THE LAW
Czech National Council
of 10 July 1990
on measures in the system of central government bodies of the Czech Republic
The Czech National Council decided on this law:
(1) The following central authorities are hereby established:
(a) the Ministry of Economic Policy and Development;
(b) the Ministry of National Property Management and its privatisation;
(c) the Ministry of Agriculture,
(d) Ministry of State Control.
(2) The following central government bodies of the Czech Republic are hereby repealed:
(a) Czech Commission for Planning and Scientific and Technological Development,
(b) Ministry of Agriculture and Nutrition,
(c) Ministry of Forestry and Wood Processing Industry,
(d) the Committee of People's Control of the Czech Republic,
(e) Czech Geological Authority.
(3) The existing scope resulting from the laws and other generally binding legislation passes
(a) from the Czech Commission for Planning and Scientific and Technological Development to the Ministry of Economic Policy and Development,
(b) from the Ministry of Finance in matters concerning the nationalisation and subsequent privatisation of national assets to the Ministry of Administration of National Assets and its privatisation;
(c) from the Ministry of Construction and Construction in the case of the production of building materials, with the exception of stone industry, prefabricated products and construction machinery, to the Ministry of Industry,
(d) from the Ministry of Agriculture and Nutrition
1. on the protection of the agricultural land fund to the Ministry of the Environment,
2. on other matters to the Ministry of Agriculture,
(e) from the Ministry of Forestry and Woodworking Industry
1. in the case of the paper and cellulose industry and the woodworking industry, to the Ministry of Industry,
2. on the protection of the forestry fund and the forestry economic plan for the Ministry of the Environment,
3. in other cases to the Ministry of Agriculture,
(f) the Ministry of the Environment on water management, with the exception of the protection of natural accumulation of water and water resources and the protection of the quality of surface and groundwater, to the Ministry of Agriculture,
(g) from the Committee of People's Control of the Czech Republic to the Ministry of State Control,
h) from the Czech Geological Office to the Ministry of the Environment.
(4) Rights and obligations arising from employment and other relationships are transferred in the context of the transition under this law
(a) from the Czech Commission for Planning and Scientific and Technological Development to the Ministry of Economic Policy and Development,
(b) from the Ministry of Finance to the Ministry of National Property Management and its privatisation;
(c) from the Ministry of Construction and Construction to the Ministry of Industry,
(d) from the Ministry of Agriculture and Nutrition to the Ministry of Agriculture and the Ministry of the Environment,
(e) from the Ministry of Forestry and Timber Industry to the Ministry of Industry, the Ministry of Agriculture and the Ministry of the Environment;
(f) from the Ministry of the Environment to the Ministry of Agriculture,
(g) from the Committee of People's Control of the Czech Republic to the Ministry of State Control,
h) from the Czech Geological Office to the Ministry of the Environment.
(5) On the transfer of rights and obligations under paragraph 4 (b) to (f), those central government bodies of the Czech Republic shall conclude an agreement specifying between themselves those rights and obligations. In particular in the agreement they shall determine which workers are to be assigned to the central authorities of the Czech state administration to which they are to be assigned under this Act.
The Act of the Czech National Council No. 2 / 1969 Coll., on the establishment of ministries and other central authorities of the Czech Socialist Republic, as amended by the Act of the Czech National Council No. 34 / 1970 Coll., the Act of the Czech National Council No. 60 / 1988 Coll., the Act of the Czech National Council No. 173 / 1989 Coll., the statutory measure of the Bureau of the Czech National Council No. 9 / 1990 Coll., the Act of the Czech National Council No. 126 / 1990 Coll. is amended as follows:

In the Czech Republic the following central government bodies of the Czech Republic are active, headed by a member of the Government of the Czech Republic:
1. the Ministry of Economic Policy and Development,
2. the Ministry of Finance,
3. the Ministry of National Property Management and its privatisation,
4. the Ministry of Construction and Construction,
5. Ministry of Education, Youth and Sports,
6. the Ministry of Culture,
7. Ministry of Labour and Social Affairs,
8. Ministry of Health,
9. The Ministry of Justice,
10. Ministry of the Interior,
11. Ministry of Industry,
12. Ministry of Agriculture,
13. Ministry of Trade and Tourism,
14. Ministry of State Control,
15. Ministry of Environment. '.
2. Paragraph 2 (1) deletes point 4.

"(1) The Ministry of Economic Policy and Development is the central body of the state administration in the economic policy and strategy development sector."
4. In Article 3 (2), the words "Czech Commission for Planning and Scientific and Technological Development 'are replaced by the words" Ministry of Economic Policy and Development'.
5. In Article 4, the words "with the exception of cases falling within the competence of the Ministry for the Management of National Property and its privatisation 'shall be inserted after the words" national property'.
6. The following Section 5 is inserted after Section 4:
The Ministry of National Property Management and its privatisation is the central body of the State Administration for Administration, Denationalisation and subsequent privatisation of National Property. '

The Ministry of Construction and Construction is the central body of the State Administration for Investment Development, Construction Production, Stone Industry, Prefabricated Products and Construction Engineering. '
8. In Paragraph 13, the following words are replaced by a comma at the end of the period: "paper and pulp and wood-working and for the production of building materials, excluding stone-making, prefabricated products and building machinery."
9. Article 15 (1) reads as follows:
"(1) The Ministry of Agriculture shall be the central authority of the State Administration for Agriculture, Forestry and Water, except for matters falling within the competence of the Ministry of the Environment, the food industry, hunting and fishing. '
10. in Article 15 (2), the words "the Ministry of Agriculture and Nutrition" shall be replaced by the words "the Ministry of Agriculture";
11. Paragraph 16 is deleted.
12. In Section 18, the words "the Committee of People's Control of the Czech Republic 'are replaced by the words" Ministry of State Control' and the words "State 'are added after the word" section'.
13. Article 19 (2) reads as follows:
"(2) The Ministry of the Environment is the central authority of the State for the protection of natural water and water resources accumulation and protection of the quality of surface and groundwater, for the protection of air, for the protection of nature, for the protection of the agricultural and forest land funds, for territorial planning and for building rules, for the field of geological research and exploration, for the ecological monitoring of mining and for technical and economic aspects of waste management. '
This Act shall take effect on 1 August 1990.
