Regulation on archiving

Government Regulation
of 7 May 1954
about archiving.
The Government of the Czechoslovak Republic orders, with the consent of the President of the Republic pursuant to § 1 of the Constitutional Act No. 47 / 1950 Coll., on adaptations in the organisation of public administration:
§ 1.
Archiving must fully serve the political, scientific, cultural and economic needs of the Czechoslovak people in their building efforts. In order for archiving to successfully perform these tasks, it is organised and managed uniformly.
§ 2.
The files of documents and documents of an archival nature arising from the activities of public authorities, their institutes and establishments, socialist legal entities, in particular national and other undertakings which manage national assets, as well as their legal predecessors, shall form a single State archive fund, if they have been classified under the rules on shredding.
§ 3.
The single state archive fund shall be concentrated:
a) in the Central State Archive in Prague,
(b) in the State Central Archive of Slovakia in Bratislava,
(c) in state archives; and
(d) in other archives.
§ 4.
(1) The state central archive in Prague is established from the archives of the central archive of the Ministry of Interior and the archive of the Czech Republic.
(2) The Slovak National Central Archive in Bratislava is established from the Slovak Central Archive in Bratislava.
(3) State archives are established from the archives of the Moravian Regional Archive in Brno and Silesian Archive in Opava and the Regional Archives.
(4) The agricultural and forestry archives will be gradually integrated into the organisation of state archives by 31 December 1955, in order to fully ensure the scientific and research interests of the Ministry of Agriculture and of the Ministry of Forestry and Wood Industry and the Czech Academy of Agricultural Sciences.
§ 5.
(1) The State archives [§ 3 (a) to (c)] become the date on which they will be taken over by the Ministry of the Interior, its scientific research institutes.
(2) The other archives serve mainly the needs of the institutions for which they are established. The management of these archives shall be carried out by the competent authorities in accordance with the guidelines of the Ministry of Interior.
§ 6.
The organisation and management of archiving belongs to the Ministry of the Interior.
§ 7.
The Ministry of the Interior shall organise and manage archiving, in particular by:
(a) issue instructions for the conduct of archival works;
(b) control the condition and storage of archive material and supervise its effective deployment;
(c) keep records of the single State archive fund;
d) manage the scientific and culturally enlightening work of state archives;
(e) oversees the implementation of the decommissioning work;
(f) ensure the disclosure and publication of archival material;
(g) ensure the political and professional growth of archival workers.
§ 8.
(1) The scientific and archival advisory body of the Ministry of the Interior is the Scientific Archive Council, which has a maximum of 18 members. The President and other members of the Scientific Archive Board are appointed by the Minister of Interior in agreement with the President of the Czechoslovak Academy of Sciences and the Minister of Education.
(2) The advisory body responsible for the internal affairs in the scientific and professional issues of Slovak archiving is the Slovak Scientific Archive Council, which has a maximum of 6 members. The President and the other members of the Slovak Scientific Archives Board shall be appointed by the Home Secretary, in agreement with the Chairman of the Slovak Academy of Sciences and the Education Officer.
(3) Membership of the Scientific Archive Board and the Slovak Scientific Archive Council is honorable.
§ 9.
Other archives may be included in the organisation of state archives. The Home Secretary shall decide on the inclusion in agreement with the relevant Ministers.
§ 10.
When integrating archives into the organisation of state archives, the Ministry of the Interior will take over the date of integration of the planned labour force, financial and material- technical resources, real estate and other equipment of archives to the extent and under the conditions under which they have been used so far.
§ 11.
(1) Detailed provisions for the implementation of this Regulation are to be issued by the Home Secretary in agreement with the President of the Czechoslovak Academy of Sciences and the Minister of Education.
(2) The Minister of the Interior may also provide for exceptions for certain archiving units of particular importance.
§ 12.
The archive material stored in the archives of the armed forces is part of a single state archive fund; the management and organisation of the archives of the armed forces and the use of the archive material stored in those archives are solely for the military authorities.
§ 13.
This Regulation shall enter into force on the day of its publication; they will be carried out by the Home Secretary in agreement with the President of the Czechoslovak Academy of Sciences and with the other members of the Government concerned.
