amending Decree No 382 / 2003 Coll., on animal health requirements for trade in animals and the animal health conditions governing their importation from third countries, as amended
The Ministry of Agriculture provides pursuant to § 78 of Act No. 166 / 1999 Coll., on Veterinary Care and on the amendment of certain related laws (Veterinary Act), as amended by Act No. 131 / 2003 Coll., Act No. 316 / 2004 Coll., Act No. 48 / 2006 Coll., Act No. 182 / 2008 Coll., Act No. 227 / 2009 Coll., Act No. 308 / 2011 Coll., Act No. 359 / 2012 Coll., Act No. 279 / 2013 Coll., Act No. 139 / 2014 Coll., and Act No. 264 / 2014 Coll., for implementation of § 8 (5), § 10 (3) (e), § 28 (5), § 31 (3) (a) and § 34 (5):
Decree No. 382 / 2003 Coll., on animal health requirements for trade in animals and on animal health conditions for imports from third countries, as amended by Decree No. 260 / 2005 Coll., Decree No. 156 / 2006 Coll. and Decree No. 416 / 2012 Coll., is amended as follows:
1. footnote 1 is deleted, including the footnote reference.
2. In footnote 1a, the words "Directive 2013 / 31 / EU of the European Parliament and of the Council of 12 June 2013 amending Council Directive 92 / 65 / EEC as regards animal health rules governing intra-Union trade in and imports into the Union of dogs, cats and ferrets shall be added at the end of the footnote. ';
3. Article 53, including the title and footnotes 14a, 19 and 20, reads:
Dogs, cats and ferrets
Dogs, cats and ferrets may be traded if:
(a) meet the conditions laid down in Articles 6 and 7 respectively, EU Regulation No 576 / 201314a);
(b) during the 48 hours prior to dispatch of the animals, a clinical examination has been carried out by a veterinarian approved by the Regional Veterinary Administration or by the competent authority of the Member State where it has been established at the time of the examination that the animals were fit for transport in accordance with Regulation (EC) No 1 / 200519; and
(c) are accompanied during transport to the place of destination by a health certificate stating that the approved veterinarian has recorded a clinical examination carried out in accordance with point (b) in the relevant section of the passport (20).
14a) Regulation (EU) No 576 / 2013 of the European Parliament and of the Council of 12 June 2013 on the non-commercial movement of pet animals and repealing Regulation (EC) No 998 / 2003.
19) Council Regulation (EC) No 1 / 2005 of 22 December 2004 on the protection of animals during transport and related activities and amending Directives 64 / 432 / EEC and 93 / 119 / EC and Regulation (EC) No 1255 / 97.
20) Article 21 (1) of Regulation (EU) No 576 / 2013 of 12 June 2013 on the non-commercial movement of pet animals and repealing Regulation (EC) No 998 / 2003. '
4. Paragraph 73 (3) reads as follows:
"(3) Dogs, cats and ferrets may be imported if:
(a) the import conditions are at least equivalent to those laid down in Article 10 (1) (a) to (d) and Article 12 (a) of Regulation (EU) No 576 / 201314a; and
(b) are accompanied, during transport to the place of destination, by a health certificate completed and signed by an official veterinarian of a third country, also stating that during the 48 hours prior to dispatch of the animals the approved veterinarian carried out a clinical examination showing that the animals were fit for transport at the time of the examination. "
footnote 16 is deleted.
Efficacy
This Decision shall enter into force on 29 December 2014.
