GOVERNMENT REGULATION
of 29 January 2025
amending Government Regulation No 9 / 2002 Coll., laying down technical requirements for noise emission products, as amended
The Government orders pursuant to § 22 paragraph 1 of Act No. 22 / 1997 Coll., on Technical Requirements for Products and on the Amendment and Addition of Certain Acts, as amended by Act No. 205 / 2002 Coll., Act No. 34 / 2011 Coll. and Act No. 526 / 2020 Coll.:
Government Regulation No. 9 / 2002 Coll., laying down technical requirements for products with regard to noise emissions, as amended by Government Regulation No. 342 / 2003 Coll. and Government Regulation No. 198 / 2006 Coll., is amended as follows:
1. In Paragraph 1 (1) of the Introductory Part of the Provisions, the words "European Community1) 'are replaced by the words" European Union1'.
Footnote 1:
"(1) Directive 2000 / 14 / EC of the European Parliament and of the Council of 8 May 2000 on the approximation of the laws of the Member States relating to noise emissions of equipment intended for outdoor use, in the environment, as amended by Directive 2005 / 88 / EC of the European Parliament and of the Council and Commission Delegated Regulation (EU) 2024 / 1208."
2. In Paragraph 1 (1), at the end of point (a), the comma is replaced by "a '.
3. In Paragraph 1 (1), at the end of point (b), the word "a 'is replaced by a dot and point (c) is deleted.
4. Paragraph 2 (58) is deleted.
Paragraph 59 shall become paragraph 58.
5. in § 2 (58) and § 5 (3), the words "Annex 3 to this Regulation" shall be replaced by the words "directly applicable European Union14";
footnote 14:
"(14) Commission Delegated Regulation (EU) 2024 / 1208 of 16 November 2023 amending Directive 2000 / 14 / EC of the European Parliament and of the Council as regards methods for measuring noise emitted by equipment intended for outdoor use and airborne spread."
(6) Paragraph 11, including footnotes 11 and 12, shall be deleted.
7. Annex 3, including the title and footnote 13, is deleted.
8. In Annex 5 (3) and (6.2), Annex 7 (3.1) and Annex 8 (3), the words "Annex 3 to this Regulation 'are replaced by the words" a directly applicable European Union Regulation (14)'.
Efficacy
This Regulation shall enter into force on 22 May 2025.
