Ministry of Foreign Affairs
The Ministry of Foreign Affairs states that on 7 June 1968, the European Convention on the abolition of the verification of documents drawn up by diplomatic representatives or consular officers was adopted in London.
On behalf of the Czech Republic, the Convention was signed in Strasbourg on 4 November 1997.
The Parliament of the Czech Republic gave its assent to the Convention and the President of the Republic ratified the Convention.
The Ratification Charter of the Czech Republic was deposited with the Secretary-General of the Council of Europe, depositary of the Convention, on 24 June 1998.
The Convention entered into force on 14 August 1970 pursuant to Article 6 (2) and entered into force on 25 September 1998 for the Czech Republic in accordance with paragraph 3 of that Article.
The Czech translation of the Convention is being announced simultaneously.
EUROPEAN CONVENTION
repealing the verification of documents drawn up by diplomatic agents
or consular officials
Member States of the Council of Europe, signatories to this Convention,
Considering that the aim of the Council of Europe is to establish a closer union between its members,
Considering that relations between Member States, as well as between their diplomatic representatives or consular officers, are increasingly based on mutual trust,
Bearing in mind that the abolition of the verification is aimed at strengthening relations between Member States as it allows the use of foreign documents in the same way as those issued by national authorities,
Convinced of the need to withdraw the requirement of verification of documents issued by their diplomatic representatives or consular officers;
agree as follows:
Článek 1
For the purposes of this Convention, verification shall mean only a formal act confirming the authenticity of the signature on the instrument, the right of the person to sign the instrument and, if necessary, the authenticity of the seal or stamp by which the instrument is affixed.
Článek 2
1. This Convention shall apply to documents drawn up by diplomatic representatives or consular officers of a Contracting Party acting under official authority and carrying out their duties in the territory of any State and which must be submitted:
(a) in the territory of another Contracting Party; or
(b) diplomatic representatives or consular officers of another Contracting Party who perform their functions in the territory of a State which is not a Party to this Convention.
2. This Convention shall also apply to official certificates, such as registration records of a particular instrument or to certificates of facts which have occurred at a certain time, and to the verification of the authenticity of signatures attached by diplomatic agents or consular officers to documents other than those referred to in paragraph 1.
Článek 3
Each Contracting Party shall withdraw the verification requirement of the documents covered by this Convention.
Článek 4
1. Each Contracting Party shall take the necessary measures to ensure that its authorities do not carry out verifications in cases where this Convention abolishes the verification requirement.
2. Where necessary, each Contracting Party shall confirm the authenticity of the instruments covered by this Convention. This confirmation shall not be subject to any charge or reimbursement of any costs and shall be carried out as quickly as possible.
Článek 5
This Convention shall, in relations between the Contracting Parties, be placed above the provisions of any Treaties, Conventions or Agreements which require or will require verification of the authenticity of the signature of diplomatic or consular officials, the status in which the signatory has acted and, where appropriate, the authenticity of the seal or stamp by which the instrument is affixed.
Článek 6
This Convention shall be open for signature to the Member States of the Council of Europe. It shall be subject to ratification or approval. The instruments of ratification or approval shall be deposited with the Secretary-General of the Council of Europe.
2. This Convention shall enter into force three months after the date of deposit of the third instrument of ratification or approval.
3. For each signatory State which subsequently ratifies or approves it, the Convention shall enter into force three months after the date of deposit of its instrument of ratification or approval.
Článek 7
1. After the entry into force of this Convention, the Council of Europe Committee of Ministers may invite any other State not a member of the Council of Europe to accede to this Convention.
2. Access shall be effected by the deposit of an instrument of access with the Secretary-General of the Council of Europe and shall take effect three months after the date of deposit.
Článek 8
1. Each Contracting Party may, at the time of signature or deposit of its instrument of ratification, approval or accession, designate one or more territories to which the Convention will apply.
2. Each Contracting Party may, when depositing its instrument of ratification, approval or accession or at any later date, extend the scope of this Convention to any other territory or territory designated in a declaration for whose international relations it is responsible or on whose behalf it is entitled to accept commitments.
3. Any declaration made pursuant to the preceding paragraph may be withdrawn in respect of any territory referred to in that declaration in accordance with the procedure laid down in Article 9 of this Convention.
Článek 9
This Convention shall remain in force without a time limit.
2. Each Contracting Party may denounce this Convention by notifying the Secretary-General of the Council of Europe.
3. The denunciation shall take effect six months after the date of receipt of such notification by the Secretary-General.
Článek 10
The Secretary-General of the Council of Europe shall notify the Member States of the Council and all States which acceded to this Convention of:
(a) each signature,
(b) the deposit of each instrument of ratification, approval or accession,
(c) each date of entry into force of this Convention,
(d) any declaration received in accordance with the provisions of Article 8,
(e) any notification received in accordance with the provisions of Article 9 and the date on which the notice becomes effective.
In order to prove the signature, duly empowered to do so, they have signed this Convention.
Done at London, 7 June 1968, in English and French, the two texts being equally authentic, in one copy to be deposited in the archives of the Council of Europe. The Secretary-General of the Council of Europe shall send certified copies to each signatory and acceding State.
