implementing the provisions of Act No. 166 / 1999 Coll., on Veterinary Care and on the amendment of certain related laws (Veterinary Act), on Animal Health and Protection, on the animal health conditions of import, export and transit of veterinary goods, on veterinary sanitation and on attestation studies
The Ministry of Agriculture shall determine, pursuant to Articles 5 (3), 6 (7), 8 (5), 28 (6), 34 (4), 36 (6), 41 (4), 51 (4), 54 (4), 59 (4), 60 (4), 64 (5), 66 (3) and 70 of Act No 166 / 1999 Coll., on veterinary care and on the amendment of certain related laws (animal health law) (hereinafter "the Act '):
VETERINARY CONDITIONS FOR IMPORTS, EXPORT AND TRANSIT OF VETERINARY GOODS
(1) An application for the establishment of animal health conditions for the importation of veterinary goods shall be submitted at least 30 days before the date of expected delivery of such goods, an application for the establishment of animal health conditions for the transit of animals at least 30 days before the date of expected entry into the domestic territory of such animals.
(2) The application referred to in paragraph 1 shall contain:
(a) the name, surname, domicile and object of the business (s) of the importer or of the carrier, if the person is a natural, commercial name, business name (s) and registered office of the importer or of the carrier, if the person is a legal person;
(b) identification number and telephone (fax) connections of importer or carrier,
(c) the country, zone and place of origin of the goods;
(d) particulars of the species, category and number of animals and their breeders, or the type, presentation, quantity and packaging of other veterinary goods, their producers and the place of storage;
(e) the means of transport of goods;
(f) the estimated date of import or transit of the goods;
(g) customs clearance or any other place where the goods will be subjected to veterinary checks on imported and accompanying veterinary goods (border veterinary inspection);
(h) the place of destination of the imported goods;
(i) where imports of animal products and feedingstuffs are concerned, also details explaining the importance of numerical and other characteristics on packaging and consumer packages indicating the date of manufacture, batch and consumption periods.
(3) The provisions of paragraph 2 shall apply mutatis mutandis to a request for the establishment of animal health conditions for repeated imports of the same veterinary goods or to repeated transit of animals for a certain period of time and for a certain territorial scope.
(4) When laying down animal health conditions for the import and transit of animals intended for release into the wild, account shall be taken in particular of the animal health situation in the country and region of origin of the animals, the animal health situation in the environment to which the animals are to be introduced, their biological needs, the way of life and the level of susceptibility to dangerous diseases.
(1) The issuing of the veterinary certificate for the export of veterinary goods shall be requested within the time limit necessary to comply with the animal health conditions of the required countries of destination and, where applicable, the transit country, but not less than 14 days before the date of expected exit of the veterinary goods abroad.
(2) Unless otherwise provided for in the international agreement to which the Czech Republic is bound, and unless otherwise provided for in the agreement of the veterinary authorities with the competent authorities of the country of destination or, where applicable, the country of transit or the country of origin of the goods,
(a) the health certificate for the export of veterinary goods shall be drawn up in the Czech language and in the language of the country of destination, where appropriate in the English language;
(b)
1. imported veterinary goods are accompanied by a health certificate drawn up in the language of the country of origin or in the English language and in the Czech language,
2. accompanying veterinary goods are accompanied by a health certificate drawn up in the language of the country of origin or in the English language and in the language of the country of destination.
(3) The health certificate for the export of veterinary goods certifies compliance with the animal health conditions, the countries of destination and, where applicable, the transit country, the veterinary certificate accompanying the imported or accompanying veterinary goods, the compliance with the animal health conditions laid down in the import or transit procedure.
(4) Where a veterinary certificate is drawn up on several sheets, those sheets shall be so joined or labelled as to prevent confusion.
(5) Where a bulk consignment of imported veterinary goods to which a single veterinary certificate has been issued is divided into several sub-consignments intended for different destinations, each partial consignment shall be accompanied by a certified photocopy or a certified copy of the original veterinary certificate, or a separate health certificate, issued on the basis of the original veterinary certificate by the district veterinary administration of the border veterinary centre concerned. This veterinary certificate shall, inter alia, indicate the type and designation of the original means of transport from which the goods have been broken down into sub-consignments.
(1) The establishment of animal health conditions is not required
(a) the importation and transit of veterinary goods which do not have a commercial character (3) and which are carried by road as luggage, express mail, air waybill or by mail, if
1. Dogs, cats, poultry, rabbits, pigeons (except postal pigeons, participating in flight competitions), guinea pigs, hamsters and other rodents, pet-bred singing and ornamental birds, small beasts and birds of prey, used for hunting, if these animals stay within the country for 30 days and are not intended for experimental purposes,
2. reptiles, amphibians and aquarium fish, not for dangerous animal species, 4)
3. With food of animal origin heat-treated and, where appropriate, otherwise deprived of pathogens up to a total weight of 5 kg,
4. processed furskins, tanned hides and skins and wool cut,
5. on prepared hunting trophies,
(b) import a reasonable quantity
1. food of animal origin intended for its own use by the representative office;
2. veterinary goods with the exception of animals intended for trade fairs, exhibitions and banquets or for scientific purposes, provided that such goods are used exclusively for those purposes and are not placed on the trading network.
