DECLARATION
Central management of the purchase of agricultural products and of the Ministry of Agriculture, Forestry and Water
of 5 April 1965
on the purchase and direct sale of fruit and vegetables to consumers
The central administration of the purchase of agricultural products and the Ministry of Agriculture, Forestry and Water in agreement with the participating central authorities and after the approval of the main arbitrator of the CSSR provides, pursuant to Section 392 of the Economic Code No. 109 / 1964 Coll., pursuant to Section 15 (1) of Act No. 51 / 1959 Coll., on the purchase of agricultural products and pursuant to Section 6 of the statutory measure of the Bureau of the National Assembly, No. 40 / 1962 Coll., on the establishment of the Central Administration of the Purchase of Agricultural Products.
(1) Purchases of fruit and vegetables are carried out by designated purchasing organisations on the basis of contracts for the purchase of agricultural products and the supply of agricultural supplies pursuant to Decree No. 122 / 1964 Coll.
(2) The contract referred to in paragraph 1 is concluded if the agreement on the subject-matter and time of performance and the price of fruit and vegetables to be delivered under the contract is reached; details are laid down in the price regulation. *)
(3) The purchasing organisation shall withdraw the quantity of fruit and vegetables agreed in a contract with tolerance plus 10% of the contract quantity. Only fruit and vegetables delivered in the quality specified by technical standards shall be subject to the collection obligation.
(4) Further quantities of fruit and vegetables are purchased by purchasing organisations at freely agreed prices, as required by the market, even if these products do not comply with technical standards.
State agricultural organisations and single agricultural cooperatives (hereinafter referred to as "agricultural organisations') may directly sell fruit and vegetables from their own production and products from their own fruit and vegetables as well as consumers (citizens, canteens, hospitals, public catering establishments, etc.) and consumer cooperatives.
(1) Directly for consumers, agricultural organisations may sell fruit and vegetables after fulfilling their contractual obligations to supply fruit and vegetables to purchasing organisations. Provided that compliance with the contract obligation is ensured, agricultural organisations may carry out direct sales of those products to consumers even before the time obligations have been fulfilled or together with their fulfilment.
(2) Direct sales of fruit and vegetables and products thereof to consumers shall take place, on the one hand, on the basis of agreements between agricultural organisations and consumers, in which they agree the conditions for such supplies, on the other hand, direct sales in agricultural establishments, markets, markets, stand-alone stands, directly from means of transport or established permanent stores, including outside the counties and the region of their production, provided that hygiene and other similar rules are complied with.
(3) Direct sales of fruit and vegetables to consumers are made at freely agreed prices.
(4) Agricultural organisations may cooperate with consumers in organising direct sales of fruit and vegetables and single agricultural cooperatives may make sales of fruit and vegetables produced by their members.
The provisions of this Decree shall apply mutatis mutandis to the purchase and sale of fruit and vegetables produced by individual farmers and small-scale farmers of agricultural land.
The purchase and direct sale of fruit and vegetables to consumers shall not be subject to:
1. the provisions of Part II of Decree No 47 / 1963 Coll., on the purchase of agricultural products by small agricultural users and on the sale of surplus agricultural products,
2. the provisions of § 3 (1), § 5 (2) and § 6 of Decree No. 122 / 1964 Coll., which issue the basic terms of purchase of agricultural products and supplies of agricultural needs.
This decree shall take effect on 10 April 1965.
