GOVERNMENT REGULATION
of 29 September 2010
amending Government Regulation No 133 / 2005 Coll., on technical requirements for the operational and technical interconnection of the European rail system, as amended by Government Regulation No 371 / 2007 Coll.
The Government orders pursuant to Section 22 of Act No. 22 / 1997 Coll., on Technical Requirements for Products and on the Amendment and Addition of Certain Acts, as amended by Act No. 71 / 2000 Coll. and Act No. 205 / 2002 Coll., ("the Act ') to implement Sections 12 paragraphs 1 and 3 and Sections 13 paragraphs 1 and 10 of the Act:
Government Regulation No. 133 / 2005 Coll., on technical requirements for the operational and technical interconnection of the European rail system, as amended by Government Regulation No. 371 / 2007 Coll., is amended as follows:
1. in Paragraph 1 (1), the introductory part of the provision reads:
"This Regulation implements the relevant provisions of the European Union( 1), building on the directly applicable provisions of the European Union( 2) and adapting them '.
2. footnotes 1 and 2 shall read:
"(1) Directive 2008 / 57 / EC of the European Parliament and of the Council of 17 June 2008 on the interoperability of the rail system within the Community. Decision No 768 / 2008 / EC of the European Parliament and of the Council of 9 July 2008 on a common framework for the marketing of products and repealing Council Decision 93 / 465 / EEC.
(2) Commission Regulation (EC) No 352 / 2009 of 24 April 2009 on the adoption of a common safety method for risk assessment and assessment as referred to in Article 6 (3) (a) of Directive 2004 / 49 / EC of the European Parliament and of the Council. ';
3. footnote 4 is deleted, including the footnote references.
4. In the first sentence of Article 2 (3), "Central 'is replaced by" Official'.
5. In Article 4, the following paragraph 6 is added:
"(6) For spare parts to subsystems already put into service at the time of entry into force of the relevant interoperability technical specification, an assessment of the conformity and suitability for use and the issue of the relevant certificate shall not be required. ';
6. In Article 6, the following paragraph 5 is inserted after paragraph 4, including footnote 10:
"(5) The certificate of review of the type of the groove vehicle or the certificate of verification of the groove vehicle is issued in accordance with the verification procedures
(a) the relevant technical interoperability specifications for vehicles corresponding to the technical interoperability specifications; or
(b) established pursuant to Decision No 10 of the European Parliament and of the Council on a common framework for the marketing of products) for vehicles not complying with the technical specifications of interoperability.
"(10) Modules D and E in Annex II to Decision No 768 / 2008 / EC of the European Parliament and of the Council of 9 July 2008 on a common framework for the marketing of products and repealing Council Decision 93 / 465 / EEC."
Paragraph 5 shall become paragraph 6.
7. Paragraph 6 (6), including footnote 11, reads:
"(6) Structural subsystems which are part of the European rail system have been assessed in accordance with the directly applicable European Union11 Regulation) and the relevant technical interoperability specifications and have issued a certificate of review of the subsystem type or certificate of verification of the subsystem shall be considered as interoperable and shall comply with the essential requirements.
11) Commission Regulation (EC) No 352 / 2009 of 24 April 2009 on the adoption of a common safety method for risk assessment and assessment as referred to in Article 6 (3) (a) of Directive 2004 / 49 / EC of the European Parliament and of the Council. '
8. In Annex No 1, Part I, at the end of point 3, the sentence "In cases where the technical specifications for interoperability are not issued, a Decision of the European Parliament and of the Council on a common framework for the marketing of products (12) shall be added."
Footnote 12 reads:
"(12) Decision No 768 / 2008 / EC of the European Parliament and of the Council of 9 July 2008 on a common framework for the marketing of products and repealing Council Decision 93 / 465 / EEC."
9. Part III of Annex No 1 is deleted.
10. In Annex 2, Part I, at the end of point 2.1, the sentence "In cases where the technical specifications for interoperability are not issued, the provisions of the Decision of the European Parliament and of the Council on a common framework for the marketing of products on the market (12) shall be added. ';
11. Part III of Annex 2 is deleted.
Efficacy
This Regulation shall enter into force on 1 November 2010.