(2) A health certificate is not required for the importation and transit of veterinary goods which are not of a commercial nature and which are carried by road as luggage, express mail, air waybill, or by post, if:
(a) dogs over 3 months of age, accompanied by evidence of vaccination against rabies, or - if these animals come from a country in which vaccination against rabies is not authorised - by evidence of a clinical test for rabies with a negative result, carried out not more than 72 hours before the date of arrival or dispatch, provided that the period of residence of those animals within the country does not exceed 30 days;
(b) dogs less than 3 months old, cats and small animals used for hunting, accompanied by evidence of vaccination against rabies, or evidence of a clinical test for rabies with negative results, carried out not more than 72 hours before the date of arrival or dispatch, unless the stay of such animals in the country exceeds 30 days;
(c) guinea pigs, hamsters and other rodents, entertained singing and ornamental birds and birds of prey used for hunting, provided that the duration of these animals' stay within the country does not exceed 30 days;
(d) reptiles, amphibians and aquarium fish,
(e) the veterinary goods referred to in paragraph 1 (a) (3) to (5).
Border veterinary inspection
(1) The importer or carrier of veterinary goods subject to border veterinary control or, where appropriate, his representative, shall submit to the border veterinary station "Confirmation of border veterinary inspection of the imported goods," hereinafter referred to as "the certificate" with the first part completed by him, in an original of 3 copies.
(2) Person referred to in paragraph 1
(a) ensure that such control is carried out under conditions appropriate to health and safety legislation at work and that the means of transport is not moved during the inspection;
(b) provide the veterinary surgeon with the veterinary authority (the official veterinarian) carrying out this inspection, at his request, with the necessary manpower and means of supporting work, such as the opening and closing of means of transport, the introduction of ladders, bridges and mobile steps, the fixation of animals, the movement of animals, etc.
(3) Where border veterinary checks are carried out in the premises of the carrier (railway station, port, airport) or post office, carrier or post office
(a) ensure the necessary office and other rooms and premises for its implementation (in particular, if they are carriers, the temporary segregation of animals, the segregation of animal products and feed and the stowage of carcases) with effective equipment and equipment and keeps them in an operational state, appropriate to the nature and purpose of border veterinary checks;
(b) establish the conditions for the necessary measures to prevent the introduction of dangerous diseases from abroad.
(1) Border veterinary inspection shall consist of checking the completeness and validity of the accompanying and transport documents, in particular the veterinary certificate, and of verifying the identity and origin of the imported and accompanying veterinary goods (hereinafter referred to as "documentary and identification checks") and, where appropriate, inspection of such goods, packaging and means of transport and sampling for laboratory examination (hereinafter referred to as "physical checks").
(2) Physical checks are carried out on imports and transit
(a) animals,
(b) other veterinary goods, where there is any doubt as to compliance with the animal health conditions laid down for importation or transit, or the health and veterinary status of such goods.
(3) The number of dead animals shall also be checked for physical checks.
(4) The border veterinary inspection shall, as a general rule, be carried out in conjunction with a customs and, where appropriate, plant health inspection accompanied by the person referred to in Section 13 (1). The result shall be recorded on the second part of the certificate and stamped at the border veterinary station. The original of the certificate shall accompany the imported veterinary goods to the place of destination, shall be transmitted by 1 copy to the customs authorities and to the person referred to in Article 13 (1); the remaining copy shall be kept by the border veterinary stations for 3 years.
Veterinary inspection at the place of destination
The consignee of the veterinary goods subject to veterinary checks at the place of destination,
(a) submit to the district veterinary authority the destination of the imported veterinary goods, accompanying and transport documents,
(b) quarantine imported animals which have been approved for that purpose by the district veterinary administration and store other imported goods in warehouses approved for that purpose by the district veterinary administration;
(c) establish the necessary conditions for carrying out the veterinary checks at the place of destination, including the provision of the necessary synergies and assistance to the official veterinarian carrying out the checks.
(1) Veterinary checks on animals at the place of destination shall consist of documentary and identification checks and physical checks, including health checks and identification of the number of dead animals.
(2) The veterinary inspection of the other veterinary goods at the place of destination consists of documentary and identification checks. A physical check shall be carried out if the consignment of goods of the same kind and origin has been so controlled for a period of 6 months, if any doubts arise as to compliance with the animal health requirements laid down for imports or the health and veterinary status of such goods, or if it relates to goods returned by the competent authorities of the country to which they were to be exported or to which they should have been carried out.
(3) The veterinary inspection at the place of destination shall be carried out promptly but no later than 24 hours after the competent veterinary authority has been informed of the arrival of the goods at the place of destination. Until its completion, imported animals shall remain in quarantine under veterinary supervision, other imported veterinary goods separately stored under seal.
