GOVERNMENT REGULATION
of 29 May 2002
determining the scope and manner of data provision in the Salary Information System
The Government hereby orders pursuant to Article 23 (1) (i) of Act No. 143 / 1992 Coll., on the salary and remuneration for on-call time in the budget and in certain other organisations and bodies, as amended by Act No. 217 / 2000 Coll., hereinafter referred to as "the Act":
Subject matter
(1) This Regulation sets out the scope of data and how it is to be provided by the employer to the Salary Information System.
(2) The range of employers who proceed under this Regulation and the number of employees for which these employers provide data to the Salary Information System is laid down in Law 1)
Scope of the data provided
(1) The employer, with the exception of the employer referred to in paragraph 2, shall provide to the Information System on salaries the data on the staff member to the extent and breakdown referred to in Annex 1 to this Regulation and other data on the employer to the extent and breakdown referred to in Annex 2 to this Regulation.
(2) The employer who carries out the tasks of the intelligence services (2) provides data on the staff members who are subject to confidentiality under a specific legislation, (3) to the extent and breakdown set out in Annex 3 to this Regulation.
Method of data provision
(1) The employer, with the exception of the local self-governing body, (4) the contribution organisation set up by the local and regional authorities, the organisational components of the local self-governing body and the State Fund, (5) it shall provide for the first half of the calendar year and for the full calendar year ("reference period") until the last calendar day of the month following the end of the reference period.
(a) the data referred to in Article 2 (1) to the administrator of the State Budget Chapter (6) (hereinafter referred to as the "Chapter Administrator");
(b) the information referred to in Article 2 (2) to the Ministry of Finance under the regime corresponding to the appropriate classification level laid down by the specific legislation. 7)
(2) The employer, who is a contributory organisation set up by a local authority and an organisational component of a local authority, shall provide the data referred to in Article 2 (1) for the reference period (8) until the last calendar day of the month following the end of the reference period.
(3) The State Fund shall provide the data referred to in Article 2 (1) for the reference period to the Ministry of Finance by the last calendar day of the month following the end of the reference period.
(4) The administrator of the chapter and the local authority shall provide the data referred to in Article 2 (1) for the reference period for all employers and employees under its responsibility to the Ministry of Finance by the fifth calendar day of the second month following the end of the reference period.
(5) Where the last day of the period provided for in paragraphs 1 to 4 is Saturday, Sunday or holiday, which shall be the day of work, 9) the period shall be deemed to have been observed if the data are provided on the next working day.
(6) The data are transmitted by the employer in electronic form in accordance with a special law. 10)
Common, transitional and final provisions
(1) The employer who provides incorrect data is obliged to correct the data and to provide the corrected data without delay, no later than 2 working days.
(2) The Ministry of Finance shall keep the data provided under Paragraph 3 (1) (b) under a regime appropriate to the classification level. 7)
(3) Administrator function 11) The Ministry of Finance shall perform the information system on salaries.
For the first time, the administrator of the chapter shall provide data for staff assigned to perform their duties at the office of the administrator of the chapter for the whole year 2002. Other employers will provide data to the Salary Information System for the first time in 2003.
Efficacy
This Regulation shall enter into force on 1 July 2002.
