amending and supplementing the criminal law and the law of the Czech National Council No. 200 / 1990 Coll., on offences
Parliament has decided on this law of the Czech Republic:
Transitional and final provisions
1. In the provisions of the criminal law which are not affected by the amendments referred to in Article I of that law, the word "prosecutor 'shall be replaced by the words" prosecutor'.
2. The criminal offence of perjury and false expert opinion pursuant to Section 175 of the Criminal Act, which was committed before a prosecutor or search authority, if they conducted investigations or searches in accordance with the Code of Criminal Procedure, or by a state notary or economic arbitrage authority, if they were engaged in decision-making activities, or before an investigation committee of the Federal Assembly or the Czech National Council, shall be assessed in accordance with the existing regulations.
3. The custodial sentence imposed before the application of this law for an act which is not a criminal offence, or the remainder thereof, shall not be enforced. In such cases, the provision on the global penalty shall not be used. If a total or aggregate sentence has been imposed for such an act and a collectible offence, the court shall reduce the sentence accordingly; taking into account the mutual proportion of the seriousness of the acts which have not been criminal since the effectiveness of this law and the collectible offences.
The President of the Chamber of Deputies is hereby authorised to declare in the Collection of Laws of the Czech Republic the full text of the Criminal Act, as is apparent from the subsequent provisions.
This Law shall take effect on 1 January 1994.
