GOVERNMENT REGULATION
of 7 February 2018
amending Government Regulation No 76 / 2015 Coll., on the conditions for implementing organic farming measures, as amended
The Government orders pursuant to § 2c (5) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 85 / 2004 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll., and pursuant to § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act No. 179 / 2014 Coll. as amended by Act No. 441 / 2005 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll.:
Government Regulation No. 76 / 2015 Coll., on the conditions for the implementation of organic farming measures, as amended by Government Regulation No. 113 / 2015 Coll., Government Regulation No. 64 / 2016 Coll., Government Regulation No. 236 / 2016 Coll., Government Regulation No. 18 / 2017 Coll. and Government Regulation No. 49 / 2017 Coll., are amended as follows:
1. in Paragraph 12 (2) (a), "20." is replaced by "24."
2. in Paragraph 12 (2) (b), "20." is replaced by "6."
3. in Article 12 (7) (h):
"(h) prove its own production of strawberries, at a minimum of 2 000 kg per hectare of the area planted with the strawberry for which it applies for the subsidy, by supporting, by 31 January of the following calendar year at the latest, the Fund for the Fund for the Fund issued by the Fund for the Form, the volume of its own production and the crop records referred to in Article 72 of Commission Regulation (EC) No 889 / 2008 to the relevant works of the soil blocks on which the strawberry is grown; this condition shall not apply to the part of the soil block or part thereof on which the strawberry crop is based for the first year, the applicant shall provide evidence of that fact by recording the crop production referred to in Article 72 of Commission Regulation (EC) No 889 / 2008, and ';
4. In Article 15 (3), point (f) is deleted.
Points (g) to (j) shall be renumbered as points (f) to (i).
5. In Article 15 (4), "(j) 'is replaced by" (i)';
6. in Paragraph 18 (1) (h), "424" is replaced by "419."
7. in Paragraph 18 (2) (h), "424" is replaced by "417."
8. In Paragraph 21 (4), "(h) 'is replaced by" (g)'.
9. In Paragraph 22 (8), "(g) 'is replaced by" (f)';
10. In Article 23 (10), the words "or (f) 'are deleted.
11. in Paragraph 24 (8), "(i)" is replaced by "(h)";
12. in Article 25 (12), the text "(j)" is replaced by the text "(i)";
13. in Article 25 (14), the word "or" and points (b) and (c) shall be added at the end of point (a);
Point (d) shall be renumbered (b).
14. In Paragraph 25, the following paragraph 15 is inserted after paragraph 14:
"(15) The subsidy shall not be granted in the relevant calendar year on the production area of the part of the soil block on which the non-compliance has been established, if the Fund has ascertained the applicant,
(a) failure to comply with the condition set out in Article 15 (2) (b) or (c); or
(b) failure to comply with the condition set out in Article 15 (3) (a) or (b). "
Paragraph 15 shall become paragraph 16.
15. in Article 25 (16), the words "the part of the soil block to which" shall "be replaced by the words" to which "and after the number" 14 "shall be inserted the words" or 15. "
16. In Annex 10, Part C:
"C. Model record keeping on values of climate indicators in an intensive set
"
Transitional provisions
1. The procedure for applications for grants initiated pursuant to Government Regulation No. 76 / 2015 Coll., as effective before the date of entry into force of this Government Regulation, shall be completed pursuant to Government Regulation No. 76 / 2015 Coll., as effective before the date of entry into force of this Regulation.
2. In the event of non-granting of subsidies for 2017 pursuant to Article 25 (14) (b) or (c) for non-compliance with the conditions referred to in Article 15 (2) (b) or (c), or Article 15 (3) (a) or (b) of Government Regulation No 76 / 2015 Coll., as effective before the date of entry into force of this Regulation, the date of entry into force of this Regulation shall be determined in accordance with Article 25 (14) to (16) of Government Regulation No 76 / 2015 Coll., as effective from the date of entry into force of this Regulation.
Efficacy
This Regulation shall take effect on 1 March 2018.
