DECLARATION
of 21 January 2010
amending Decree No 209 / 2004 Coll., on closer conditions for the management of genetically modified organisms and genetic products, as amended by Decree No 86 / 2006 Coll.
In agreement with the Ministry of Health and the Ministry of Agriculture, the Ministry of the Environment provides, pursuant to § 38 (c) of Act No. 78 / 2004 Coll., for the management of genetically modified organisms and genetic products:
Decree No. 209 / 2004 Coll., on the closer conditions for the management of genetically modified organisms and genetic products, as amended by Decree No. 86 / 2006 Coll., is amended as follows:
1. In Article 5, the following paragraph 5 is inserted after paragraph 4:
"(5) The first stage of the risk assessment of the contained use shall be the identification of the potential harmful effects referred to in points (a) to (i) of paragraph 3. Only genetically modified organisms may be included in the first category of the risk of contained use referred to in Annex 3 to the Act for which:
(a) it is unlikely that the recipient or the parental organism will cause disease to humans, animals or plants;
(b) the nature of the vector and insert is such that they cannot make the phenotype of the genetically modified organism subject to which it could cause human, animal or plant disease or which could have harmful effects on the environment; and
(c) the genetically modified organism is unlikely to cause diseases in humans, animals or plants or to have harmful effects on the environment. ';
Paragraphs 5 to 10 shall be renumbered paragraphs 6 to 11.
2. in Article 5 (7) (a), "paragraphs 1 to 5" shall be replaced by "paragraphs 1 to 6";
3. In Article 5 (8), the words "paragraph 6 'are replaced by the words" paragraph 7' and the words "In order to obtain the information necessary to carry out a risk assessment, the relevant Community legislation, international or national classification systems, including new scientific and technical knowledge, shall be added. For the inclusion of the contained treatment of genetically modified organisms in the risk categories referred to in Annex 3 to the Act, classification of biological agents into four groups may also be used according to the level of risk of infection according to § 36 and Annex 7 of the Government Regulation No. 361 / 2007 Coll., and classification systems applicable to plant and animal pathogens, as appropriate. 1a)."

Act No. 166 / 1999 Coll., on Veterinary Care and on the amendment of certain related laws (Veterinary Act), as amended. Annexes 1 and 2 to Decree No 215 / 2008 Coll., on measures to prevent the introduction and spread of harmful organisms of plants and plant products, as amended. Decree No 356 / 2004 Coll., on the monitoring of zoonoses and zoonotic agents and amending Decree No 299 / 2003 Coll., on measures to prevent and control diseases and diseases communicable from animals to humans. Decree No. 474 / 2002 Coll., implementing Act No. 281 / 2002 Coll., on certain measures relating to the prohibition of bacteriological (biological) and toxin weapons and on the amendment of the Trade Act. '
Efficacy
This decree shall take effect on the day of its publication.
