annex 1, point 23 reads as follows:

Není-li použití skloionomerního cementu možné z hlediska zdravotního stavu pojištěnce, hrazeno při použití dózovaného amalgámu, při použití samopolymerujícího kompozita pouze v rozsahu špičáků včetně.“. |
Transitional provisions
1. Special Contracts pursuant to Article 17a (1) of Act No. 48 / 1997 Coll., as effective from the date of entry into force of this Act, including the Appendices to Special Contracts concluded before the date of entry into force of this Act and intended to become effective after the date of entry into force of this Act, shall be published by health insurance undertakings no later than 6 months after the date of entry into force of this Act; the specific contracts, including the amendments to the specific contracts, shall become effective on the date specified therein.
2. Proceedings initiated under § 39a of Act No. 48 / 1997 Coll., as effective by the date of entry into force of the Act, shall be completed under Act No. 48 / 1997 Coll., as effective by the date of entry into force of the Act.

1. in Part Four, the following Title III is inserted after Title II:
HOSPIC
(1) Hospital means a provider who provides health services to terminally terminally treated patients in hospital-type special-bed medical facilities or in the patient's own social environment.
(2) Hospital services are generally provided to patients and their loved ones under other legislation. "
2. In Paragraph 70 (3), after the first sentence, the sentence "The head of the Institute of Statistics shall be the Director appointed and dismissed by the Government on a proposal from the Minister for Health."
3. in Article 77a (3) (a):
"(a) an agent identifier of a natural person assigned under the law governing the information system of the basic registrar (18) to an insured person to whom a health service specified in (d) has been provided and paid by health insurance providers or social services providers; where an agent identifier of a natural person has not been assigned, the identification number of that insured person, ';
4. in Article 77a (3), the following points (b) and (c) are inserted after point (a), including footnote 54:
"(b) the sex of the insured person referred to in (a) and the year of birth;
(c) the municipality code of the address of the insured person's place of residence referred to in (a) from the basic register of territorial identification, addresses and real estate 54); and
54) Decree No 359 / 2011 Coll., on the Basic Register of Territorial Identification, Addresses and Real Estate, as amended by Decree No 415 / 2016 Coll. '.
Point (b) shall be renumbered (d).
Amendment to Act No. 66 / 2017 Coll.
Act No. 66 / 2017 Coll., amending Act No. 378 / 2007 Coll., on Medicines and on Changes to Certain Related Acts (Law on Medicines), as amended, and other Related Acts, is amended as follows:
1. in Article VIII (a), the words "48, 49," shall be deleted;
2. in Article VIII (b), "65 and 70 'is replaced by" 70';
3. in Article VIII (c), the words ", 48, 49," and the words "and 63 'are replaced by the words", 63 and 65';
EFFECTIVE
That law shall enter into force on 1 January 2018, with the exception of the provisions of Article 5 (1) (a) and (b) of Regulation (EU) No 1308 / 2013. I (10) and Article IV, which shall take effect on the day of its publication and the provisions of Article III (2) to (4), which shall take effect on the first day of the second calendar month following its publication.
