DECLARATION
of 13 October 2010
amending Decree No. 266 / 1999 of the Ministry of Defence Coll., on the method of providing free meals, equipment and transport equipment and on the accommodation of professional soldiers, as amended
According to § 93 of Act No. 221 / 1999 Coll., the Ministry of Defence provides:
Čl. I
Decree of the Ministry of Defence No. 266 / 1999 Coll., on the method of providing free meals, equipment and transport equipment and on the accommodation of professional soldiers, as amended by Decree No. 456 / 2002 Coll., Decree No. 69 / 2008 Coll. and Decree No. 334 / 2008 Coll., is amended as follows:
1. in Article 1, point (f) is deleted;
Points (g) and (h) shall be renumbered as points (f) and (g).
2. Article 3, including the title, reads:
„§ 3
Free meals on continuous duty
In a continuous service that lasts at least 24 hours, free meals shall be provided for the soldier from the first meal to be served after the start of the continuous service and end with the last meal to be served before the end of the continuous service. '
3. In Article 4 (1), the introductory part of the provision reads as follows:
"Free meals in the performance of special professions and activities are provided."
4. In Paragraph 4 (1), the dot at the end of point (g) is replaced by a comma and the following points (h) and (i) are added:
"(h) a soldier who, after his duties, is trained to acquire basic military knowledge and skills necessary for the performance of his duties; the soldier shall be provided free of charge with the main daily meals which fall within the period of service,
(i) to a soldier in a preventive hospital medical examination to which he is obliged to submit immediately after returning from a foreign operation. "
5. in Article 5 (1) (a), the words "leave granted for continuous military deployment in the Czech Republic" shall be inserted after the word "training."

„§ 14
(1) Military equipment is issued in the form of basic equipment. The basic equipment consists of clothing, linen, footwear and other equipment of the soldier necessary for the performance of the service, for the provision of training and for the performance of his duties.
(2) A soldier who has been appointed to the rank of General is hereby issued an addition to the basic equipment.
(3) A soldier who has already been in the service of an occupational soldier shall be provided with basic equipment if more than 5 years have elapsed since the last termination of the service.
(4) A soldier who has already been in the service of an occupational soldier and if less than 5 years have elapsed since the last termination of service but more than 2 years is issued one time twice the amount per year for equipment intended to restore basic equipment, the missing equipment being supplemented by the soldier at his own expense.
(5) A soldier who has been transferred from the Military Office of the President of the Republic or the Castle Guard to carry out his duties in the military or in the Ministry or vice versa shall be issued military equipment according to the duration of the service referred to in paragraph 3 or 4.
(6) A soldier who prepares for the performance of his duties by studying in schools and courses abroad or is transferred abroad, and a soldier who is seconded to perform his duties in a foreign operation, is provided with military equipment for operating abroad. Upon completion of the secondment, the military equipment referred to in paragraph 1 shall be provided to the soldier, provided that the essential equipment has not been issued to him during his occupation.
(7) In the probationary period, only the military equipment necessary for training is issued to the soldier. After the test period has been successfully completed, the other military equipment shall be issued to the soldier until completion of the basic equipment referred to in paragraph 1.
(8) A soldier who has already been in the service of an occupational soldier and has lost his service during a probationary period shall be re-engaged in military equipment in the form of basic equipment. "
7. In Article 15 (3), the words "or reduced basic 'are deleted.
8. In Article 17 (1), at the end of point (e), the dot is replaced by a comma and the following point (f) is added:
"(f) he took maternity leave."
9. In Article 17 (3), the words "and (f) 'shall be inserted after the words" paragraph 1 (e)'.
10. Paragraph 18, including the title, reads:
„§ 18
Military equipment at funeral
(1) If a soldier dies during the duration of the service, he may be buried in a military uniform issued to him in the form of basic equipment.
(2) If a soldier called for service abroad or in a foreign operation who has not been issued basic equipment pursuant to Paragraph 14 (1) dies, a military uniform without shoes and a laundry set shall be issued for burial.
(3) In exceptional cases where a military uniform issued to a soldier in the service ratio in the form of basic equipment referred to in Paragraph 14 (1) cannot be traced or destroyed or damaged, it may be issued for burial of a military uniform without shoes and one set of linen. '
11. After Paragraph 25, the following Section 26 is inserted:
„§ 26
Special-duty military formalities
A soldier who is called to special service shall be provided free of charge with catering, transport and accommodation. '

Efficacy
This Decree shall take effect on 1 January 2011.
