GOVERNMENT REGULATION
of 29 May 2002
laying down rules on the grant of grants to support libraries
The Government orders pursuant to § 15 (3) of Act No. 257 / 2001 Coll., on Libraries and Conditions of the Operation of Public Library and Information Services (Library Act) (hereinafter "the Act"):
§ 1
Subject matter
(1) This Regulation lays down rules on the grant of grants to library operators from the State Budget (hereinafter referred to as "grants') for projects under Article 15 (1) (b) to (h), (j) and (l) of the Act.
(2) This Regulation shall not apply to grants for:
(a) projects of science and research under Section 15 (1) (a) of the Act governed by specific legislation, 1)
(b) the construction or reconstruction of a library pursuant to Article 15 (1) (k) of the Act, which is governed by specific legislation.2)
Rules for granting subsidies pursuant to § 15 (1) (b) to (h), (j) and (l) of the Act
§ 2
The subsidy may be granted to the library operator registered in the library register, (3) which, at the date on which the application is submitted, does not have any payable obligations in relation to the state budget, to the state funds or to the budget of the local self-government and to the public health insurance and social security contributions and to the contribution to the state employment policy.
§ 3
The Ministry of Culture (hereinafter referred to as "the Ministry ') shall, by 30 September of the calendar year preceding the calendar year in which the subsidy is to be granted, publish on the Internet a selection grant procedure for the following calendar year for each area selected in accordance with paragraphs 7 to 15 of this Regulation.
§ 4
(1) The application for a subsidy contains:
(a) the name or business name of the library operator, the identification number of the person, the registered office and the legal form, if any;
(b) the name and, where applicable, the name and surname of the library operator, the place of permanent residence and the identification number of the person, if any, if any, if any, the natural person;
(c) the name and, where appropriate, the names of persons who are the statutory body or members of the statutory body, if the library operator is a legal person;
(d) banking connections;
(e) the tax identification number of the library operator;
(f) telephone number and e-mail address,
(g) a description of the project to which the subsidy is requested, including the date and place of implementation;
(h) the amount of subsidy required.
(2) The Annex to the application for subsidy contains at least:
(a) the detailed budget of the project, including the amount of the financial contribution of the library operator;
(b) a statement by the library operator of compliance with the conditions laid down in Article 2.
(3) The request shall be submitted to the Ministry in writing by 10 December of the calendar year preceding the calendar year in which the subsidy is to be granted.
§ 5
(1) The projects are assessed by the expert committees as advisory bodies set up by the Ministry, which are always evaluated by the Ministry
(a) the quality of the project, its social needs and expected benefits;
(b) the adequacy of the budgeted costs for each activity;
(c) professional standards and library facilities;
(d) the results of the implementation of the library operator's projects, provided that they have received subsidies in previous years.
(2) The deliberations of expert commissions shall be governed by the rules of procedure of the Ministry.
§ 6
(1) On the basis of the outcome of the selection procedure, the Ministry shall, by 31 March of the calendar year in which the grant is to be granted, issue a decision to grant the grant in accordance with specific legislation, 5) until the funds for the calendar year in question are exhausted. In deciding on applications for grants, account shall be taken of the ranking recommended by the expert committees on the basis of the aspects referred to in Article 5 (1).
(2) The grant may be granted up to 70% of the budgeted project implementation costs.
(3) The subsidy is granted by the Ministry within the deadlines set in the decision granting the subsidy.
§ 7
Subsidies for the implementation of new technologies in the field of public library and information services
The aim of the introduction of new technologies in the area of the provision of public library and information services is primarily:
(a) automation of library and information processes in which the declared library and technical standards recommended by the National Library of the Czech Republic are respected as a centre of standardisation activities;
(b) the integration of information sources and their qualitatively new accessibility through the central portal.
§ 8
Subsidies to support the interconnection of libraries in the network
The aim of promoting the interconnection of libraries in the network is in particular:
(a) the creation of cooperation systems based on information and communication technologies;
(b) improving the existing Internet connection of public libraries;
(c) an extension of the existing number of workstations for users.
§ 9
Subsidies for the processing and making available of information sources into electronic form
The purpose of processing information sources into electronic form and making them available is primarily:
(a) digitisation of library funds which comply with the relevant standards;
(b) the reformatting of documents threatened by the degradation of acidic paper which comply with the relevant standards;
(c) building and developing digital libraries and archives with a view to making digital data available in the long term;
(d) making catalogues available electronically;
(e) shared cataloguing of libraries and cooperative development and use of a set of national authorities within a comprehensive catalogue.
§ 10
Subsidy to supplement the library fund
The aim of complementing the library fund is primarily:
(a) purchase of printed non-periodic and periodic production corresponding to the library fund profile;
(b) the purchase of electronic information resources;
(c) purchase of a library fund in connection with the promotion of the development of national minorities.
§ 11
Subsidy to protect the library fund from adverse environmental effects
The aim of the protection of the library fund against adverse environmental effects is primarily:
(a) protection of library funds using the latest restoration methods and technologies in practice;
(b) preventing and eliminating adverse environmental effects on library funds;
(c) the removal of the consequences of an emergency.
§ 12
Subsidy for making library funds available to citizens with disabilities
The aim of making library funds available to citizens with disabilities is primarily:
(a) purchase of library funds for the blind and the weak-sighted,
(b) the purchase and installation of technical equipment for disabled citizens enabling access to the library;
(c) the purchase of technical equipment enabling access to library funds and electronic information resources for disabled citizens.
§ 13
Subsidies for cultural, educational and educational projects
The objectives of projects in the field of cultural, educational and educational activities are primarily:
(a) the development of reading;
b) organisation of lectures, seminars, meetings, competitions and exhibitions,
(c) publication of publications;
(d) Community activities of libraries and the provision of services for groups at risk of social exclusion.
§ 14
Subsidies to ensure further training of library staff
The aim of ensuring the continuing training of library staff is primarily the extracurricular training of library staff.
(a) working with information and communication technologies;
(b) cataloguing,
(c) in other areas necessary for the pursuit of the profession.
§ 15
Subsidy for equipment of library building by safety and fire protection systems
The purpose of the library building is primarily to provide security and fire protection systems.
(a) securing historical funds and library buildings before breaking and entering;
(b) the purchase and installation of security equipment to reduce the risk of theft by freely accessible library funds;
(c) security of library funds and objects by fire protection systems.
Common, transitional and final provisions
§ 20
(1) No subsidy can be granted if the library operator, as established by the Ministry
(a) has not properly, in a timely manner and in accordance with the decision to grant the grant of the payment of the subsidy to support libraries in the previous calendar year; or
(b) has not properly, in a timely manner and in accordance with the decision to grant the subsidy to the State Budget for the support of libraries provided in the previous calendar year or part thereof which it has not used or which it has used in contravention of the legislation or the decision to grant the subsidy.
(2) The subsidy may only be used for the purpose set out in the decision granting the subsidy.
(3) The subsidy may cover capital, normal and wage expenses related to the implementation of the project. In order to determine the specific amount of the wage subsidy, special legislation applies, 7), according to which the salaries of employees engaged in the same or comparable activities are determined.
§ 21
Specific legislation shall apply in order to check compliance with the conditions under which the subsidy was granted, the withdrawal procedure and the application of penalties for breaches of budgetary discipline in the management of the subsidy. 8)
§ 22
The selection procedure for library support announced by the Ministry before the date of entry into force of this Regulation shall be completed in accordance with the rules.
§ 23
This Regulation shall enter into force on 1 July 2002.
